【摘要】：權(quán)利窮竭是重要的版權(quán)權(quán)利限制制度。價值預(yù)設(shè)、理論基礎(chǔ)和正外部性是理解權(quán)利窮竭的三大要點。其中價值預(yù)設(shè)表明,權(quán)利窮竭創(chuàng)設(shè)的初衷在于對知識產(chǎn)品的售后限制進(jìn)行結(jié)構(gòu)性控制。數(shù)字時代的到來使得權(quán)利窮竭遭遇了嚴(yán)峻挑戰(zhàn),但是售后限制問題依然存在并且愈演愈烈。從基礎(chǔ)理論批判中推導(dǎo)出的"3-3-1"沙漏模型有助于對權(quán)利窮竭的適用條件進(jìn)行調(diào)整,以便在個案中判斷權(quán)利窮竭是否適用。
[Abstract]:Exhaustion of rights is an important restriction system of copyright rights. Value presupposition, theoretical basis and positive externality are the three main points to understand the exhaustion of rights. Value presupposition indicates that the original intention of right exhaustion is to control the post-sale restriction of knowledge products. The arrival of the digital age makes the exhaustion of rights meet a severe challenge, but the problem of post-sale restrictions still exists and becomes more and more serious. The "3-3-1" hourglass model derived from the criticism of basic theory is helpful to adjust the applicable conditions of exhaustion of rights in order to judge the applicability of exhaustion of rights in individual cases.
