【摘要】：媒體融合是基于新的傳播技術(shù)的發(fā)展所推動(dòng)的。傳播技術(shù)的發(fā)展一方面擴(kuò)展了作品信息的傳播方式,另一方面也導(dǎo)致了新舊媒體著作權(quán)糾紛的增加,給現(xiàn)有的著作權(quán)法律體系帶來(lái)了挑戰(zhàn)。著作權(quán)法影響著媒體的發(fā)展,而媒體融合也對(duì)著作權(quán)法律制度產(chǎn)生作用。媒體兼具權(quán)利人與傳播者的雙重屬性,特別是在媒體融合下,不管是新媒體還是傳統(tǒng)媒體,為加強(qiáng)自身新聞作品的著作權(quán)保護(hù),必須通過(guò)提高版權(quán)意識(shí),強(qiáng)化版權(quán)資產(chǎn)管理等措施提升自身管理水平。社會(huì)通過(guò)組建媒體版權(quán)聯(lián)盟來(lái)加強(qiáng)對(duì)傳統(tǒng)媒體的保護(hù),采取多元化的糾紛解決機(jī)制應(yīng)對(duì)新舊媒體之爭(zhēng),強(qiáng)化對(duì)自媒體的監(jiān)管。除此之外,法律應(yīng)當(dāng)回應(yīng)媒體融合對(duì)于著作權(quán)法律制度的影響,加快相應(yīng)立法建設(shè),通過(guò)完善相應(yīng)的著作權(quán)法律制度,從而為媒體融合的發(fā)展保駕護(hù)航,最終實(shí)現(xiàn)我國(guó)媒體產(chǎn)業(yè)又好又快發(fā)展,社會(huì)整體利益和媒體自身利益的雙贏。本文在結(jié)構(gòu)上分為四個(gè)部分:第一部分論述了媒體融合下及媒體著作權(quán)一般分析,通過(guò)對(duì)媒體融合概念國(guó)內(nèi)外研究現(xiàn)狀的梳理、互聯(lián)網(wǎng)時(shí)代的媒體融合以及媒體著作權(quán)國(guó)內(nèi)外立法保護(hù)現(xiàn)狀的比較法考察,找出媒體融合過(guò)程中,我國(guó)媒體現(xiàn)行著作權(quán)法律制度存在的問(wèn)題。第二部分論述了媒體融合對(duì)媒體著作權(quán)保護(hù)產(chǎn)生的影響分析。本部分通過(guò)分析媒體融合對(duì)于著作權(quán)產(chǎn)生的影響,主要影響有:新舊媒體著作權(quán)糾紛的增多、媒體融合時(shí)代的新聞著作權(quán)問(wèn)題、著作權(quán)限制制度的不合理性,如法定許可制度的不科學(xué)之處、以及合理使用制度規(guī)則難以適應(yīng)自媒體的發(fā)展。第三部分論述了媒體融合下媒體的著作權(quán)保護(hù)困境成因,主要認(rèn)為自媒體本身特點(diǎn)所導(dǎo)致的自媒體侵權(quán)行為難以認(rèn)定,以及傳統(tǒng)媒體自身作品保護(hù)意識(shí)不強(qiáng)等原因。第四部分為媒體融合下完善媒體著作權(quán)保護(hù)機(jī)制的建議。本文主要通過(guò)三個(gè)層面提出媒體融合下媒體著作權(quán)保護(hù)機(jī)制完善意見(jiàn)。第一個(gè)層面是完善我國(guó)著作權(quán)相關(guān)立法;第二個(gè)層面是強(qiáng)化版權(quán)行政與社會(huì)組織在媒體融合過(guò)程中的作用;第三個(gè)層面是媒體自身,不管是自媒體還是傳統(tǒng)媒體,都應(yīng)當(dāng)加強(qiáng)自身的媒體著作權(quán)保護(hù)。
[Abstract]:Media integration is based on the development of new communication technology. On the one hand, the development of communication technology expands the way of dissemination of works information, on the other hand, it also leads to the increase of copyright disputes between new and old media. It has brought challenges to the existing copyright legal system. Copyright law affects the development of the media, and media integration also plays a role in the copyright legal system. The media has the dual attributes of the obligee and the communicator, especially under the media convergence. Whether it is new media or traditional media, in order to enhance the copyright protection of their own news works, we must raise the awareness of copyright. Strengthening the management of copyright assets and other measures to improve their own management level. Society through the formation of media copyright alliance to strengthen the protection of traditional media, adopt a diversified dispute resolution mechanism to deal with the new and old media disputes. In addition, the law should respond to the influence of media integration on the copyright legal system, speed up the corresponding legislative construction, and protect the development of media integration by perfecting the corresponding copyright legal system. Finally, the media industry of our country develops well and rapidly, and the whole social interest and the media self-interest are both win-win. This paper is divided into four parts in structure: the first part discusses the media integration and the general analysis of media copyright. Through combing the present situation of the research on the concept of media convergence at home and abroad, the media integration in the Internet era and the comparative law of the current situation of the legislative protection of media copyright at home and abroad, we find out the process of media integration. The second part discusses the influence of media integration on the protection of media copyright. The main effects are: the increase of copyright disputes between new and old media, the problem of news copyright in the era of media convergence, the irrationality of copyright restriction system, such as the unscientific aspects of the legal licensing system, The third part discusses the causes of the media copyright protection dilemma under the media integration, mainly thinks that the self-media infringement caused by the characteristics of the self-media is difficult to identify. The 4th part is the suggestion to perfect the media copyright protection mechanism under the media integration. This paper mainly puts forward the media copyright protection machine under the media integration through three levels. The first level is to perfect the relevant legislation of copyright in our country; The second level is to strengthen the role of copyright administration and social organizations in the process of media integration; the third level is the media itself, whether self-media or traditional media, should strengthen their own media copyright protection.
