【摘要】:2010年2月26日,第十一屆人大常委會通過了《關(guān)于修改著作權(quán)法的決定》,將2001年版《著作權(quán)法》第4條第1款的規(guī)定刪除,同時(shí)在第2款增加“國家對作品的出版、傳播依法進(jìn)行監(jiān)督管理”的規(guī)定。短短兩句話的變動,其中的法理邏輯卻耐人尋味,再度將未經(jīng)批準(zhǔn)的境外作品的著作權(quán)保護(hù)問題擺在了立法和實(shí)務(wù)面前。 本文以WTO中美知識產(chǎn)權(quán)第一案中,圍繞我國《著作權(quán)法》第4條第1款所引起的爭端為切入點(diǎn),運(yùn)用經(jīng)濟(jì)學(xué)分析法、比較分析法、規(guī)范與實(shí)證分析法等,展開對未經(jīng)批準(zhǔn)的境外作品的著作權(quán)保護(hù)問題的論述,論證了對未經(jīng)批準(zhǔn)的境外作品賦予著作權(quán)保護(hù)的合理性,以及限制其著作權(quán)行使的正當(dāng)性;通過借鑒其他國家的做法,審視我國現(xiàn)行審查制度的不足和完善之道,在正確解讀現(xiàn)行《著作權(quán)法》第4條的前提下,提出在文化產(chǎn)品市場新的發(fā)展形勢下,對該類作品著作權(quán)保護(hù)的建議。 論文由引言、正文、結(jié)語三部分構(gòu)成,其中正文分為四部分。 引言主要介紹我國《著作權(quán)法》第4條的修改背景,以WTO美國訴我國WT/DS362案第三項(xiàng)訴求的簡述,引出正文對未經(jīng)批準(zhǔn)的境外作品著作權(quán)的保護(hù)問題的探討。現(xiàn)行《著作權(quán)法》第4條意味著未經(jīng)批準(zhǔn)的境外作品其著作權(quán)最終得到立法承認(rèn),但如何明確此類作品著作權(quán)的具體保護(hù),使文化的發(fā)展傳播與公共利益相平衡,是本文努力探討的問題。 正文第一部分簡單明確未經(jīng)批準(zhǔn)的境外作品的概念及分類。第二部分首先通過對“版權(quán)自動保護(hù)原則”的分析和“三步檢驗(yàn)法”的運(yùn)用,從正反兩方面論證了賦予未經(jīng)批準(zhǔn)的境外作品著作權(quán)保護(hù)的合理性;其次,通過比較法分析、“成本——收益”的經(jīng)濟(jì)學(xué)角度的分析,以及對公共道德的法律權(quán)衡的剖析,進(jìn)一步肯定了這種合理性。此類作品的特殊性在于,它更多地涉及公共道德的權(quán)衡和文化發(fā)展的平衡,這也是對該類作品是否應(yīng)當(dāng)賦予著作權(quán)保護(hù)的最大爭議所在。法律在公共道德的選擇上應(yīng)該具有前瞻性,應(yīng)當(dāng)與文化發(fā)展的公共利益相平衡,而不是僵硬地?fù)?jù)此否定一部作品的著作權(quán);在文化產(chǎn)品市場空前繁榮、多元價(jià)值和道德信念并行的今天,承認(rèn)此類作品的著作權(quán)是合理合法的明智之舉。 第三部分在第二部分的基礎(chǔ)上,結(jié)合審查制度,提出限制此類作品著作權(quán)行使的正 當(dāng)性。無論是境外作品還是本國作品,其出版、傳播都要受到公共道德和公共利益的約束,需要公法對濫用言論出版自由權(quán)的行為予以懲戒。行政審查是各國普遍采用的做法,亦是一國主權(quán)性質(zhì)的權(quán)力,行政審查對未經(jīng)批準(zhǔn)的境外作品著作權(quán)的合理保護(hù)具有重要作用,兩者具有可兼容的特點(diǎn)。 通過第二、三部分的論述,提出解決此類作品著作權(quán)問題的第三條路徑,即承認(rèn)其著作權(quán),但對其著作權(quán)行使進(jìn)行合理限制。 第四部分在現(xiàn)行法律框架下,探討對未經(jīng)批準(zhǔn)的境外作品著作權(quán)保護(hù)制度的完善。通過對我國審查制度的反思,提出行政審查制度應(yīng)當(dāng)明確權(quán)力行使主體,并將審查標(biāo)準(zhǔn)科學(xué)量化;針對實(shí)踐中存在的侵權(quán)行為,對尚未提交內(nèi)容審查的作品和等待內(nèi)容審查結(jié)果的作品,在立法中建議增設(shè)臨時(shí)性保護(hù)措施;針對不同類型的未經(jīng)批準(zhǔn)的境外作品,在侵權(quán)行為的認(rèn)定、訴訟時(shí)效及損害賠償金的適用上做出進(jìn)一步闡釋。 本文的結(jié)論是:對未經(jīng)批準(zhǔn)的境外作品應(yīng)當(dāng)承認(rèn)其著作權(quán),但在著作權(quán)的行使上應(yīng)給予合理的公法限制。解決此類作品困境的關(guān)鍵,是提高政府監(jiān)管制度的水平,對作品內(nèi)容審查標(biāo)準(zhǔn)做進(jìn)一步明確,防止任意的“選擇性執(zhí)法”;在現(xiàn)有立法保護(hù)規(guī)定的基礎(chǔ)上,增設(shè)臨時(shí)性保護(hù)措施,同時(shí),當(dāng)此類作品受到侵權(quán)后,權(quán)利人的救濟(jì)手段、主張侵權(quán)行為人賠償經(jīng)濟(jì)損失的計(jì)算方式還需立法做進(jìn)一步闡釋。惟其如此,才能保證著作權(quán)法的邏輯一致性和運(yùn)轉(zhuǎn)規(guī)范性。
[Abstract]:On Feb . 26 , 2010 , the 11th NPC Standing Committee adopted the Decision Concerning the revision of the Copyright Law , and deleted the provisions of Article 4 , paragraph 1 , of the Copyright Law in 2001 . At the same time , it added the provisions of Article 4 , paragraph 1 , of the Copyright Law of 2001 . In the meantime , the changes of the two sentences , the legal logic of the works , and the copyright protection of the non - approved overseas works are put in front of the legislation and practice .
In the first case of China ' s intellectual property right in the WTO , the author points out that the dispute arising from article 4 , paragraph 1 , of China ' s copyright law is the point of entry , and the author demonstrates the rationality of copyright protection to unauthorized overseas works and discusses the legitimacy of copyright protection in China .
The thesis consists of three parts : preface , text and conclusion , in which the text is divided into four parts .
The introduction mainly introduces the background of the amendment of Article 4 of the copyright law in China , and discusses the protection of the copyright of non - approved overseas works by the WTO US v . China ' s WT / DS362 case . The article 4 of the current Law Copyright Law means that the copyright of the non - approved overseas works is finally recognized by legislation , but how to clarify the specific protection of the copyright of such works makes the development of culture well balanced with the public interest , which is a problem to be discussed in this paper .
The first part of the text simply makes clear the concept and classification of unauthorized overseas works . The second part firstly demonstrates the rationality of the copyright protection granted to the unauthorized overseas works by the analysis of the principle of automatic protection of copyright and the application of the " three - step inspection method " . The particularity of such works is that it is more concerned with the trade - off of public morality and the balance of cultural development .
The third part , on the basis of the second part , puts forward the right to limit the exercise of copyright of such works in combination with the examination system .
Administrative examination is widely used in all countries , and it is also a power of the sovereign nature of a country . Administrative examination is an important role in the rational protection of copyright of overseas works which have not been approved . Both have compatible features .
Through the discussion of the second and third parts , the article puts forward the third way to solve the copyright problem of such works , that is , to recognize the copyright of the works , but to limit the exercise of the copyright .
In the fourth part , under the current legal framework , the author probes into the perfection of the copyright protection system of overseas works which has not been approved . Through the reflection of our country ' s examination system , it is proposed that the administrative examination system should be clear and the main body should be exercised and the standard scientific quantification will be examined .
The conclusion is that there should be a reasonable limitation of public law in the exercise of copyright . The key to solve the dilemma of such works is to improve the level of government supervision system and to prevent arbitrary " selective law enforcement " .
