【摘要】:在影視產(chǎn)業(yè)的鏈條中,編劇處在源頭。在一定意義上說(shuō),沒(méi)有編劇,就沒(méi)有好的劇本,也就不可能有好的影視劇。唯有保障好編劇的權(quán)益,才能激發(fā)編劇創(chuàng)作好劇本的動(dòng)力。中國(guó)編劇權(quán)利受侵的情況屢見(jiàn)不鮮,維權(quán)顯得迫在眉睫。首先,在影視產(chǎn)業(yè)鏈條中,編劇是其中的勞動(dòng)者,其勞動(dòng)應(yīng)受到勞動(dòng)法的保護(hù)。如果編劇的權(quán)利得不到有效的保護(hù),出現(xiàn)了類似美國(guó)那樣的編劇罷工,就會(huì)威脅到影視產(chǎn)業(yè)的市場(chǎng)秩序,造成影視產(chǎn)業(yè)不安定的局面。其次,在理念上,我們應(yīng)當(dāng)確立與制片方之間的勞資關(guān)系的屬性。在確立了這一理念后,編劇就是勞動(dòng)者。最后,編劇權(quán)利是著作權(quán)保護(hù)的重要內(nèi)容。著作權(quán)可以保護(hù)著作權(quán)人的權(quán)益,激發(fā)其創(chuàng)作積極性。著作權(quán)對(duì)促進(jìn)經(jīng)濟(jì)、科技的發(fā)展和文化、藝術(shù)的繁榮起了重要作用。然而,隨著時(shí)代的進(jìn)步,科學(xué)技術(shù)的更新,新型的作品形式不斷涌現(xiàn),如何實(shí)現(xiàn)“舊瓶裝新酒”,把新型的作品納入到著作權(quán)法保護(hù)的范圍之內(nèi),需要法律的智慧。中國(guó)編劇署名權(quán)、保護(hù)作品完整權(quán)和最基本的報(bào)酬權(quán)普遍受到侵害。這些問(wèn)題在美國(guó)并不普遍,可以說(shuō)是基本解決了。本文將借鑒美國(guó)的治理辦法,結(jié)合中國(guó)的實(shí)際,從行業(yè)和法律兩個(gè)角度提出中國(guó)編劇維權(quán)策略。另外,關(guān)于中國(guó)編劇和美國(guó)編劇想要隨著新媒體時(shí)代發(fā)展,獲得與自己勞動(dòng)完全匹配的報(bào)酬,由于立法的滯后性和不全面性,這個(gè)問(wèn)題只能是完善,不能完全解決。
[Abstract]:In the chain of film and television industry, the screenwriter is at the source. In a sense, there is no screenwriter, no good script, there can be no good film and television drama. Only by protecting the rights and interests of screenwriters, can we inspire the writers to write well. The violation of Chinese writers' rights is common and urgent. First of all, in the chain of film and television industry, screenwriter is the laborer, whose labor should be protected by labor law. If the rights of screenwriters can not be effectively protected, there will be a strike like that in the United States, which will threaten the market order of the film and television industry and cause instability in the film and television industry. Secondly, conceptually, we should establish the attributes of industrial relations with producers. After establishing this idea, the writer is the laborer. Finally, the writer's right is an important part of copyright protection. Copyright can protect the rights and interests of copyright owners and stimulate their creative enthusiasm. Copyright plays an important role in promoting the development of economy, science and technology and the prosperity of culture and art. However, with the progress of the times, the renewal of science and technology and the continuous emergence of new forms of works, how to realize the "new wine in old bottles" and bring the new works into the scope of copyright law protection needs the wisdom of law. The right to authorship, the right to integrity and the most basic right to remuneration are generally violated in China. These problems are not common in the United States, can be said to be basically solved. This article will draw lessons from the American governance method, unifies the Chinese reality, from the industry and the legal angle puts forward the Chinese screenwriter rights protection strategy. In addition, with the development of the new media era, the Chinese and American writers want to get the remuneration that matches their own labor perfectly. Because of the lag and imperfection of legislation, the problem can only be perfect and can not be solved completely.
