中國(guó)版權(quán)制度與版權(quán)經(jīng)濟(jì)發(fā)展關(guān)系研究

【摘要】: 在20世紀(jì)后期,計(jì)算機(jī)技術(shù)的普及,數(shù)字化的時(shí)代來(lái)臨,更由于互聯(lián)網(wǎng)技術(shù)的普及,世界經(jīng)濟(jì)進(jìn)入到了知識(shí)經(jīng)濟(jì)時(shí)代,此時(shí)的版權(quán)已經(jīng)成為重要的經(jīng)濟(jì)資源,在世界范圍內(nèi)發(fā)生了根本性的經(jīng)濟(jì)變革,版權(quán)經(jīng)濟(jì)產(chǎn)業(yè)初現(xiàn)端倪。而此時(shí),中國(guó)才剛剛開(kāi)始我們的基礎(chǔ)版權(quán)建設(shè)。進(jìn)入新世紀(jì),信息化的沖擊,新的產(chǎn)業(yè)形式不斷出現(xiàn),中國(guó)剛剛建立尚未健全的“傳統(tǒng)”版權(quán)制度(面向于以紙質(zhì)媒介為主體的版權(quán)產(chǎn)品)已經(jīng)顯現(xiàn)出對(duì)于新技術(shù)的不適應(yīng)。新的技術(shù)形勢(shì)之下,中國(guó)原有的版權(quán)制度存在的問(wèn)題產(chǎn)生了擴(kuò)大效應(yīng)。由于中國(guó)的版權(quán)制度,也就是版權(quán)保護(hù)的法律制度是在應(yīng)對(duì)國(guó)際要求的情況之下建立的,所以制度本身的建立就存在著與實(shí)際要求不相符合的情況。這種情況在新的數(shù)字技術(shù)發(fā)展的今天顯現(xiàn)得更加明顯。比如說(shuō),原本就產(chǎn)權(quán)不明的一些網(wǎng)絡(luò)著作上和數(shù)字圖書館中的產(chǎn)權(quán)更加難以明晰,在一段時(shí)期內(nèi),甚至法律上根本就沒(méi)有相應(yīng)的產(chǎn)權(quán)歸屬的相應(yīng)規(guī)定。這一情況的根本原因就在于圖書產(chǎn)權(quán)的歸屬并不明晰、劃分不夠明確,另外也是由于新的數(shù)碼技術(shù)平臺(tái)的出現(xiàn),對(duì)于相關(guān)版權(quán)保護(hù)的規(guī)定并沒(méi)有相應(yīng)跟上,導(dǎo)致數(shù)字版權(quán)保護(hù)不力。面對(duì)這種情況,我們必須進(jìn)行版權(quán)體制的改革。 本文主要圍繞中國(guó)版權(quán)制度建設(shè)與版權(quán)經(jīng)濟(jì)發(fā)展關(guān)系,考察中國(guó)當(dāng)前版權(quán)制度存在的問(wèn)題(如版權(quán)保護(hù)的法律不健全,版權(quán)制度本身前后矛盾,版權(quán)保護(hù)乏力等)對(duì)版權(quán)經(jīng)濟(jì)發(fā)展的影響。本文認(rèn)為,一個(gè)國(guó)家,尤其是發(fā)展中國(guó)家,其版權(quán)制度及其對(duì)版權(quán)保護(hù)的力度和水平離不開(kāi)該國(guó)當(dāng)初的具體國(guó)情。也就是說(shuō),與經(jīng)濟(jì)發(fā)展水平的高低相伴隨,版權(quán)制度及其對(duì)版權(quán)的保護(hù)力度和水平也有高有低,如一國(guó)版權(quán)保護(hù)出現(xiàn)問(wèn)題,均可在該制度建立之初的具體國(guó)情和環(huán)境中找到答案和原因。當(dāng)前,中國(guó)版權(quán)制度同時(shí)面臨數(shù)字化和國(guó)際化雙重沖擊。由于中國(guó)的版權(quán)制度存在著諸多不足和缺陷,而這些不足和缺陷又極大地影響著版權(quán)經(jīng)濟(jì)的發(fā)展。本文通過(guò)回顧中國(guó)版權(quán)制度的發(fā)展歷程,分析我國(guó)版權(quán)制度存在的問(wèn)題,以及通過(guò)比較研究,借鑒別國(guó)版權(quán)制度發(fā)展的經(jīng)驗(yàn)和教訓(xùn),尤其通過(guò)對(duì)美國(guó)的版權(quán)制度改革和發(fā)展的詳細(xì)分析,分析中國(guó)版權(quán)制度存在的問(wèn)題和缺陷,并基于分析提出相關(guān)改革建議和意見(jiàn)。 本文的主要工作及新意有:(1)通過(guò)對(duì)版權(quán)制度的歷史性分析,發(fā)現(xiàn)中國(guó)版權(quán)制度建設(shè)走過(guò)了一條由較單一和被動(dòng)的純制度建設(shè),進(jìn)而向經(jīng)濟(jì)建設(shè)轉(zhuǎn)變的路徑。(2)較全面地討論了諸如現(xiàn)有版權(quán)制度模式的缺陷、新形勢(shì)下關(guān)于版權(quán)定義的重新界定、版權(quán)制度建設(shè)的滯后性、對(duì)版權(quán)市場(chǎng)主體中弱勢(shì)方的保護(hù)、版權(quán)生產(chǎn)者與使用者之間的權(quán)益分配,以及中國(guó)未來(lái)版權(quán)制度變革及其模式選擇等一系列問(wèn)題。(3)采取了定性和定量研究相結(jié)合的方法,運(yùn)用包括法學(xué)、社會(huì)學(xué)、政治學(xué)和經(jīng)濟(jì)學(xué)等多學(xué)科分析對(duì)我國(guó)版權(quán)制度的改革問(wèn)題進(jìn)行探討。(4)本文認(rèn)為版權(quán)制度對(duì)版權(quán)經(jīng)濟(jì)的發(fā)展有著直接的重要影響。中國(guó)版權(quán)經(jīng)濟(jì)發(fā)展的空間和速度取決于相關(guān)版權(quán)制度的改革,重構(gòu)和完善程度。
[Abstract]:In the late twentieth Century, the popularization of computer technology, the era of digital, and the popularization of Internet technology, the world economy has entered the era of knowledge economy. The copyright has become an important economic resource, a fundamental economic change has taken place in the world, and the industry of copyright economy is beginning to emerge. We have just started the construction of our basic copyright. Into the new century, the impact of information technology and the emergence of new industrial forms. China has just established the unsound "traditional" copyright system (for the paper media as the main body of copyright products) has shown the new technology is not suitable. Under the new technical situation, the original copyright of China Because of the copyright system in China, that is, the legal system of copyright protection is established in response to the international requirements, the establishment of the system itself is not in conformity with the actual requirements. This situation is more evident today in the development of the new digital technology. For example, for example, the property rights in some network books and digital libraries, which were originally unidentified, were more difficult to clarify. In a period of time, there were no corresponding regulations on the ownership of property rights. The fundamental reason for this situation is that the ownership of books is not clear, the Division is not clear enough, and it is also the same. The emergence of the new digital technology platform does not keep up with the relevant regulations on copyright protection, which leads to poor digital copyright protection. In this case, we must reform the copyright system.
This article focuses on the relationship between China's copyright system construction and the development of copyright economy, and examines the existing problems of the copyright system in China (such as the legal imperfection of copyright protection, the contradictions of the copyright system itself, the lack of copyright protection, etc.). This article considers that a country, especially the developing country, has its copyright system. The degree and the strength and level of copyright protection can not be separated from the country's original national conditions. That is to say, with the level of economic development, the copyright system and its protection and level of copyright are also high and low. For example, the problem of copyright protection in one country can be found in the concrete conditions and environment of the system at the beginning of the establishment. At present, the copyright system in China is confronted with both digital and international shocks. There are many shortcomings and defects in China's copyright system, and these deficiencies and defects greatly affect the development of copyright economy. This paper analyzes the development process of China's copyright system and analyzes the existence of the copyright system in China. By comparing the experience and lessons of identifying the development of the country's copyright system through comparative studies, especially through a detailed analysis of the reform and development of the copyright system in the United States, the problems and defects in the Chinese copyright system are analyzed, and the relevant reform proposals and suggestions are put forward on the basis of analysis.
The main work and new meaning of this article are as follows: (1) through the historical analysis of the copyright system, it is found that the construction of Chinese copyright system has gone through a single and passive pure system construction, and then the path to the economic construction. (2) the defects of the existing copyright system model are discussed in a more comprehensive way, and the definition of copyright under the new situation is discussed. Redefinition, the lag of the construction of copyright system, the protection of the vulnerable party in the copyright market, the distribution of rights and interests between the copyright producers and the users, and the reform of China's future copyright system and the choice of its mode. (3) the method of combining qualitative and quantitative research is adopted, which includes law, sociology and politics. The reform of copyright system in China is discussed. (4) the copyright system has a direct and important influence on the development of copyright economy. The space and speed of the development of China's copyright economy depends on the reform of the relevant copyright system, the reconstruction and the extent of the good.
