【摘要】： 繼傳統(tǒng)的三大媒體:報(bào)紙、廣播和電視之后,具有交互式傳播特點(diǎn)的互聯(lián)網(wǎng)的出現(xiàn),極大地改變了作品的傳播方式和傳播環(huán)境。交互式傳播,這種對(duì)作品新的利用方式給原有的《著作權(quán)法》帶來了很大的挑戰(zhàn)。對(duì)此,各國際組織和國家都做出了自己的因應(yīng),中國也不例外。在詳盡考察相關(guān)國際條約以及對(duì)相關(guān)詞語進(jìn)行語義分析的基礎(chǔ)上,本文詳細(xì)解析了信息網(wǎng)絡(luò)傳播權(quán)概念,對(duì)信息網(wǎng)絡(luò)傳播權(quán)的相關(guān)制度進(jìn)行了深入探討。文章重點(diǎn)分析了信息網(wǎng)絡(luò)傳播權(quán)的間接侵權(quán)行為,并對(duì)不同類型的網(wǎng)絡(luò)服務(wù)提供者的間接侵權(quán)責(zé)任進(jìn)行了分析。對(duì)與信息網(wǎng)絡(luò)傳播權(quán)密切相關(guān)的合理使用制度、技術(shù)措施、權(quán)利管理信息,文章也一一進(jìn)行了簡要的分析。最后,通過將信息網(wǎng)絡(luò)傳播權(quán)與復(fù)制權(quán)、發(fā)行權(quán)、廣播權(quán)的比較,作者認(rèn)為我國關(guān)于傳播權(quán)的相關(guān)法律規(guī)定存在一定的缺陷,并提出了糾正這一缺陷的建議。
[Abstract]:Following the traditional three major media: newspapers, radio and television, the emergence of the Internet, which has the characteristics of interactive communication, has greatly changed the way in which works are disseminated and the environment in which they are disseminated. This new way of using the works has brought great challenges to the original copyright Law. To this end, various international organizations and countries have made their own response. China is no exception. On the basis of detailed investigation of relevant international treaties and semantic analysis of relevant words, this paper analyzes the concept of information network communication right in detail. The related system of information network communication right is discussed in depth. The article analyzes the indirect infringement of information network communication right. It also analyzes the indirect tort liability of different types of network service providers. It also makes a brief analysis of the reasonable use system, technical measures and rights management information, which are closely related to the information network communication right. By comparing the rights of information network communication with the rights of reproduction, distribution and broadcasting, the author thinks that there are some defects in the relevant laws and regulations on the right of communication in our country, and puts forward some suggestions to correct this defect.
