民間文學(xué)藝術(shù)作品著作權(quán)保護研究

【摘要】:民間文學(xué)藝術(shù)作品作為我國重要的非物質(zhì)文化遺產(chǎn),隨著科學(xué)技術(shù)的發(fā)展,其內(nèi)在價值越來越受到重視,并將成為國際社會中日漸重要的戰(zhàn)略資源之一。盡管該課題在50年代非洲國家已提出保護立項,由于國際地位的懸殊,發(fā)達國家與發(fā)展中國家對民間文學(xué)藝術(shù)作品的保護大不相同,F(xiàn)實生活中侵犯民間文學(xué)藝術(shù)作品的情形屢見不鮮,對民間文學(xué)藝術(shù)作品的保護是發(fā)展之趨。本文試圖從中國第一著作權(quán)糾紛案《烏蘇里船歌》入手,分析民間文學(xué)藝術(shù)作品著作權(quán)保護的正當(dāng)性,以期為我國進一步的立法提供一些指導(dǎo)。 以《烏蘇里船歌案》為引,首先對我國民間文學(xué)藝術(shù)作品的保護現(xiàn)狀進行分析,其次,從對民間文學(xué)藝術(shù)作品的界定出發(fā),對其概念、特征及與相關(guān)概念的區(qū)別進行分析,為下文的進一步論述框定范圍。隨后從經(jīng)濟學(xué)視角、文化視角、法理學(xué)的角度三個視角論述對民間文學(xué)藝術(shù)作品著作權(quán)保護的正當(dāng)性,并通過對域外公約/國內(nèi)法有關(guān)民間文學(xué)藝術(shù)作品的立法實踐以期對我國有所啟示,最后闡述了當(dāng)前我國民間文學(xué)藝術(shù)作品著作權(quán)保護制度之路—特殊版權(quán),并從權(quán)利主體、權(quán)利內(nèi)容、保護期限、侵權(quán)行為與法律救濟進行論述。
[Abstract]:As an important intangible cultural heritage of our country, folk literature and art works, with the development of science and technology, their intrinsic value is paid more and more attention, and will become one of the increasingly important strategic resources in the international community. Although the protection project has been put forward in African countries in the 1950s, the protection of folklore works in developed countries and developing countries is very different from that in developing countries because of the great difference in international status. The situation of infringing folk literature and art works is common in real life, and the protection of folk literature and art works is the trend of development. This paper attempts to analyze the legitimacy of copyright protection of folklore works from the case of the first copyright dispute in China, "the ship Song of Ursuli", in order to provide some guidance for the further legislation of our country. Based on the case of "the boat song in Ursuli", this paper first analyzes the current situation of the protection of folk literature and art works in China, and secondly, analyzes the concept, characteristics and differences between them from the definition of the works of folk literature and art. Frame the scope for further discussion below. Then from the perspective of economics, culture and jurisprudence, it discusses the legitimacy of copyright protection of folklore works. And through the legislative practice of the extraterritorial convention / domestic law on folklore and art works in order to enlighten our country, this paper finally expounds the road of copyright protection system of folklore works in our country at present-special copyright, and the subject of right. The content of right, time limit of protection, tort and legal remedy are discussed.
