【摘要】：孤兒作品版權(quán)使用問題在數(shù)字網(wǎng)絡(luò)技術(shù)與新興文化利用模式交互發(fā)展時(shí)期更加突出。在對孤兒作品"盡力查找"時(shí)應(yīng)以使用人為查找主體而以著作權(quán)行政管理部門或其指定機(jī)構(gòu)為認(rèn)定主體,并遵循相應(yīng)的查找原則和查找路徑;使用費(fèi)可參照法定許可標(biāo)準(zhǔn)并酌情考量市場因素;此外,孤兒作品的利用應(yīng)延及非數(shù)字化形式;救濟(jì)規(guī)則的設(shè)計(jì)則需兼顧公平與效率。
[Abstract]:The problem of copyright usage of orphan works is more prominent in the period of interactive development between digital network technology and new cultural utilization mode. When searching for orphans' works, the author should take the copyright administrative department or its designated agency as the main body, and follow the corresponding principles and ways of searching. In addition, the use of orphan works should be extended to non-digital forms, and the design of relief rules should take account of fairness and efficiency.
