【摘要】：隨著數(shù)字信息技術(shù)的發(fā)展,出版業(yè)由傳統(tǒng)出版向數(shù)字出版轉(zhuǎn)型,文明逐漸開始通過數(shù)字形式進行保存,因此傳統(tǒng)的出版物呈繳體制已經(jīng)跟不上數(shù)字時代的發(fā)展,數(shù)字呈繳制度的建立變得十分重要。傳統(tǒng)出版物的呈繳狀況原本就不樂觀,數(shù)字出版物的呈繳狀況更是不盡人意,出版物數(shù)字呈繳制度的建立初衷是為了彌補原有呈繳制度的弊端,不僅需要從法律法規(guī)上進行完善,建立以法律為支撐的制度保障,細化法律對于數(shù)字呈繳制度的內(nèi)容建設(shè),制定相關(guān)法律保證數(shù)字呈繳制度順利實施,還需要平衡受繳主體和呈繳主體等各方利益,建立補償機制,集中對于出版物數(shù)字呈繳管理的權(quán)利,避免各自為政的現(xiàn)象,更是需要在呈繳方式上進行大突破,將原本阻礙呈繳制度發(fā)展實施的直接送繳式呈繳方式轉(zhuǎn)變?yōu)橥ㄟ^出版物數(shù)字呈繳網(wǎng)絡平臺進行呈繳,可以實現(xiàn)快捷、方便、全面的出版物呈繳,同時為出版物的后續(xù)獲取利用提供了更好的基礎(chǔ)。全文共分為五個章節(jié),第一章為緒論,主要介紹研究緣起以及原有呈繳制度國內(nèi)外研究現(xiàn)狀。第二章對出版物數(shù)字呈繳的概念界定,論文通過對出版物呈繳主體、客體及出版物呈繳制度建設(shè)歷程進行論述,從而明確出版物數(shù)字呈繳的內(nèi)涵;并對傳統(tǒng)出版物和數(shù)字出版物的數(shù)字呈繳進行了概述。第三章主要對我國建立數(shù)字呈繳制度的宏觀環(huán)境進行分析,我國缺乏完善的呈繳法律制度以及對呈繳后出版物版權(quán)保護的相關(guān)法律,國家財政對于呈繳機制保存管理成本以及受繳補償成本的經(jīng)濟支撐匱乏,呈繳管理機構(gòu)管理制度不完善,出版物數(shù)字呈繳受繳、保存以及服務利用等環(huán)節(jié)的相關(guān)技術(shù)保障存在困難。第四章為我國建立出版物數(shù)字呈繳制度的策略,政治方面主要是建立以法律為支撐的制度保障,細化法律對于數(shù)字呈繳制度的內(nèi)容建設(shè)以及制定相關(guān)法律保證出版物數(shù)字呈繳制度順利實施;經(jīng)濟方面一是節(jié)約管理成本,二是實行補償機制;社會方面的策略首先是國家層面上精簡數(shù)字呈繳管理者,其次是地方層面遵循國家統(tǒng)一規(guī)定,最后是針對數(shù)字呈繳的特點進行專門的呈繳管理規(guī)定或建立相關(guān)管理項目。技術(shù)方面主要對出版物數(shù)字呈繳平臺的建立提出建議。第五章對前文進行總結(jié),并提出對未來公共借閱權(quán)和網(wǎng)絡信息傳播權(quán)研究的展望。
[Abstract]:With the development of digital information technology, the publishing industry has transformed from traditional publishing to digital publishing, and the civilization has gradually begun to be preserved in digital form. Therefore, the traditional publication payment system has been unable to keep up with the development of the digital age. The establishment of the system of digital presentation has become very important. The status of the collection of traditional publications is not optimistic, The present situation of the digital publication is not satisfactory. The original intention of the publication system is to make up the defects of the original system. It not only needs to be perfected from laws and regulations, establish the system support with law as the support, and refine the construction of the law for the content of the system of the digital presentation, and make the relevant legal guarantee figures. The payment system is implemented smoothly. It also needs to balance the interests of the subject and the subject, establish the compensation mechanism, focus on the right to pay management of the publication figures, avoid the phenomenon of self governance, and also need to make a breakthrough in the way of presentation, and transfer the direct payment and payment method which originally hinders the development of the system. It can be turned into a network platform by the number of publications, which can be realized quickly, conveniently and fully, and provide a better basis for the subsequent use of publications. The full text is divided into five chapters. The first chapter is the introduction, which mainly introduces the research status and the status quo of the research at home and abroad of the original system. The second chapter The definition of the collection of digital publications is defined. Through the exposition of the subject of the publication, the object and the system of the publication of the publication, the paper makes clear the connotation of the number of publications and gives a summary of the figures of the traditional publications and the digital publications. The third chapter mainly sets up the macro of the system of digital presentation in China. In view of the analysis of the environment, our country lacks the perfect legal system and the relevant laws on the copyright protection of the published publications. The state finance is deficient in saving the cost of management and the cost of compensation for the payment mechanism, the management system of the administration institution is not perfect, the number of publications is paid and paid, the preservation and service are beneficial. The fourth chapter provides a strategy for the establishment of the system of the digital presentation of publications in China. The political aspect is mainly to establish the system support with the support of the law, to refine the construction of the law for the content of the digital payment system and to establish the relevant laws to ensure the smooth implementation of the system of the digital presentation of publications; The first is to save the cost of management, two is to implement the compensation mechanism; the social strategy is first to streamline the number of the administrators at the national level, followed by the local level to follow the national unified regulations, and finally to carry out special administration regulations or establish related management projects for the characteristics of the digital surrender. The fifth chapter gives a summary of the foregoing, and puts forward the prospect of the research on Public Lending Right and the right of information dissemination in the future.
