【摘要】：網絡商業(yè)小說是隨著互聯網的興起而出現的一種極具我國特色的網絡原創(chuàng)文學。因為網絡具有虛擬性、技術性、全球性和傳播快捷性等特點,又因為網絡商業(yè)小說的自身特性及我國涉及這方面的法律法規(guī)很少,且這些法律法規(guī)中還存在著內容過于籠統或者不符合現實情況等問題,導致我國存在著十分嚴重的網絡商業(yè)小說著作權侵權現象。在學術研究方面,我國學者對這一問題的研究也存在著諸多不足。本文在借鑒眾多學者相關研究成果的基礎上,對網絡商業(yè)小說著作權侵權這一問題進行了探討,并提出了淺薄的解決建議,共分為四個部分:第一部分對網絡商業(yè)小說的概念進行了界定,并從法律關系角度系統地論述網絡商業(yè)小說的著作權。第二部分對網絡商業(yè)小說著作權侵權理論進行了分析,主要分析了網絡商業(yè)小說著作權侵權行為的構成要件、類型及責任承擔方式。第三部分分析了我國網絡商業(yè)小說著作權侵權的基本現狀,論述了我國相關法律制度存在的問題。第四部分為完善我國網絡商業(yè)小說著作權保護制度提出了個人建議。主要從兩個方面進行完善,分別為借鑒國外相關立法中的精華部分和完善我國的相關法律法規(guī)制度。
[Abstract]:With the rise of the Internet, the network business novel is a kind of network original literature with Chinese characteristics. Because the network is fictitious, technical, global and quick to spread, and because of its own characteristics and the few laws and regulations concerning this area in our country, And these laws and regulations also exist in the content too general or not in line with the actual situation and other problems, resulting in the existence of a very serious network business novel copyright infringement phenomenon. In the aspect of academic research, there are many deficiencies in the research of Chinese scholars. Based on the research results of many scholars, this paper discusses the problem of copyright infringement of network commercial novels, and puts forward some suggestions to solve the problem. It is divided into four parts: the first part defines the concept of the network commercial novel, and systematically discusses the copyright of the network commercial novel from the angle of legal relationship. In the second part, the author analyzes the theory of copyright infringement of network commercial novels, mainly analyzes the composing elements, types and ways of liability of copyright infringement of network commercial novels. The third part analyzes the basic situation of copyright infringement of network commercial novels in our country, and discusses the problems existing in the relevant legal system of our country. The fourth part puts forward personal suggestions for perfecting the copyright protection system of network commercial novels in China. Mainly from two aspects to improve, respectively for the reference of the essence of foreign legislation and improve the relevant laws and regulations of our country.
