【摘要】：《世界知識產(chǎn)權(quán)組織版權(quán)條約》(WCT)規(guī)定的向公眾傳播權(quán)和向公眾提供權(quán)是信息網(wǎng)絡(luò)傳播權(quán)的國際法淵源,在立法目的指引下對其進(jìn)行文本解讀有助于界定信息網(wǎng)絡(luò)傳播權(quán)的范疇并厘清其與廣播權(quán)的界限。WCT和著作權(quán)法規(guī)定的向公眾提供作品使公眾成員可在其個人選定的時間和地點獲得作品,應(yīng)依據(jù)法律本文進(jìn)行解釋,不宜附加額外要求。信息網(wǎng)絡(luò)傳播權(quán)和廣播權(quán)屬基本平行的兩種傳播權(quán),其界定應(yīng)以承載作品的信號在傳播介質(zhì)中保留的時間長短為依據(jù)。網(wǎng)絡(luò)實時直播或轉(zhuǎn)播屬廣播權(quán)范疇,而把作品提供于互聯(lián)網(wǎng)空間使公眾可在個人選定的時間和地點獲得之行為,包括網(wǎng)絡(luò)定時循環(huán)播放影視作品,屬信息網(wǎng)絡(luò)傳播權(quán)范疇。著作權(quán)法第三次修訂宜擴(kuò)展廣播權(quán),使之包括有線廣播及對有線廣播的有線轉(zhuǎn)播等傳播方式,藉以彌補(bǔ)我國著作權(quán)法下廣播權(quán)的缺陷。
[Abstract]:The right to communicate to the public and the right to provide the public as stipulated by the copyright Treaty of the World intellectual property Organization (WIPO) are the sources of international law for the right to communicate through information networks. The interpretation of the text under the guidance of legislative purposes helps to define the scope of the right to communicate on the Internet and to clarify its boundaries with the right to broadcast. WCT and the provision of works to the public under the copyright Act enable members of the public to choose in their own right. The time and place of obtaining the work, This article should be interpreted according to the law, and it is not suitable to add additional requirements. The right to communicate on information network and the right to broadcast are two kinds of communication rights which are basically parallel to each other. It should be defined on the basis of the length of time that the signal carrying the work remains in the medium of communication. Live or rebroadcast on the network falls within the scope of the right to broadcast, The provision of works in Internet space to enable the public to obtain them at a time and place of their choice, including the periodic circulation of film and television works on the Internet, falls within the scope of the right of dissemination of information on the Internet. The third revision of the copyright Law should extend the right to broadcast. It includes cable broadcasting and cable broadcasting, so as to make up for the defects of broadcasting right under copyright law of our country.
