【摘要】：追隨著科技更新的腳步,我們已經(jīng)迎來了數(shù)字時代,互聯(lián)網(wǎng)在日常生活中扮演著不可或缺的重要角色。它完全改變了作品的傳播方式,將作品數(shù)字化后,任何人都可以通過極為容易的方式獲取相關(guān)內(nèi)容并進行再次傳播。如果法律不對網(wǎng)絡(luò)環(huán)境中的各種傳播行為做出適當規(guī)制,那么著作權(quán)人的作品將會面臨無數(shù)次的傳播,其利益將會遭受重大損失,進而降低他們創(chuàng)作作品的積極性。新的傳播技術(shù)催生了新的傳播行為,新的傳播行為如果得不到法律的合理控制則必然會引起相應(yīng)的權(quán)利糾紛。因網(wǎng)絡(luò)定時播放等非交互式網(wǎng)絡(luò)傳播行為產(chǎn)生的著作權(quán)糾紛逐年攀升,已然引起學界的普遍關(guān)注。為適應(yīng)互聯(lián)網(wǎng)給傳播方式帶來的變化,《著作權(quán)法》中明確規(guī)定了信息網(wǎng)絡(luò)傳播權(quán),但是在給該項權(quán)利下定義時,立法者并沒有完全領(lǐng)會其引用的相關(guān)法律條文的含義,導致該項權(quán)利調(diào)控的傳播行為具有單一性,無法適用于近年出現(xiàn)的新型網(wǎng)絡(luò)傳播行為。有的學者意欲尋求廣播權(quán)的規(guī)定來規(guī)制這種傳播行為,然而仔細梳理該項權(quán)利,我們就會發(fā)現(xiàn)由于我國廣播權(quán)確立時間較早,導致其定義過于傳統(tǒng),權(quán)利外延相對狹窄,上述傳播行為也無法涵蓋在其規(guī)制范圍之內(nèi)。最終產(chǎn)生的結(jié)果是非交互式網(wǎng)絡(luò)傳播行為作為一種新興傳播行為無法受到權(quán)利人擁有的任何一項專有權(quán)利的控制。但是毫無疑問,這種傳播行為明顯侵犯了著作權(quán)人的合法權(quán)益,綜合考慮各方利益,只能由兜底條款臨時對其進行限制。因其便捷性和及時性,非交互式網(wǎng)絡(luò)傳播行為的發(fā)展前景必定會越來越好。為對其進行有效規(guī)制,學理上提出了三種規(guī)制方案,第一種是擴展信息網(wǎng)絡(luò)傳播權(quán)的定義,第二種是擴展廣播權(quán)的定義,第三種是規(guī)定向公眾傳播權(quán)。本文梳理了相關(guān)權(quán)利的立法起因和立法目的,對國外規(guī)制此種傳播行為的不同做法一一分析,同時對比我國的立法現(xiàn)狀,對上述傳播行為的法律性質(zhì)加以認定,以期對其進行合理規(guī)制找到最佳解決方案。與此同時筆者也對因規(guī)制這種傳播行為引起的相關(guān)法律問題進行探討和解答。知識產(chǎn)權(quán)在一個國家的發(fā)展過程中占據(jù)了越來越重要的位置,因此本文寫作過程中也對我國著作權(quán)法的立法方式進行反省,對其查缺補漏,為以后相關(guān)法律的修改與制定奠定良好的基礎(chǔ)。
[Abstract]:Following in the footsteps of technological innovation, we have ushered in the digital age, the Internet plays an indispensable role in daily life. Anyone can get the content and redistribute it in a very easy way. If the law does not properly regulate all kinds of communication activities in the network environment, then the copyright owner's works will face numerous transmissions. Their interests will suffer a great loss, which in turn will reduce their enthusiasm for the creation of works. The new communication technology has given birth to new communication behaviors. If the new communication behavior can not be controlled reasonably by law, it will inevitably lead to the corresponding rights dispute. The copyright disputes caused by the non-interactive network communication behavior such as network timing play are rising year by year. In order to adapt to the changes brought by the Internet to the way of communication, the copyright Law clearly stipulates the right of information network communication, but in defining this right, The legislator did not fully understand the meaning of the relevant legal provisions cited by the legislator, which led to the singularity of the communication behavior regulated by the right. Some scholars want to seek the regulation of broadcasting right to regulate this kind of communication behavior. However, by carefully combing this right, we will find that broadcasting right was established earlier in our country. As a result, the definition is too traditional and the extension of rights is relatively narrow. The resulting non-interactive network communication behavior, as an emerging communication act, cannot be controlled by any exclusive right held by the right holder. This kind of communication behavior obviously infringes on the legitimate rights and interests of copyright owners. Considering the interests of all parties, it can only be temporarily restricted by the bottom clause. Because of its convenience and timeliness, The development prospect of non-interactive network communication behavior is bound to be better and better. In order to regulate it effectively, three regulation schemes are put forward in theory. The first is the definition of extending information network communication right, the second is the definition of expanding broadcasting right. The third is the regulation of the right to communicate to the public. This article combs the legislative causes and legislative purposes of the relevant rights, analyzes the different practices of regulating this communication behavior in foreign countries, and compares the current legislative situation of our country. Ascertaining the legal nature of the above-mentioned acts of communication, At the same time, the author also discusses and answers the relevant legal problems caused by the regulation of this kind of communication behavior. Intellectual property rights occupy in the development process of a country. Has become more and more important. Therefore, in the process of writing, the author also reflects on the legislative way of copyright law of our country, checks and omits the missing, and lays a good foundation for the revision and formulation of relevant laws in the future.
