孤兒作品利用的法律問題研究

【摘要】:孤兒作品是指在著作權(quán)保護(hù)期限內(nèi),作品權(quán)利人不明或者雖然權(quán)利人明確,但無法取得聯(lián)系以洽商著作權(quán)授權(quán)利用事宜的作品。在無法獲得合法授權(quán)的情況下,潛在使用者在面對此類作品時,只能選擇放棄使用或者冒險侵權(quán)使用,而這都不利于孤兒作品的保護(hù)與傳播。 隨著數(shù)字化技術(shù)的發(fā)展和商業(yè)模式的更新,美國、歐盟等國對孤兒作品的利用困境更是表示出極大的關(guān)注,并開始尋求立法和實踐上的解決方案。相反,國內(nèi)學(xué)者和相關(guān)產(chǎn)業(yè)界對孤兒作品問題還未給予足夠的重視,立法上的規(guī)范仍是空白。盡管“孤兒作品”一詞源于美國對此問題的討論,我國并無這一術(shù)語,但孤兒作品在我國客觀存在卻是不爭的事實。因此,對孤兒作品利用的法律問題進(jìn)行研究具有重要的現(xiàn)實意義。 文分為四個部分: 第一章孤兒作品問題的概述。本章在對孤兒作品進(jìn)行定義之后,確定了受利用的孤兒作品范圍。本文認(rèn)為,受利用的孤兒作品范圍包括權(quán)利人明確但下落不明的作品,但僅限于已發(fā)表的作品。在對孤兒作品產(chǎn)生的原因進(jìn)行深入分析后,指出版權(quán)信息不足及網(wǎng)絡(luò)數(shù)字化的發(fā)展是孤兒作品產(chǎn)生的外在原因,而各國法律對著作權(quán)自動保護(hù)原則的接受則是孤兒作品產(chǎn)生的根本原因。此后,本章從直觀的數(shù)據(jù)出發(fā),,討論了解決孤兒作品利用困境,推動孤兒作品公共獲取的必要性。 第二章分析我國著作權(quán)法視野下的孤兒作品現(xiàn)狀,以厘清現(xiàn)行立法對孤兒作品利用規(guī)范的不足。基于孤兒作品在我國客觀存在的事實,本章先明確了問題探討的必要性。在對與孤兒作品相關(guān)的立法現(xiàn)狀進(jìn)行檢討后,提出“作者身份不明的作品”范圍遠(yuǎn)小于孤兒作品,且現(xiàn)行規(guī)范所確立的行權(quán)規(guī)則存在著一定的缺陷,而“無權(quán)利義務(wù)承受人的作品”并不屬于孤兒作品的范疇。本章還考察了此前實行過的著作權(quán)“報酬轉(zhuǎn)遞”機(jī)制,認(rèn)為該機(jī)制也并不能解決孤兒作品的利用難題。 第三章對國外及國內(nèi)其他法域孤兒作品利用方案進(jìn)行比較研究,明確各個利用方案的異同點,以期對我國孤兒作品利用模式的選擇提供借鑒。各個方案均強調(diào)經(jīng)過“合理勤勉”搜尋確定作品的“孤兒”狀態(tài)是利用的前提,而對權(quán)利人進(jìn)行合理補償則是利用的經(jīng)濟(jì)條件。但是,各方案在具體的制度設(shè)計、立法模式上又存在差異。 第四章我國孤兒作品利用模式的選擇。在對孤兒作品的合法利用方式、利用原則以及其他考量因素進(jìn)行分析后,本章結(jié)合前述國家和地區(qū)孤兒作品利用方案以及我國著作權(quán)管理的實際,提出我國孤兒作品利用的具體方案。本章建議除了現(xiàn)行合理使用和法定許可之外,還需引入孤兒作品的法定授權(quán)制度。
[Abstract]:An orphan work refers to a work in which the owner of a work is not known within the term of copyright protection or is unable to obtain contact to negotiate the issue of copyright authorization although the owner of the work is clear. In the absence of legal authorization, potential users can only choose to give up use or risk infringing when faced with such works, which is not conducive to the protection and dissemination of orphan works. With the development of digital technology and the renewal of business model, the United States, the European Union and other countries have shown great concern about the plight of the use of orphan works, and began to seek legislative and practical solutions. On the contrary, domestic scholars and related industries have not paid enough attention to the problem of orphans' works, and the legislative norms are still blank. Although the term "Orphan works" originates from the discussion of this issue in the United States and there is no such term in China, it is an indisputable fact that orphan works exist objectively in our country. Therefore, it is of great practical significance to study the legal problems in the utilization of orphans' works. The paper is divided into four parts: The first chapter is an overview of the problem of orphans' works. After defining the orphan works, this chapter determines the scope of the orphan works. This paper holds that the scope of the orphan works in use includes those whose rights are clear but whose whereabouts are unknown, but is limited to published works. After an in-depth analysis of the causes of orphans' works, it is pointed out that the lack of copyright information and the development of digital network are the external reasons for the generation of orphans' works. The acceptance of the principle of automatic copyright protection is the root cause of orphan works. From then on, this chapter discusses the necessity of solving the dilemma of using orphans' works and promoting the public acquisition of orphans' works from intuitionistic data. The second chapter analyzes the current situation of orphans' works in the field of copyright law in order to clarify the deficiency of the current legislation on the utilization of orphans' works. Based on the fact that orphan works exist objectively in China, this chapter first clarifies the necessity of discussion. After reviewing the current legislative situation related to orphan works, it is pointed out that the scope of "works of unknown author" is much smaller than that of orphan works, and there are some defects in the exercise rules established by the current norms. However, the works of people without rights and obligations do not belong to the category of orphans' works. This chapter also examines the prior copyright "reward transfer" mechanism, which can not solve the problem of orphans' work. The third chapter makes a comparative study on the utilization schemes of orphans' works in foreign countries and other jurisdictions in China, and makes clear the similarities and differences of the utilization schemes, in order to provide a reference for the choice of the utilization modes of the orphans' works in our country. Each scheme emphasizes that the condition of "orphan" is the precondition of utilization through "reasonable diligence" search, and the reasonable compensation to the right holder is the economic condition of utilization. However, there are differences in the specific system design and legislative model. The fourth chapter is about the choice of the utilization mode of orphans' works in China. After analyzing the ways, principles and other considerations of the lawful use of orphans' works, this chapter combines the utilization schemes of orphans' works in the aforementioned countries and regions and the actual situation of copyright management in our country. This paper puts forward the concrete scheme of the utilization of orphans' works in our country. In addition to the existing reasonable use and legal permission, this chapter suggests the introduction of statutory authorization system for orphan works.
