【摘要】：隨著科技日新月異,計(jì)算機(jī)技術(shù)與通信技術(shù)的迅猛發(fā)展和結(jié)合促進(jìn)了全球網(wǎng)絡(luò)環(huán)境的迅速形成,并不斷改變著人類的生存方式和思維模式,數(shù)字技術(shù)與網(wǎng)絡(luò)技術(shù)引發(fā)的新技術(shù)革命對傳統(tǒng)印刷環(huán)境下的著作權(quán)保護(hù)問題產(chǎn)生了巨大的影響,既促進(jìn)了著作權(quán)法相關(guān)制度的革新與優(yōu)化,也給著作權(quán)法帶來一定沖擊與挑戰(zhàn),誕生于傳統(tǒng)環(huán)境,旨在平衡著作權(quán)人、使用者和社會(huì)公眾三方利益的合理使用制度的作用已顯得有些力不從心。 為了加快我國網(wǎng)絡(luò)著作權(quán)合理使用制度的完善步伐,重新恢復(fù)利益的天平,加強(qiáng)對置于網(wǎng)絡(luò)環(huán)境中的作品的保護(hù)和明確公眾對網(wǎng)絡(luò)作品合理使用的標(biāo)準(zhǔn),本文在認(rèn)真分析互聯(lián)網(wǎng)背景下的作品所呈現(xiàn)出的新特點(diǎn)的基礎(chǔ)上,利用綜合比較現(xiàn)有的研究成果的方法,借鑒國際社會(huì)在互聯(lián)網(wǎng)領(lǐng)域著作權(quán)保護(hù)的成功經(jīng)驗(yàn),探討合理使用制度的判斷標(biāo)準(zhǔn),適當(dāng)調(diào)整網(wǎng)絡(luò)環(huán)境下合理使用制度的適用范圍,為我國相關(guān)立法提供參考思路,以期完善進(jìn)入網(wǎng)絡(luò)時(shí)代后,既符合我國國情又能應(yīng)對新技術(shù)帶來的新問題的合理使用制度體系,最終達(dá)到更好的保護(hù)人類智力成果和各方的切身利益的成效。 本文第一部分對于網(wǎng)絡(luò)與知識產(chǎn)權(quán)法的關(guān)系,我國網(wǎng)絡(luò)發(fā)展現(xiàn)狀,以及近年來我國法院受理審理知識產(chǎn)權(quán)案件情況進(jìn)行了介紹。第二部分系網(wǎng)絡(luò)著作權(quán)合理使用基本概念和基本理論的介紹,解釋了著作權(quán)合理使用和網(wǎng)絡(luò)著作權(quán)合理使用這兩者的概念和由來,是后文展開論述的基礎(chǔ)。第三部分著重在于對我國網(wǎng)絡(luò)著作權(quán)合理使用現(xiàn)狀進(jìn)行分析,分析我國現(xiàn)有的法律法規(guī)、現(xiàn)有行政條例規(guī)章,以及在我國生效的國際條約中有關(guān)網(wǎng)絡(luò)著作權(quán)合理使用是如何規(guī)定的、存在哪些問題。在對現(xiàn)狀和存在問題進(jìn)行初步分析的基礎(chǔ)上,對中國網(wǎng)絡(luò)著作權(quán)合理使用制度進(jìn)行了理論思考和現(xiàn)狀分析。對網(wǎng)絡(luò)著作權(quán)合理使用的理論思考,包括對法哲學(xué)精神下的平等、公平、公共利益等價(jià)值的思考,對網(wǎng)絡(luò)著作權(quán)合理使用精神內(nèi)核即利益平衡原則的思考；對我國網(wǎng)絡(luò)著作權(quán)合理使用實(shí)踐的思考,主要是分析立法中存在的問題和實(shí)踐中必須考慮的因素。第四部分則在前文分析的基礎(chǔ)上針對如何完善我國的網(wǎng)絡(luò)著作權(quán)合理使用制度提出明確的建議,力求盡快建立起以法律規(guī)制為主,不斷強(qiáng)化法律干預(yù)的主要作用,同時(shí)積極拓展網(wǎng)絡(luò)著作權(quán)合理使用由相關(guān)民間自治的實(shí)踐空間的適合我國的網(wǎng)絡(luò)著作權(quán)合理使用管理體系。
[Abstract]:With the rapid development of science and technology, the rapid development and combination of computer technology and communication technology promote the rapid formation of the global network environment, and constantly change the way of life and mode of thinking of human beings. The new technological revolution caused by digital technology and network technology has had a great impact on the copyright protection under the traditional printing environment, which not only promoted the innovation and optimization of the relevant system of copyright law, but also brought certain impact and challenge to the copyright law. Born in the traditional environment, it is difficult to balance the interests of copyright owners, users and the public. In order to speed up the perfection of the system of rational use of network copyright in our country, to restore the balance of interests, to strengthen the protection of works placed in the network environment and to clarify the standards for the rational use of network works by the public, On the basis of analyzing the new characteristics of the works in the background of the Internet, using the method of synthetically comparing the existing research results, this paper draws lessons from the successful experience of the international community in the field of copyright protection in the field of Internet. This paper probes into the judgment standard of the reasonable use system, adjusts the application scope of the reasonable use system under the network environment, and provides reference ideas for the relevant legislation of our country, in order to perfect the network era after entering the network era. The system of rational use of the system which not only conforms to the national conditions of our country but also can deal with the new problems brought about by the new technology can finally achieve the effect of better protecting the human intellectual achievements and the vital interests of all parties. The first part of this paper introduces the relationship between network and intellectual property law, the current situation of network development in China, and the cases of intellectual property accepted by Chinese courts in recent years. The second part is the introduction of the basic concept and basic theory of the rational use of network copyright, which explains the concept and origin of the rational use of copyright and the rational use of network copyright, which is the basis of the later discussion. The third part focuses on the analysis of the current situation of the rational use of network copyright in China, the analysis of the existing laws and regulations, the existing administrative regulations and rules, And how to regulate the rational use of network copyright and what problems exist in the international treaties that are in force in our country. Based on the preliminary analysis of the present situation and the existing problems, this paper makes a theoretical thinking and an analysis of the current situation of the rational use of network copyright in China. The theoretical thinking on the rational use of network copyright, including the value of equality, fairness and public interest in the spirit of philosophy of law, and the principle of balance of interests in the rational use of network copyright; The reflection on the rational use of network copyright in China is mainly to analyze the problems existing in the legislation and the factors that must be considered in practice. In the fourth part, on the basis of the previous analysis, the author puts forward some clear suggestions on how to improve the system of rational use of network copyright in China, and tries to set up legal regulation as soon as possible and strengthen the main role of legal intervention. At the same time, we actively expand the management system of the rational use of network copyright, which is suitable for our country by the practice space of relevant civil autonomy.
