【摘要】：隨著互聯(lián)網(wǎng)技術(shù)的不斷發(fā)展,信息網(wǎng)絡(luò)傳播行為變得更加便利,信息網(wǎng)絡(luò)傳播權(quán)的侵權(quán)糾紛和侵權(quán)形式也逐漸增多,給現(xiàn)有的相關(guān)立法和司法帶來了諸多考驗與挑戰(zhàn)。本文將結(jié)合現(xiàn)有的著作權(quán)方面的法律法規(guī)及其相關(guān)的理論知識和典型案例,主要運(yùn)用案例分析法和價值分析法對本文進(jìn)行相關(guān)的闡述,并從立法角度對一些重要的問題提出了自己的想法。本文的主要內(nèi)容包括以下幾個部分:第一,緒論部分提綱挈領(lǐng)地介紹了寫作本論文的理論背景和實踐背景,為更好地開啟下文的寫作奠定了堅實的基礎(chǔ)。第二,正文部分在對信息網(wǎng)絡(luò)傳播權(quán)的概念和特征進(jìn)行簡要介紹后,緊接著就轉(zhuǎn)入了本文的核心內(nèi)容,即信息網(wǎng)絡(luò)傳播權(quán)侵權(quán)的概念、特征、侵權(quán)行為的分類以及侵權(quán)的構(gòu)成要件等幾個方面,尤其對信息網(wǎng)絡(luò)傳播權(quán)侵權(quán)的歸責(zé)原則,分別從學(xué)術(shù)界主要的理論觀點和自己的見解兩個方面作了詳細(xì)闡述。正文的最后,是對信息網(wǎng)絡(luò)傳播權(quán)的立法現(xiàn)狀中存在的一些問題進(jìn)行了細(xì)致分析,并分別提出了相應(yīng)的解決方案,以便更好地讓法律服務(wù)于司法實踐。第三,在結(jié)論部分,對本文的重點內(nèi)容進(jìn)行了梳理歸納,并對如何能夠更好的完善信息網(wǎng)絡(luò)傳播權(quán)的相關(guān)法律制度提出了自己的看法。其實,任何一項法律制度的創(chuàng)立、成熟和完善都離不開社會各界的共同努力。本文的研究價值主要在于通過對相關(guān)理論的闡述和典型案例的剖析,發(fā)現(xiàn)立法和司法實踐中存在的問題,進(jìn)而對我國信息網(wǎng)絡(luò)傳播權(quán)立法保護(hù)的完善建言獻(xiàn)策。
[Abstract]:With the continuous development of Internet technology, the communication behavior of information network has become more convenient, the infringement disputes and the forms of infringement of the right of information network spread are increasing, which have brought many challenges and challenges to the existing relevant legislation and judicature. This article will combine the existing laws and regulations of the copyright side and the relevant theoretical knowledge and code. The main contents include the following parts: first, the introduction part outlines the theoretical background and practical background of the paper, which is better for the better. Second, after a brief introduction to the concept and characteristics of the right to communication of information network, the main body of the text has been transferred to the core content of this article, namely, the concept, characteristics, classification of tort and the constitutive requirements of tort, especially on the infringement. The principle of imputation for the infringement of the right of information network communication is elaborated in detail from two aspects of the main theoretical viewpoint and own opinion of the academic circle. The final part of the text is the detailed analysis of some problems in the legislative status of the right of information network communication, and the corresponding solutions are put forward in order to make the law better. To serve the judicial practice. Third, in the concluding part, the key content of this article is summarized and the views on how to better improve the relevant legal system of the right of information network communication are put forward. In fact, the establishment, maturity and good of any legal system can not be separated from the common efforts of all walks of life. The main value is to find out the existing problems in the legislative and judicial practice through the exposition of the relevant theories and the analysis of the typical cases, and then to make suggestions for the perfection of the legislative protection of the right to communication of information network in China.
