【摘要】：職務(wù)作品指的“員工在受雇傭期間和受雇傭范圍內(nèi)所創(chuàng)作的作品”。職務(wù)作品制度的關(guān)鍵在于職務(wù)作品著作權(quán)的分配,而分配的依據(jù)就是對(duì)雙方各自承擔(dān)之義務(wù)的認(rèn)定。認(rèn)定單位的義務(wù),正是為了確定單位享有著作權(quán)的條件,這就是職務(wù)作品中單位義務(wù)認(rèn)定的意義之所在。 我國(guó)的現(xiàn)行法中對(duì)職務(wù)作品中的權(quán)利歸屬雖然通過一般職務(wù)作品與特殊職務(wù)作品二分的規(guī)定區(qū)別了權(quán)利歸屬的不同情況,然而對(duì)權(quán)利分配依據(jù)的規(guī)定過于粗糙,尤其是對(duì)單位承擔(dān)的義務(wù)規(guī)定不清,無法作為單位取得職務(wù)作品著作權(quán)的具體標(biāo)準(zhǔn),因此,我們必須對(duì)單位義務(wù)的認(rèn)定予以重構(gòu)。 為了重構(gòu)單位義務(wù)的認(rèn)定標(biāo)準(zhǔn),筆者從著作權(quán)取得的理論依據(jù)入手,論證了單位承擔(dān)義務(wù)與取得著作權(quán)之間的因果關(guān)系,然后從作品的異化和作者的變化這兩個(gè)角度闡述了單位參與作品創(chuàng)作的過程,并分析了單位在作品創(chuàng)作中的地位和作用,奠定了單位義務(wù)認(rèn)定的基礎(chǔ)。隨后,筆者著重分析了我國(guó)現(xiàn)行法上對(duì)職務(wù)作品規(guī)定,通過對(duì)其外部范圍和內(nèi)部種類的界定指出了現(xiàn)行規(guī)定的不合理性。 通過對(duì)理論和法律規(guī)制的分析,筆者提出了單位義務(wù)認(rèn)定的具體標(biāo)準(zhǔn)： 1.明確職務(wù)作品的范圍,確立職務(wù)作品單位義務(wù)分析的前提條件。堅(jiān)持將智力投入者與財(cái)產(chǎn)投入者之間的關(guān)系作為作品劃分的原因基礎(chǔ),糾正目前法人作品、職務(wù)作品、委托作品分類混亂的現(xiàn)狀,限定職務(wù)作品的適用范圍。 2.明確職務(wù)作品單位承擔(dān)義務(wù)的性質(zhì)。單位承擔(dān)的性質(zhì)就是一種財(cái)產(chǎn)性義務(wù),這是由單位非生理性的本質(zhì)決定的,也與單位一直以來在作品創(chuàng)作中扮演的財(cái)產(chǎn)投入者的身份相符。盡管單位也會(huì)為職務(wù)作品的創(chuàng)作提出要求、提供建議,但這并沒有改變單位作為財(cái)產(chǎn)性投入者的地位。 3.堅(jiān)持職務(wù)作品中單位義務(wù)認(rèn)定的原則和一般標(biāo)準(zhǔn),判斷具體作品中單位義務(wù)的承擔(dān)情況,以確定單位享有著作權(quán)的資格和權(quán)利內(nèi)容。首先,我們要看單位提供的財(cái)產(chǎn)性投入是否對(duì)作品的完成發(fā)揮了主要作用。其次,看作品的性質(zhì)對(duì)單位義務(wù)認(rèn)定的影響。
[Abstract]:Duty works refer to "works created by employees during employment and within the scope of employment". The key to the system of duty works lies in the distribution of copyright in the work of duty, and the basis for distribution is the determination of the obligations of both parties. The obligation of the affirming unit is precisely to determine the conditions under which the unit enjoys copyright, which is duty. The meaning of the unit's obligation cognizance in works.
In the current law of our country, although the ownership of the right in the work of duty is different from that in the work of special duty through the dichotomy between the work of general duty and the work of special duty, the stipulation of the basis for the distribution of the right is too rough, especially the stipulation of the obligation undertaken by the unit is not clear, and the copyright of the work of duty can not be obtained as a unit. Therefore, we must reconstruct the identification of unit obligations.
In order to reconstruct the criteria for determining the obligations of a unit, the author begins with the theoretical basis of copyright acquisition, demonstrates the causal relationship between the obligations of a unit and the acquisition of copyright, then expounds the process of the unit participating in the creation of a work from the perspectives of alienation of the work and the change of the author, and analyzes the status of the unit in the creation of a work. After that, the author emphatically analyzes the provisions of the current law of our country on duty works, and points out the irrationality of the current provisions by defining their external scope and internal types.
Through the analysis of theory and legal regulation, the author puts forward specific criteria for the determination of unit obligations.
1. Define the scope of the work, establish the premise of the duty analysis of the work unit. Adhere to the relationship between intellectual investors and property investors as the basis for the division of the work, rectify the current juridical person work, job work, entrusted work classification confusion, limit the scope of application of the work.
2. Define the nature of the obligation of the work unit. The nature of the work unit is a kind of property obligation, which is determined by the non-physiological nature of the unit, and is consistent with the identity of the property investor that the unit has been playing in the creation of the work. Although the unit will also put forward requirements for the creation of the work, provide suggestions, but this is. It has not changed the status of units as property investors.
3. Adhere to the principles and general criteria for determining the obligations of the units in the work of duty, and judge the obligations of the units in the specific work so as to determine the qualifications and rights of the units to enjoy copyright. First of all, we should see whether the property input provided by the units has played a major role in the completion of the work. Second, we should look at the nature of the work to the units.
