中國(guó)著作權(quán)集體管理制度研究

【摘要】:著作權(quán)集體管理是一種權(quán)利信托制度,著作權(quán)人將其部分或全部的權(quán)利通過(guò)自主授權(quán)或法定授權(quán)的方式交與著作權(quán)集體管理組織,由著作權(quán)集體管理組織代為行使其著作權(quán),向使用者發(fā)放授權(quán),,同時(shí)進(jìn)行維權(quán)活動(dòng)。著作權(quán)集體管理組織通常是一種非營(yíng)利性組織。我國(guó)著作權(quán)集體管理制度產(chǎn)生的歷程和西方最大的不同點(diǎn)在于,著作權(quán)集體管理制度在西方多是自下而上的產(chǎn)物,而在我國(guó),著作權(quán)集體管理則是政府主導(dǎo)下的自上而下的一種全新的法律和社會(huì)制度的構(gòu)建,它還肩負(fù)著向民眾傳播版權(quán)文化、普及版權(quán)法律法規(guī)的重任。因此,對(duì)我國(guó)的著作權(quán)集體管理制度做一個(gè)深度的研究就有著很重要的意義。本文先從著作權(quán)集體管理制度的沿革和基本理論入手,通過(guò)比較國(guó)外先進(jìn)的著作權(quán)集體管理制度進(jìn)而落腳到我國(guó)現(xiàn)行著作權(quán)集體管理制度的問(wèn)題和其解決方法上。 本文共分為四章。第一章為著作權(quán)集體管理制度概述,分為制度沿革、基本理論兩個(gè)小節(jié),制度沿革分為國(guó)外和國(guó)內(nèi)兩個(gè)部分;基本理論分為定義、性質(zhì)、基本原則、法律關(guān)系四個(gè)部分,對(duì)著作權(quán)集體管理制度的歷史和基礎(chǔ)理論進(jìn)行了充分的闡述和梳理,為下文實(shí)證研究的展開(kāi)進(jìn)行了理論鋪墊。 第二章為部分發(fā)達(dá)國(guó)家的著作權(quán)集體管理制度的介紹和比較,通過(guò)對(duì)幾個(gè)典型的發(fā)達(dá)國(guó)家的著作權(quán)集體管理的制度比較找出它們值得我國(guó)借鑒的地方。 從第三章開(kāi)始,遵照既定的“提出問(wèn)題——解決問(wèn)題”的基本思路,對(duì)我國(guó)著作權(quán)集體管理制度建立以來(lái)所遇到種種問(wèn)題,采取實(shí)證研究的方法,通過(guò)“丁香花”歌曲侵權(quán)案、昆明飯店業(yè)與音著協(xié)之爭(zhēng)等真實(shí)案例,對(duì)國(guó)內(nèi)著作權(quán)集體管理制度中的會(huì)員制度問(wèn)題、著作權(quán)使用費(fèi)收取和分配問(wèn)題、著作權(quán)集體管理組織的監(jiān)督問(wèn)題以及著作權(quán)集體管理糾紛的解決問(wèn)題進(jìn)行了探討,指出這些問(wèn)題存在的原因,為解決對(duì)策的提出提供思考的方向。 第四章內(nèi)容為“解決問(wèn)題”的部分,針對(duì)第三章提出的問(wèn)題,借鑒國(guó)外的一些做法,從國(guó)情出發(fā)在著作權(quán)集體管理組織的監(jiān)督和財(cái)務(wù)制度的改進(jìn)、組織的會(huì)員工作和對(duì)外工作細(xì)節(jié)的完善、著作權(quán)使用費(fèi)的收費(fèi)標(biāo)準(zhǔn)以及著作集體管理爭(zhēng)議仲裁制度的構(gòu)建等方面提出了一些切實(shí)可行的建議。
[Abstract]:The collective management of copyright is a right trust system in which the copyright owner gives some or all of his rights to the copyright collective management organization by way of independent authorization or statutory authorization, and the copyright collective management organization exercises its copyright on behalf of the copyright collective management organization. Issue authorizations to users and carry out rights-safeguarding activities at the same time. Copyright collective management organization is usually a non-profit organization. The greatest difference between the process of the emergence of the collective copyright management system in China and that of the West lies in that the collective copyright management system in the West is mostly the product of bottom-up, while in our country, The collective management of copyright is the construction of a new legal and social system under the guidance of the government. It also shoulders the responsibility of spreading copyright culture to the public and popularizing copyright laws and regulations. Therefore, it is of great significance to do a deep research on the copyright collective management system in China. This paper begins with the evolution and basic theory of the copyright collective management system, then compares the foreign advanced copyright collective management system to the problems of the current copyright collective management system in our country and its solutions. This paper is divided into four chapters. The first chapter is an overview of the collective management system of copyright, which is divided into two parts: the evolution of the system, the basic theory, and the foreign and domestic parts; the basic theory is divided into four parts: definition, nature, basic principles, legal relations, etc. The history and basic theory of copyright collective management system are fully expounded and combed, which lays the foundation for the following empirical research. The second chapter is the introduction and comparison of the copyright collective management system in some developed countries. Through the comparison of several typical developed countries' copyright collective management system, we find out that they are worthy of our country's reference. From the third chapter, in accordance with the basic idea of "putting forward problems-solving problems", we adopt the method of empirical research to deal with the problems encountered since the establishment of the collective management system of copyright in our country, and adopt the case of infringing the rights of "lilac flower" songs. Real cases such as the dispute between the hotel industry in Kunming and the audio and authorship association, as well as the problems of the membership system in the collective management system of domestic copyright, the collection and distribution of copyright royalties, This paper probes into the supervision of copyright collective management organization and the settlement of copyright collective management disputes, points out the causes of these problems, and provides some thinking directions for solving the countermeasures. The fourth chapter is the part of "problem solving". In view of the problems raised in the third chapter, we can learn from some foreign practices and proceed from the national conditions to improve the supervision and financial system of the copyright collective management organization. This paper puts forward some practical suggestions on the perfection of the details of the organization's member work and external work, the charging standard of copyright usage fee and the construction of the arbitration system of collective management dispute.
