視頻公開(kāi)課著作權(quán)問(wèn)題探析

【摘要】:著名大學(xué)的優(yōu)質(zhì)教育資源的網(wǎng)絡(luò)共享運(yùn)動(dòng)推進(jìn)了世界教育的發(fā)展,使網(wǎng)絡(luò)成為大眾接受優(yōu)質(zhì)教育變成為了可能。視頻公開(kāi)課無(wú)疑對(duì)加速知識(shí)的傳播、推動(dòng)優(yōu)質(zhì)教育資源的大眾化、以及對(duì)改變傳統(tǒng)的受教育模式做出了突出的貢獻(xiàn)。然而,視頻公開(kāi)課的出現(xiàn)卻給傳統(tǒng)的著作權(quán)制度帶來(lái)極大的沖擊。如:建設(shè)視頻公開(kāi)課程過(guò)程中大多需要使用他人的作品,這些作品在法律上受到著作權(quán)法的保護(hù),如何實(shí)現(xiàn)大眾利益與原著作權(quán)人利益的平衡以及視頻公開(kāi)課程自身的著作權(quán)歸屬問(wèn)題;另外,視頻公開(kāi)課程是利用網(wǎng)絡(luò)實(shí)現(xiàn)優(yōu)質(zhì)教育資源的共享,在共享過(guò)程中不可避免的會(huì)涉及到網(wǎng)絡(luò)侵權(quán)問(wèn)題。這些問(wèn)題的研究無(wú)疑對(duì)視頻公開(kāi)課程這一新事物的制度研究以及著作權(quán)人利益的保護(hù)有著深遠(yuǎn)的意義。因此,本文試圖依據(jù)視頻公開(kāi)課程的新發(fā)展、著作權(quán)的基本原理和原則對(duì)視頻公開(kāi)課程的著作權(quán)問(wèn)題做一個(gè)梳理,以期對(duì)此課題有一個(gè)清晰的認(rèn)識(shí),借此提出建立視頻公開(kāi)課程的著作權(quán)保護(hù)機(jī)制。 本文分為三個(gè)部分: 在本文的第一部分,作者闡明了視頻公開(kāi)課程的涵義、起源及對(duì)其發(fā)展做出介紹。意在梳理這一新事物的出現(xiàn)及其現(xiàn)在的發(fā)展?fàn)顩r,并對(duì)麻省理工學(xué)院的開(kāi)放計(jì)劃和《知識(shí)共享協(xié)議》中關(guān)于知識(shí)產(chǎn)權(quán)方面作簡(jiǎn)要介紹,以及我國(guó)目前關(guān)于視頻公開(kāi)課建設(shè)中關(guān)于著作權(quán)問(wèn)題的實(shí)施方案。 在本文的第二部分,作者對(duì)視頻公開(kāi)課程的著作權(quán)現(xiàn)狀問(wèn)題進(jìn)行法律分析。旨在說(shuō)明視頻公開(kāi)課程的出現(xiàn)對(duì)現(xiàn)有著作權(quán)法律制度所形成的創(chuàng)設(shè)的沖擊,主要說(shuō)明其在四方面所造成的影響1.建設(shè)視頻公開(kāi)課程中使用他人作品的問(wèn)題;2.視頻公開(kāi)課程著作權(quán)的歸屬問(wèn)題;3.視頻公開(kāi)課程的使用對(duì)網(wǎng)絡(luò)信息傳播權(quán)的挑戰(zhàn)問(wèn)題;4.視頻公開(kāi)課程的運(yùn)營(yíng)管理問(wèn)題。 本文第三部分,作者試圖運(yùn)用我國(guó)現(xiàn)有的著作權(quán)法律制度以及相關(guān)的民事規(guī)則來(lái)解決視頻公開(kāi)課程的著作權(quán)問(wèn)題。視頻公開(kāi)課程的發(fā)展建設(shè)關(guān)系一個(gè)國(guó)家教育、科研的發(fā)展水平,其能緩解教育資源分配不均衡的局面,營(yíng)造一個(gè)開(kāi)放自由的教育環(huán)境。我國(guó)作為發(fā)展中國(guó)家,雖然我國(guó)著作權(quán)法幾經(jīng)修改,但仍然難以適應(yīng)信息網(wǎng)絡(luò)化的時(shí)代發(fā)展需要。在此情形下,如何正確理解現(xiàn)有的著作權(quán)法律法規(guī)并用來(lái)解決視頻公開(kāi)課帶給我們的實(shí)際問(wèn)題,使其既符合視頻公開(kāi)課程的發(fā)展需要又能保護(hù)著作權(quán)人的利益,促進(jìn)這一事物的健康有序發(fā)展,是我們必須考慮的問(wèn)題。在這一思想指導(dǎo)下,筆者大膽的對(duì)我國(guó)現(xiàn)有的著作權(quán)法律制度、政策及相關(guān)民法制度進(jìn)行整合歸納,作以下幾方面的歸納。主要從以下四個(gè)方面:1.視頻公開(kāi)課建設(shè)中使用原作品的解決方式;2.視頻公開(kāi)課程的著作權(quán)歸屬;3.視頻公開(kāi)課的網(wǎng)絡(luò)信息傳播權(quán)的相關(guān)規(guī)定;4.合理運(yùn)用現(xiàn)有的著作權(quán)集體管理組織。
[Abstract]:The network sharing movement of high quality educational resources in famous universities has promoted the development of world education and made it possible for the public to accept high quality education. The video open course has undoubtedly made outstanding contributions to accelerating the spread of knowledge, promoting the popularization of high-quality educational resources and changing the traditional mode of education. However, the emergence of video open courses has brought great impact to the traditional copyright system. For example, most of the work of others is required in the course of building a public video course, and these works are legally protected by copyright law. How to achieve the balance between the interests of the public and the original copyright owner and the ownership of the copyright of the video open course itself; in addition, the video open course is to use the network to achieve the sharing of high-quality educational resources. In the process of sharing, the problem of network infringement will inevitably be involved. There is no doubt that the research of these problems has far-reaching significance to the system research of the new thing of video open curriculum and the protection of the interests of copyright owners. Therefore, according to the new development of the video open course and the basic principle and principle of copyright, this paper tries to sort out the copyright problem of the video open course, in order to have a clear understanding of this subject. In order to establish a video open course copyright protection mechanism. This paper is divided into three parts: In the first part of this paper, the author explains the meaning, origin and development of the video open course. The purpose of this paper is to sort out the emergence of this new thing and its present development, and to briefly introduce the aspects of intellectual property in MIT's Open Plan and the Knowledge-Sharing Agreement. And the implementation plan of copyright in the construction of video open course in our country. In the second part of this paper, the author makes a legal analysis on the copyright of the video open course. The purpose of this paper is to explain the impact of the emergence of the video open course on the creation of the existing copyright legal system, and mainly to explain its impact in four aspects. Build a video open course using the work of others. The ownership of the copyright of the Video Open course. The use of video open courses challenges the right to network information dissemination. The operation management of the video open course. In the third part of this paper, the author tries to solve the copyright problem of the video open course by using the existing copyright law system and relevant civil rules in our country. The development and construction of video open curriculum is related to the development level of education and scientific research in a country, which can alleviate the unbalanced distribution of educational resources and create an open and free educational environment. As a developing country, China's copyright law has been revised several times, but it is still difficult to meet the needs of the development of information network era. In this case, how to correctly understand the existing copyright laws and regulations and use them to solve the actual problems brought to us by video open courses, so that they can not only meet the needs of the development of video open courses, but also protect the interests of copyright owners. To promote the healthy and orderly development of this matter is an issue we must consider. Under the guidance of this thought, the author boldly sums up the existing copyright legal system, policy and relevant civil law system in our country, and makes the following induction. Mainly from the following four aspects: 1. The solution of the original works is used in the construction of the video open class. The copyright ownership of the video open course. The relevant regulation of network information dissemination right of video open class is 4. Rational use of existing copyright collective management organizations.
