【摘要】： 數(shù)字敦煌作品版權(quán)是指敦煌數(shù)字化形成的作品所應(yīng)當(dāng)享有的傳播、放送等權(quán)利。數(shù)字敦煌作品版權(quán)保護打破了時間、空間限制,可以永久性無損的保存敦煌石窟、文化藝術(shù)信息,有助于發(fā)展和弘揚具有中國特色的敦煌文化。數(shù)字敦煌作品版權(quán)研究為保護數(shù)字敦煌作品版權(quán)提供了理論依據(jù),同時,數(shù)字敦煌作品所具有的不可重復(fù)性、價值性、矛盾性、及時性等特點,和數(shù)字敦煌作品版權(quán)具有的復(fù)雜性、特殊性、規(guī)范性等特性使數(shù)字敦煌作品版權(quán)具有重要的研究意義。同其他版權(quán)作品比較,數(shù)字版權(quán)作品更多的是立足于虛擬空間的一種看得見摸不著的作品,數(shù)字版權(quán)作品傳播率更加廣泛,利用率也更大。 數(shù)字敦煌作品版權(quán)保護的客體范圍有：敦煌數(shù)字圖書館的匯編作品；敦煌數(shù)字圖像及虛擬洞窟的影視作品和美術(shù)作品；敦煌復(fù)制品及影視信息等文字作品和音像作品；數(shù)字敦煌作品的主體則應(yīng)當(dāng)是國家,由國家對數(shù)字敦煌作品進行統(tǒng)一授權(quán)和管理。數(shù)字敦煌作品版權(quán)還存在許多問題,如：數(shù)字敦煌作品侵權(quán)表現(xiàn)難以界定、數(shù)字敦煌作品的信息網(wǎng)絡(luò)傳播權(quán)與復(fù)制權(quán)難以保護、數(shù)字敦煌作品長期保護困難。美國的《數(shù)字千禧年版權(quán)法》以及歐盟的《電子商務(wù)指令》中的版權(quán)制度,對我們研究數(shù)字敦煌作品版權(quán)提供了寶貴的借鑒和指導(dǎo)。 數(shù)字敦煌作品版權(quán)維護可以采用版權(quán)費支付制度,通過互聯(lián)網(wǎng)的在線方式對數(shù)字敦煌作品的使用進行許可、收費；引進數(shù)字水印、數(shù)字加密、數(shù)字簽名新技術(shù)措施保護數(shù)字敦煌作品；還應(yīng)當(dāng)完善著作權(quán)法,將數(shù)字作品納入到著作權(quán)法規(guī)定的作品范圍之內(nèi)；明確數(shù)字敦煌作品使用范圍,協(xié)調(diào)保護與限制的關(guān)系；采用特別授權(quán)或特許經(jīng)營方式開發(fā)數(shù)字敦煌作品,鼓勵數(shù)字敦煌權(quán)利管理制度的完善；建立有效的監(jiān)管平臺對數(shù)字敦煌版權(quán)進行有效統(tǒng)一的監(jiān)管；并構(gòu)建一種全面,完善的數(shù)字敦煌作品版權(quán)機制。
[Abstract]:Copyright of digital Dunhuang works refers to the rights of dissemination, distribution, etc. Copyright protection of digital Dunhuang works breaks down time and space restrictions and can be preserved forever and undamaged. Cultural and artistic information is helpful to the development and development of Dunhuang culture with Chinese characteristics. The research on copyright of digital Dunhuang works provides a theoretical basis for the protection of copyright of digital Dunhuang works, and at the same time, digital Dunhuang works are not repeatable. The characteristics of value, contradiction, timeliness and the complexity, particularity and standardization of the copyright of digital Dunhuang works make the copyright of digital Dunhuang works of great significance. Digital copyright works are more based on the virtual space of a visible untouchable work, digital copyright works spread more widely, the utilization rate is also greater. The object scope of copyright protection of digital Dunhuang works includes: the compilation works of Dunhuang Digital Library, the film and television works and fine arts works of Dunhuang digital images and virtual caves, the text works and audio and video works such as Dunhuang replicas and film and television information, etc. The subject of digital Dunhuang works should be the state, and the state should authorize and manage the digital Dunhuang works uniformly. There are still many problems in the copyright of digital Dunhuang works, such as: the infringement of digital Dunhuang works is difficult to define. It is difficult to protect the right of information dissemination and reproduction of digital Dunhuang works, but it is difficult for digital Dunhuang works to be protected for a long time. It provides valuable reference and guidance for us to study the copyright of digital Dunhuang works. The copyright maintenance of digital Dunhuang works can adopt the payment system of copyright fee, license and charge the use of digital Dunhuang works through the online way of Internet, introduce digital watermark, digital encryption, Digital signature new technical measures should protect digital Dunhuang works, perfect copyright law, bring digital works into the scope of works stipulated in copyright law, clarify the scope of use of digital Dunhuang works, and coordinate the relationship between protection and restriction. To develop digital Dunhuang works with special authorization or franchise, to encourage the improvement of digital Dunhuang rights management system; to establish an effective regulatory platform for the effective and unified supervision of digital Dunhuang copyright; and to build a comprehensive system. Perfect copyright mechanism of digital Dunhuang works.
