【摘要】： 著作權(quán)法是保護作者的著作權(quán)以及與著作權(quán)有關(guān)權(quán)益的基本法律,其立法目的是為了鼓勵有益于社會主義精神文明、物質(zhì)文明建設(shè)的作品的創(chuàng)作和傳播,促進社會主義文化和科學事業(yè)的發(fā)展與繁榮。合理使用制度是著作權(quán)法的重要內(nèi)容之一,在調(diào)節(jié)著作權(quán)人、公眾之間的利益平衡方面起著關(guān)鍵的作用,并且得到了現(xiàn)代各國著作權(quán)法的普遍認可。 近年來,數(shù)字技術(shù)的進步和網(wǎng)絡(luò)的發(fā)展對傳統(tǒng)著作權(quán)法形成了極大的沖擊。在數(shù)字環(huán)境下,一方面作品的復制和傳播變得極為簡單和便捷,而法律的發(fā)展落后于技術(shù)的進步,著作權(quán)人的權(quán)益受到前所未有的威脅；另一方面由于法律的威懾力不足以制止侵權(quán)行為,技術(shù)手段就成為了彌補法律不足的手段,但技術(shù)手段在很大程度上限制了傳播,而且會時常阻止或限制基于公共利益的合理使用行為。為了使合理使用制度在當前飛速發(fā)展的數(shù)字環(huán)境中繼續(xù)發(fā)揮作用,世界各國都在積極尋求解決的辦法,不斷改革和完善立法。我國著作權(quán)法采用列舉方式明確規(guī)定合理使用的范圍,在數(shù)字環(huán)境下,這一判斷標準已很難適用。為了保持作者、社會公眾之間利益平衡,有必要深入研究合理使用制度理論,完善我國數(shù)字環(huán)境下著作權(quán)合理使用法律制度,這就是本文的目的所在,希望能夠從對著作權(quán)合理使用制度的研究中找到答案。 本文首先從傳統(tǒng)著作權(quán)合理使用制度的產(chǎn)生和發(fā)展入手,闡釋了合理使用制度的概念,分析了數(shù)字環(huán)境給合理使用制度帶來的新挑戰(zhàn)。然后,通過運用比較分析法、歷史分析法、案例分析法、歸納分析法等多種方法,探討了國內(nèi)外著作權(quán)合理使用制度立法現(xiàn)狀和我國合理使用制度存在的問題。最后,提出了數(shù)字環(huán)境下完善我國著作權(quán)合理使用制度的建議。全文共分為四章： 第一章為著作權(quán)合理使用制度的概述。概括敘述了著作權(quán)合理使用概念、沿革、合理使用制度體現(xiàn)的立法精神,從理論的角度來研究著作權(quán)的合理使用,了解其概念的內(nèi)涵,制度的發(fā)展歷程。 第二章闡述了數(shù)字環(huán)境下著作權(quán)合理使用制度面臨的挑戰(zhàn)。本章先對數(shù)字環(huán)境的形成及其對傳統(tǒng)著作權(quán)的影響進行了描述,再就數(shù)字環(huán)境對合理使用制度的沖擊進行了具體的分析,在此基礎(chǔ)上總結(jié)我國著作權(quán)合理使用制度的現(xiàn)狀及不足。 第三章的主要內(nèi)容是對國際公約、發(fā)達國家及我國關(guān)于著作權(quán)合理使用的立法狀況進行分析,揭示出當今國際社會對著作權(quán)合理使用制度進行完善的態(tài)度和方法。 第四章提出了構(gòu)建數(shù)字環(huán)境下著作權(quán)合理使用制度的設(shè)想。本章通過前文的分析和研究,結(jié)合我國國情,探索我國數(shù)字環(huán)境下著作權(quán)合理使用制度改革的方向,最后提出對我國著作權(quán)合理使用制度完善的建議。
[Abstract]:The copyright law is the basic law to protect the author's copyright and the rights and interests related to the copyright. Its legislative purpose is to encourage the creation and dissemination of works beneficial to the construction of socialist spiritual civilization and material civilization. To promote the development and prosperity of socialist cultural and scientific undertakings. The system of rational use is one of the important contents of copyright law, which plays a key role in regulating the balance of interests between copyright owners and the public, and has been generally recognized by modern copyright law. In recent years, the progress of digital technology and the development of network have a great impact on the traditional copyright law. In the digital environment, on the one hand, the reproduction and dissemination of works become extremely simple and convenient, while the development of law lags behind the progress of technology, and the rights and interests of copyright owners are under unprecedented threat; On the other hand, because the deterrent power of the law is not enough to stop the infringement, the technical means have become the means to make up for the insufficiency of the law, but to a large extent, the technical means have restricted the dissemination. And it often prevents or restricts reasonable use in the public interest. In order to make the system of rational use continue to play a role in the current rapid development of the digital environment, countries all over the world are actively seeking solutions to constantly reform and improve legislation. In the digital environment, it is difficult to apply this criterion to the copyright law of our country, which clearly prescribes the scope of reasonable use by means of enumeration. In order to maintain the balance of interests between the author and the public, it is necessary to deeply study the theory of rational use system and perfect the legal system of the rational use of copyright in the digital environment of our country. This is the purpose of this paper. Hope to be able to find out from the study of the system of fair use of copyright. This paper begins with the emergence and development of the traditional system of rational use of copyright, explains the concept of the system of rational use, and analyzes the new challenges brought by the digital environment to the system of rational use. Then, by means of comparative analysis, historical analysis, case analysis, inductive analysis and other methods, this paper discusses the domestic and foreign copyright fair use system legislative status and the existing problems of China's fair use system. Finally, the paper puts forward some suggestions on how to perfect the fair use system of copyright in digital environment. The full text is divided into four chapters: The first chapter is an overview of the system of fair use of copyright. This paper briefly describes the concept, evolution and spirit of legislation embodied in the system of rational use of copyright, studies the rational use of copyright from a theoretical point of view, understands the connotation of its concept and the course of development of the system. The second chapter expounds the challenges faced by the fair use of copyright in the digital environment. This chapter first describes the formation of digital environment and its impact on traditional copyright, and then analyzes the impact of digital environment on the system of rational use. On this basis, the author summarizes the current situation and shortcomings of the fair use of copyright in China. The third chapter mainly analyzes the international conventions, the legislation of the developed countries and our country on the rational use of copyright, and reveals the attitude and methods of the international community to improve the system of the fair use of copyright. The fourth chapter puts forward the idea of constructing the reasonable use system of copyright in the digital environment. Through the above analysis and research, this chapter explores the direction of the reform of the fair use of copyright system under the digital environment in our country, and finally puts forward some suggestions for the perfection of the fair use system of copyright in our country.
