【摘要】：計算機和互聯網技術的發(fā)展，使得文字作品能夠上傳到網絡中加以儲存并傳播，也使得創(chuàng)作可以拋棄傳統的稿紙寫作模式而在電腦上直接寫作并儲存發(fā)表。網絡這個虛擬空間為創(chuàng)作者提供了一個自由的創(chuàng)作環(huán)境，網絡的交互性極大刺激了公眾的創(chuàng)作欲望，這使得創(chuàng)作的主體開始回歸公眾，并直接導致網絡原創(chuàng)文字作品迅猛發(fā)展，大量網絡用戶在極短的時間內創(chuàng)作出數以億計的網絡原創(chuàng)文字作品。網絡的便捷使作品和信息的傳播更加自由，，同時卻也使得侵犯網絡原創(chuàng)文字作品著作權的行為變得更加復雜與難以察覺。侵犯網絡原創(chuàng)文字作品著作權的案件近年來屢見不鮮，如李旭光訴紅袖添香案、云霄閣涉嫌侵犯網絡著作權犯罪案等，這些案件折射出網絡原創(chuàng)文字作品著作權歸屬確定難、舉證難等一系列等問題。與此同時，通過對網絡原創(chuàng)小說作者群的調查，發(fā)現相當數量的作者由于維權意識不到位、身份邊緣化以及維權成本高昂等原因，對侵犯自己作品權利的行為聽之任之，不采取任何有效行動。網絡原創(chuàng)文字作品發(fā)展時間短，勢頭猛，我國法律對其著作權的保護尚不夠完善，許多條文仍處于理論狀態(tài)，很難真正實現。面對這些問題，我們應該加強著作權知識宣傳，提高作者維權意識和公眾網絡道德；通過推行網絡實名制，建立網絡原創(chuàng)文字作品著作權集體管理制度加強管理；完善法律法規(guī)提供最終保障；并運用技術的、媒體的等各種手段多管齊下，以便為網絡原創(chuàng)文字作品著作權提供更為有效的保護。
[Abstract]:The development of computer and Internet technology makes the writing work can be uploaded to the network to store and spread. It also makes the creation can discard the traditional paper writing mode and write and store it directly on the computer. The virtual space provides a free creative environment for the creator, and the interactivity of the network is a great thorns. The public's creative desire has been stimulated, which makes the subject of creation return to the public, and directly leads to the rapid development of the original text works of the network. A large number of Internet users create hundreds of millions of original works of the network in a very short time. The convenience of the network makes the communication of the works and information more free, but it also makes the infringement of the network original. In recent years, the cases of infringement of the copyright of the original works of the network are often seen, such as the case of Li Xuguang suing the red sleeves and the crime of infringing the crime of network copyright. These cases reflect the difficulty in determining the ownership of the copyright of the original writings of the network, and the difficulty of proof. At the same time, through the investigation of the authors of the original network novels, the author finds that a considerable number of authors can not take any effective action on the rights of their own works and do not take any effective action because of the poor awareness of the rights of their rights, the marginalization of their identity and the high cost of safeguarding their rights. In the face of these problems, we should strengthen the propaganda of the copyright knowledge, improve the consciousness of the rights of the authors and the public network morality, and establish the collective management of the copyright of the original works of the network through the implementation of the network real name system. In order to provide more effective protection for the copyright of the original text works of the network, the management of the system should be strengthened, the laws and regulations are perfected and the final guarantee is provided.
