【摘要】：隨著網(wǎng)絡(luò)信息化時(shí)代的不斷發(fā)展，，數(shù)字化網(wǎng)絡(luò)逐漸普及到社會(huì)中，并成為了當(dāng)今人們不可缺少的一種工具。數(shù)字圖書館即是在這時(shí)開始建設(shè)發(fā)展的。但是在數(shù)字圖書館的建設(shè)過程中，由于各國各地區(qū)都缺乏這方面的立法，導(dǎo)致舊模式下的一些法律法規(guī)對其產(chǎn)生了副作用，著作權(quán)限制制度是其中一個(gè)比較突出的例子。 本文主要以著作權(quán)限制制度為基礎(chǔ)理論，并著重分析討論合理使用和法定許可兩種制度在數(shù)字圖書館的建設(shè)及發(fā)展中的利與弊。文章觀點(diǎn)認(rèn)為，著作權(quán)限制制度在數(shù)字圖書館的發(fā)展中是尤為重要的部分，應(yīng)當(dāng)與時(shí)俱進(jìn)針對數(shù)字圖書館這一特殊形式進(jìn)行一定的改革，這是數(shù)字圖書館正常建設(shè)發(fā)展的有力保障。 文章的第一部分，主要說明數(shù)字圖書館分類及特點(diǎn)，并闡述了著作權(quán)限制制度在數(shù)字圖書館的建設(shè)和發(fā)展中的重要作用及地位；數(shù)字圖書館的價(jià)值和功能。如果要分析著作權(quán)限制制度對數(shù)字圖書館的適用問題，就必須要對數(shù)字圖書館的分類及特點(diǎn)進(jìn)行闡述和分析，明確其法律主體地位，才能確定其基本權(quán)利和義務(wù)。 文章第二部分，分為兩節(jié)。第一節(jié)研究分析了著作權(quán)限制制度在美國的適用經(jīng)驗(yàn)，合理使用制度在美國采用了原則性的立法和擴(kuò)大法官自由裁量權(quán)的方式，在法定許可制度上美國采用了原則性和列舉性的方式，有效的解決了法定許可在適用方面的問題。第二節(jié)，主要分析了國際條約中關(guān)于著作權(quán)限制制度的“三步檢驗(yàn)法”，筆者對歐盟的《指令》關(guān)于著作權(quán)限制制度的適用規(guī)定進(jìn)行了研究分析和經(jīng)驗(yàn)總結(jié)。 文章第三部分，主要圍繞適用方面，具體分析研究我國現(xiàn)行法律對于圖書館的合理使用及法定許可的相關(guān)規(guī)定，對于數(shù)字圖書館而言，這些規(guī)定存在哪些不足，這些不足會(huì)對數(shù)字圖書館的建設(shè)和運(yùn)營產(chǎn)生哪些不利影響，并得出結(jié)論。 文章第四部分，針對前述的分析與研究，筆者對著作權(quán)限制制度如何更好的適用于數(shù)字圖書館的建設(shè)及發(fā)展提出了一些建議，修改現(xiàn)行《著作權(quán)法》和《信息網(wǎng)絡(luò)傳播權(quán)保護(hù)條例》的建議，以此來達(dá)到著作權(quán)限制制度在數(shù)字圖書館發(fā)展中發(fā)揮有利作用的目的。
[Abstract]:With the continuous development of network information age, digital network is gradually popularized into the society, and has become an indispensable tool for people today. It is at this time that the digital library begins to build and develop. However, in the process of digital library construction, due to the lack of legislation in various countries and regions, some laws and regulations under the old model have side effects on it, and the copyright restriction system is one of the outstanding examples. Based on the theory of copyright restriction system, this paper mainly discusses the advantages and disadvantages of the two systems of rational use and legal license in the construction and development of digital library. The author holds that the copyright restriction system is a particularly important part in the development of digital library and should be reformed with the times in view of the special form of digital library. This is the digital library normal construction and development of a strong guarantee. The first part of the article mainly explains the classification and characteristics of digital library, and expounds the important role and position of copyright restriction system in the construction and development of digital library, the value and function of digital library. If we want to analyze the application of copyright restriction system to digital library, we must expound and analyze the classification and characteristics of digital library, clarify its legal subject status, and determine its basic rights and obligations. The second part of the article is divided into two sections. The first section analyzes the experience of the copyright restriction system in the United States, the rational use of the system in the United States to adopt the principle of legislation and expand the discretion of judges in the way, In the legal licensing system, the United States adopted the principle and enumeration methods, effectively solved the legal license in the application of the problem. In the second section, the author mainly analyzes the "three-step test method" of copyright restriction system in international treaties. The author makes a research and analysis on the applicable provisions of the copyright restriction system in the European Union (EU). The third part of the article, mainly around the application aspect, the concrete analysis studies our country present law to the library reasonable use and the legal permission related stipulation, for the digital library, these provisions have what deficiency, These deficiencies will have adverse effects on the construction and operation of digital library, and come to a conclusion. In the fourth part of the article, in view of the above analysis and research, the author puts forward some suggestions on how to better apply the copyright restriction system to the construction and development of digital library. This paper proposes to amend the present copyright Law and the regulations on the Protection of Information Network Transmission right, so as to achieve the purpose of the copyright restriction system playing a favorable role in the development of digital library.
