【摘要】：本文以我國(guó)圖書網(wǎng)絡(luò)版權(quán)保護(hù)為研究對(duì)象,通過對(duì)我國(guó)圖書網(wǎng)絡(luò)版權(quán)保護(hù)現(xiàn)狀及國(guó)外先進(jìn)國(guó)家版權(quán)保護(hù)經(jīng)驗(yàn)的研究,結(jié)合新公共管理理論,從司法保護(hù)和行政保護(hù)兩個(gè)角度提出我國(guó)圖書版權(quán)保護(hù)的對(duì)策。本文的主要內(nèi)容如下:第1章緒論部分,首先闡述了本研究的意義和背景,著重介紹了當(dāng)前該研究方向的主要進(jìn)展情況,并介紹本研究的研究思路和方法。第2章主要介紹了網(wǎng)絡(luò)版權(quán)保護(hù)研究中所涉及的相關(guān)概念以及理論基礎(chǔ)。第3章重點(diǎn)分析了當(dāng)前我國(guó)圖書網(wǎng)絡(luò)版權(quán)保護(hù)的現(xiàn)狀,包括我國(guó)圖書版權(quán)的侵權(quán)現(xiàn)狀和保護(hù)現(xiàn)狀兩個(gè)方面。并在此基礎(chǔ)上,總結(jié)了我國(guó)圖書網(wǎng)絡(luò)版權(quán)保護(hù)的不足之處。第4章研究了美國(guó)、歐盟的圖書版權(quán)保護(hù)體系,總結(jié)美國(guó)、歐盟在圖書版權(quán)保護(hù)方面的成熟經(jīng)驗(yàn),并歸納了對(duì)我國(guó)可資借鑒之處。第5章針對(duì)在前文中所闡述的不足和經(jīng)驗(yàn)借鑒,結(jié)合新公共管理理論,從司法保護(hù)、行政保護(hù)兩個(gè)角度提出我國(guó)圖書網(wǎng)絡(luò)版權(quán)保護(hù)的對(duì)策。結(jié)論部分概括總結(jié)了本文觀點(diǎn)。
[Abstract]:This paper takes the book network copyright protection of our country as the research object, through the research of the present situation of the book network copyright protection of our country and the foreign advanced country copyright protection experience, unifies the new public management theory, From the angle of judicial protection and administrative protection, this paper puts forward the countermeasures of book copyright protection in China. The main contents of this paper are as follows: in the first chapter, the significance and background of this research are introduced, the main progress of the research direction is introduced, and the research ideas and methods are introduced. Chapter 2 mainly introduces the related concepts and theoretical basis of the research on network copyright protection. The third chapter focuses on the analysis of the current situation of book network copyright protection in China, including the current situation of book copyright infringement and protection of two aspects. And on this basis, summarized our country book network copyright protection deficiency. Chapter 4 studies the book copyright protection system of the United States and the European Union, summarizes the mature experience of the United States and the European Union in the copyright protection of books, and sums up the points that can be used for reference in our country. In chapter 5, according to the deficiency and experience described in the previous article, combined with the theory of new public management, the author puts forward the countermeasures of copyright protection of book network in our country from two angles: judicial protection and administrative protection. The conclusion summarizes the views of this paper.
