【摘要】：我國傳統(tǒng)出版業(yè)經(jīng)過多年持續(xù)高速增長,已經(jīng)發(fā)展為具有一定規(guī)模的產(chǎn)業(yè),然而這一過程中也伴隨著諸多問題,其中由于版權保護缺位引致的版權侵權問題尤為嚴峻。以往的國內(nèi)研究或者僅測算全國或各地區(qū)版權保護強度,或者僅就版權保護對傳統(tǒng)出版業(yè)的影響進行定性分析或描述統(tǒng)計,缺乏對兩者數(shù)量關系的深入研究。因此對我國版權保護強度進行科學的、令人信服的評估,進而采用規(guī)范的定量分析方法研究其對傳統(tǒng)出版業(yè)的影響是十分有必要的。 本研究以1978-2012年我國版權保護與傳統(tǒng)出版業(yè)為研究對象,構建由立法強度和執(zhí)法強度兩個維度組成、涵蓋多個指標的指標體系評估版權保護強度。通過理論模型分析版權保護對傳統(tǒng)出版業(yè)的影響機制,繼而采用計量分析方法對模型得出的命題進行檢驗。在此基礎上,為了對問題有更深入的認識,本研究分別分析了立法強度和執(zhí)法強度對傳統(tǒng)出版業(yè)影響的方向和程度,以期得到更具現(xiàn)實指導意義的結論。 研究結果表明,總體而言,版權保護強度對于傳統(tǒng)出版業(yè)產(chǎn)量、利潤有正向促進作用,且邊際作用遞減；版權保護立法強度對傳統(tǒng)出版業(yè)產(chǎn)量、利潤有正向促進作用；版權保護執(zhí)法強度對傳統(tǒng)出版業(yè)產(chǎn)量、利潤有正向促進作用,且邊際作用遞增�？梢姮F(xiàn)階段仍有必要采取措施提高版權保護強度,而從提高執(zhí)法強度的角度展開,有可能是事半功倍的。 文章也對本研究就行了反思,并在最后提出了針對性的對策建議。
[Abstract]:China's traditional publishing industry has developed into a certain scale industry after years of sustained and rapid growth. However, there are many problems in this process, especially the copyright infringement caused by the absence of copyright protection. Previous domestic studies have only measured the intensity of copyright protection in China or in various regions, or only carried out qualitative analysis or descriptive statistics on the impact of copyright protection on the traditional publishing industry, but lack of in-depth research on the quantitative relationship between the two. Therefore, it is necessary to evaluate the intensity of copyright protection in China scientifically and convincingly, and then to study the influence of copyright protection on traditional publishing industry by means of normative quantitative analysis. This study takes the copyright protection and traditional publishing industry in China from 1978 to 2012 as the research object, and constructs an index system to evaluate the copyright protection intensity, which consists of two dimensions: legislative intensity and enforcement intensity. This paper analyzes the influence mechanism of copyright protection on traditional publishing industry through theoretical model, and then uses econometric analysis method to test the propositions obtained by the model. On this basis, in order to have a deeper understanding of the problem, this study analyzes the direction and extent of the impact of legislative intensity and law enforcement intensity on the traditional publishing industry respectively, in order to obtain a more realistic and instructive conclusion. The results show that, in general, the intensity of copyright protection has a positive effect on the output of the traditional publishing industry, and the marginal effect is decreasing, and the intensity of copyright protection legislation has a positive effect on the output and profit of the traditional publishing industry. The enforcement intensity of copyright protection has a positive effect on the output and profit of traditional publishing industry, and the marginal effect is increasing. We can see that it is necessary to take measures to improve the intensity of copyright protection at the present stage, and from the angle of enhancing the intensity of law enforcement, it is possible to achieve twice the result with half the effort. The article also reflects on this study and puts forward some countermeasures and suggestions at the end.
