藝術(shù)“挪用”引起的法律問(wèn)題研究

【摘要】: 藝術(shù)法的形成、發(fā)展離不開(kāi)二十世紀(jì)七十年代歐美各國(guó)的藝術(shù)品投資熱潮,法律工作者和藝術(shù)家在實(shí)踐基礎(chǔ)上不斷進(jìn)行總結(jié)。但在以往發(fā)表的研究成果中,他們依照已有的法律條款、司法解釋來(lái)處理藝術(shù)市場(chǎng)中出現(xiàn)的問(wèn)題。由于藝術(shù)法的跨學(xué)科性,以法律工作者為主導(dǎo)的藝術(shù)法研究往往忽視了藝術(shù)創(chuàng)作自身的規(guī)律、特點(diǎn)。 隨著藝術(shù)史發(fā)展,“挪用”作為藝術(shù)家表達(dá)思想的一種重要?jiǎng)?chuàng)作手法被頻繁運(yùn)用。但在法律領(lǐng)域內(nèi),這一行為卻不容易被理解:“挪用”這一詞在法律里的使用語(yǔ)境,涉及的是《刑法》“挪用公款”等條款;即便涉及到保護(hù)智力勞動(dòng)成果的《著作權(quán)法》,由于“挪用”產(chǎn)生的藝術(shù)作品不符合法律里關(guān)于作品需要具備的“獨(dú)創(chuàng)性”要件,這使得在以往的司法判例中,基于“挪用”進(jìn)行創(chuàng)作的藝術(shù)家處于非常不利的位置。從中,我們也可以看到,僅依照原有的研究角度是難以處理好此問(wèn)題。 本文將從藝術(shù)創(chuàng)作自身的規(guī)律出發(fā),對(duì)“挪用”引起的法律問(wèn)題進(jìn)行研究。通過(guò)對(duì)有關(guān)案例的藝術(shù)社會(huì)學(xué)和法學(xué)的分析,厘清“挪用”在藝術(shù)與法律中的不同涵義,并對(duì)藝術(shù)中的“挪用”行為面臨的法律困境,做出分析、提出解決策略。
[Abstract]:The formation of art law can not be separated from the upsurge of art investment in Europe and the United States in the 1970s, and legal workers and artists continue to sum up on the basis of practice. But in the past published research results, they deal with the problems in the art market according to the existing legal provisions. Due to the interdisciplinary nature of art law, the law of art, led by legal workers, often ignores the laws and characteristics of art creation itself. With the development of art history, misappropriation is frequently used as an important creative technique for artists to express their ideas. However, in the field of law, this act is not easy to understand: "misappropriation" in the context of the use of the law, involving the "misappropriation of public funds" and other provisions; Even when it comes to the copyright Law, which protects the fruits of intellectual labor, because the works of art produced by "misappropriation" do not meet the requirements of "originality" in the law concerning the work, this makes it possible in previous judicial precedents. Artists who create based on "misappropriation" are in a very disadvantageous position. From this, we can also see that it is difficult to deal with this problem according to the original research angle. Based on the law of artistic creation, this paper studies the legal problems caused by misappropriation. Through the analysis of the art sociology and the jurisprudence of the relevant cases, this paper clarifies the different meanings of "misappropriation" in art and law, and analyzes the legal dilemma of the "misappropriation" in art, and puts forward some countermeasures.
