論著作權(quán)法上的出租權(quán)

【摘要】: 從20世紀(jì)80年代早期開始,出租電影作品、音像制品等成為利用作品與鄰接權(quán)客體的重要形式。如何解決著作權(quán)與作品原件及復(fù)制件所有人享有的物權(quán)之間在出租過程中發(fā)生的權(quán)利沖突,如何實(shí)現(xiàn)著作權(quán)人、物權(quán)所有人與消費(fèi)者之間的利益平衡,成為各國乃至整個(gè)國際知識(shí)產(chǎn)權(quán)界亟待解決的問題。TRIPS協(xié)議、WCT和WPPT等國際條約有關(guān)出租權(quán)的規(guī)定為各成員國建構(gòu)出租權(quán)制度提供了示范性規(guī)范和最低要求。 出租權(quán)作為著作財(cái)產(chǎn)權(quán)一項(xiàng)新的權(quán)利內(nèi)容,是法律賦予著作權(quán)人與相關(guān)權(quán)利人的專有權(quán)利。相對于其他著作財(cái)產(chǎn)權(quán)而言,其行使涉及的利益攸關(guān)方更多,權(quán)益沖突更加尖銳。立法者的態(tài)度比較謹(jǐn)慎。出租權(quán)的核心問題集中在對其必要性的探討、出租權(quán)的法律構(gòu)造等方面。 本文總體上分為五部分: 引言簡要介紹我國法上出租權(quán)的立法過程及立法者所持的態(tài)度。 正文第一部分探討出租權(quán)立法的必要性。出租權(quán)是數(shù)字時(shí)代平衡利益的需要,是從經(jīng)濟(jì)上對權(quán)利人給以補(bǔ)償以求社會(huì)公正的需要;同時(shí)也是適應(yīng)有關(guān)國際條約規(guī)定,履行國際義務(wù)的需要。 第二部分從客體、主體、內(nèi)容、行使與限制及侵權(quán)行為等五個(gè)方面剖析出租權(quán)的法律構(gòu)造。著作權(quán)客體是作品,著作權(quán)法上的出租權(quán)客體則不能生搬硬套且一概而論。著作權(quán)法上的出租權(quán)客體分為兩類:著作財(cái)產(chǎn)權(quán)中的出租權(quán)客體和鄰接權(quán)中的出租權(quán)客體。出租作品附著物過程中,出租標(biāo)的決定了出租利益的歸屬:如果出租標(biāo)的是物,目的僅在于發(fā)揮物的效用,收益歸附著物物權(quán)人;如果出租標(biāo)的是附著物體現(xiàn)的作品,收益歸著作權(quán)人或相關(guān)權(quán)利人。出租權(quán)主體是指著作權(quán)法上的享有出租權(quán)的人。我國著作權(quán)法上規(guī)定的出租權(quán)對權(quán)利人采取的是適度保護(hù)原則,即賦予特定主體對特定客體享有專有出租權(quán)。我國著作權(quán)法上確認(rèn)的出租權(quán)主體是著作權(quán)人或者與著作權(quán)有關(guān)的權(quán)利人。出租權(quán)的內(nèi)容是指出租權(quán)的各項(xiàng)權(quán)能。出租權(quán)的內(nèi)容決定了出租權(quán)的行使方式;出租權(quán)的行使是指權(quán)利人如何實(shí)施出租權(quán)。出租權(quán)的限制,是法律在一定條件下對出租權(quán)加以限制或者規(guī)定例外。侵害出租權(quán)的行為部分探討侵害出租權(quán)的行為方式。 第三部分從國際組織、國際條約規(guī)定的出租權(quán)的角度探討出租權(quán)。通過評(píng)介國際組織、國際條約規(guī)定的出租權(quán),梳理其間的關(guān)系。 第四部分結(jié)合有關(guān)法律規(guī)定探討我國法上出租權(quán)制度現(xiàn)狀,指出我國法上出租權(quán)制度的不足,并提出有關(guān)完善的建議。
[Abstract]:From the beginning of the early 1980s, rent movies, audio and video products has become an important form of the works and the adjacent right object. How to solve the conflict between the copyright and the original works and copies of the property rights of all people in the rental process, how to achieve the balance of interests between copyright owners, property owners and consumers, become the problems of.TRIPS protocol and the whole world of international intellectual property rights is urgently to be solved, the rules of WCT and WPPT and other international treaties related to rental rights provides a demonstration of the specification and the minimum requirements for various members to construct the rental right system.
The rental right as a new copyright right content, is the law of copyright and related rights to exclusive rights. Comparing with other works property rights, the exercise involves stakeholders more and more sharp conflict of rights and interests of legislators. A more cautious attitude. The core problem of rental rights focus on discussion the necessity of the legal structure of the rental right and so on.
This article is divided into five parts as a whole:
The introduction gives a brief introduction to the legislative process of the renting right in China and the attitude of the legislator.
The first part of the text discusses the necessity of legislation of rental rights. The right to rent is the need of balancing interests in the digital age, the need to compensate the right people for social justice and the need to fulfill the international obligations stipulated in the relevant international treaties.
The second part from the object, subject, content, legal structure of the five aspects of exercise and restriction of tort and analysis of the rental right.
