【摘要】： 互聯(lián)網(wǎng)技術(shù)的發(fā)展,使得所有傳統(tǒng)作品都能夠上傳到網(wǎng)絡(luò)中加以儲存并傳播,也使公眾更青睞于直接在互聯(lián)網(wǎng)上進(jìn)行作品創(chuàng)作,于是網(wǎng)絡(luò)作品大量涌現(xiàn),但由于網(wǎng)絡(luò)本身的隱匿性與技術(shù)性,公眾在發(fā)表言論或文章時多署筆名、假名甚至匿名,造成許多作品的著作權(quán)(版權(quán))歸屬不清,既不利于保護(hù)著作權(quán)人的權(quán)利,又對公眾使用這些作品構(gòu)成不便。本文抽取作品中的一類,以網(wǎng)絡(luò)文字作品為視角,聯(lián)系國內(nèi)學(xué)者、司法審判人員對著作權(quán)研究的最新動態(tài),結(jié)合知識產(chǎn)權(quán)保護(hù)機(jī)制在實(shí)踐中的操作,研究網(wǎng)絡(luò)文字作品著作權(quán)歸屬問題。本文首先介紹文字作品的概念、特征、表現(xiàn)形式等,通過對文字作品的介紹進(jìn)一步引出網(wǎng)絡(luò)文字作品的定義、獨(dú)創(chuàng)性標(biāo)準(zhǔn)判定及其表現(xiàn)形式；緊接著將讀者引入網(wǎng)絡(luò)文字作品的著作權(quán)歸屬問題上。本文主要采用調(diào)查法、比較分析法、文獻(xiàn)研究法、個案分析法的方法,以提出問題、分析問題、解決問題為邏輯主線,以達(dá)到理清網(wǎng)絡(luò)文字作品的著作權(quán)歸屬的目的。在文章最后,筆者結(jié)合國外實(shí)踐并聯(lián)系我國實(shí)際情況,提出一些解決思路,為網(wǎng)絡(luò)文字作品提供保護(hù)合力,以期明確網(wǎng)絡(luò)文字作品的著作權(quán)歸屬,規(guī)范對網(wǎng)絡(luò)文字作品的著作權(quán)管理。
[Abstract]:With the development of Internet technology, all traditional works can be uploaded to the Internet for storage and dissemination, and the public prefer to create works directly on the Internet. However, due to the occult and technical nature of the network itself, many pseudonyms, pseudonyms and even anonymity are used by the public when they make statements or articles, which makes the copyright (copyright) of many works unclear, which is not conducive to the protection of the rights of copyright owners. It is also inconvenient for the public to use these works. This article extracts one kind of works, from the network writing work angle of view, contacts the domestic scholar, the judicial judge to the copyright research newest development, unifies the intellectual property rights protection mechanism in the practice operation, This paper studies the problem of copyright ownership of network writing works. This paper first introduces the concept, features, forms of expression of the text works, through the introduction of the text works to further lead to the definition of the network text works, the criteria of originality and the form of expression; Then the reader will be introduced into the copyright ownership of the network text works on the issue. This paper mainly adopts the methods of investigation, comparative analysis, literature research and case analysis, to raise problems, analyze problems and solve problems as the logical main line, in order to clear up the copyright ownership of the network text works. At the end of the article, the author combines the foreign practice and the actual situation of our country, puts forward some solutions, provides the protective force for the network character works, in order to define the copyright ownership of the network character works. To regulate the copyright management of works written on the Internet.
