【摘要】：上世紀九十年代,我國頒布實施了《著作權(quán)法》,并加入了《伯爾尼保護文學和藝術(shù)作品公約》,從此我國的圖書版權(quán)貿(mào)易進入了一個全新的發(fā)展階段。近幾年,圖書版權(quán)貿(mào)易的年平均交易數(shù)量均在1萬五千種左右。隨著知識產(chǎn)品在經(jīng)濟領(lǐng)域地位的攀升,版權(quán)貿(mào)易也逐步發(fā)展為國際貿(mào)易的一個重要組成部分,成為各國經(jīng)濟的主要增長點。版權(quán)貿(mào)易不僅給國內(nèi)出版社帶來豐厚的經(jīng)濟利潤,通過與國外出版社的合作更給國內(nèi)出版人打開了一扇通往世界的大門,從此我們有機會在更加廣闊的舞臺上展示自己。然而,國際版權(quán)貿(mào)易不單單是一種經(jīng)濟行為,也不僅僅是一種文化行為,還是一種法律行為,并是這些多種行為的有機綜合體。為此,對版權(quán)貿(mào)易的研究也引起了國內(nèi)外很多學者的重視,把它作為學術(shù)研究的熱點之一。 本文不是單純羅列一份嚴密的版權(quán)貿(mào)易許可合同的條款,然后分析其中需要注意的問題,諸如許可種類、授權(quán)區(qū)域、權(quán)利保證、版稅支付方式、管轄法律等等——盡管這些都是版權(quán)貿(mào)易中必須注意的法律問題,而是基于個人多年國際版權(quán)貿(mào)易的實踐,從法律的角度,對現(xiàn)階段我國版權(quán)貿(mào)易,尤其是版權(quán)引進中存在的、特別是國家相關(guān)法律法規(guī)沒有相關(guān)規(guī)定或者說隨著版權(quán)貿(mào)易的發(fā)展以及新興文化載體和傳播方式的出現(xiàn),有關(guān)規(guī)定不再適合客觀情況而亟待予以完善的法律問題,進行了一些思考和分析,并進而從立法上、司法實踐層面以及版權(quán)行政管理的角度提出一些有益的建議,最終達到進一步推動國際版權(quán)貿(mào)易產(chǎn)業(yè)健康發(fā)展、提高我國知識產(chǎn)權(quán)保護水平,進而進一步提升我國在知識產(chǎn)權(quán)保護方面良好的國際形象。 本文共分四個部分,第一部分是國際版權(quán)貿(mào)易概述,對版權(quán)、國際版權(quán)貿(mào)易、國際版權(quán)貿(mào)易的種類以及國際版權(quán)貿(mào)易的現(xiàn)狀做必要的闡述；第二部分論述國際版權(quán)許可合同主體資格審查與司法審判的問題,該部分又分為四節(jié),結(jié)合國際版權(quán)貿(mào)易中發(fā)生的實際案例,論述版權(quán)貿(mào)易許可主題資格審查的意義以及在司法實踐中法院如何正確全面處理許可主體資格審查與合同無效的問題；第三部分論述網(wǎng)絡(luò)出版引進外國圖書的內(nèi)容審查問題,針對目前我國相關(guān)法律法規(guī)欠缺,提出有關(guān)解決建議；第四部分是關(guān)于我國的版權(quán)保護問題,結(jié)合我國出版業(yè)界存在的嚴重盜版和偽書問題以及維權(quán)的幾種途徑分別存在的問題,從版權(quán)立法、版權(quán)行政管理和司法審判的角度,分別提出解決問題的建議。 本文通過對這些問題的分析,對解決辦法進行了探討,希望能夠提供一些有價值的意見和建議,為國際版權(quán)貿(mào)易的實踐提供一些指導(dǎo),為版權(quán)貿(mào)易產(chǎn)業(yè)的健康發(fā)展提供有益的幫助,為版權(quán)法律法規(guī)的進一步完善以及進一步樹立我國在知識產(chǎn)權(quán)保護方面的良好國際形象貢獻綿薄之力。
[Abstract]:In -10s, China promulgated and implemented the copyright Law and joined the Berne Convention on the Protection of Literary and artistic works. Since then, China's book copyright trade has entered a new stage of development. The annual average number of trade in book copyright is about 15,000. With the increasing status of intellectual products in the economic field, copyright trade has gradually developed into an important part of international trade. Copyright trade not only brings rich economic profits to domestic publishing houses, but also opens a door to the world for domestic publishers through cooperation with foreign publishing houses. Now we have the opportunity to show ourselves on a broader stage. However, international copyright trade is not just an economic act, nor is it just a cultural act, but also a legal act. Therefore, the research on copyright trade has attracted the attention of many scholars at home and abroad, and it is regarded as one of the hot spots of academic research. This paper does not simply list the terms of a strict copyright trade license contract, and then analyzes the problems that need to be noted, such as the type of license, the authorized area, the guarantee of rights, the way of payment of royalty. Jurisdiction law and so on-although these are legal issues that must be paid attention to in copyright trade, but based on the practice of individual international copyright trade for many years, from the legal point of view, the copyright trade in China at this stage, especially the introduction of copyright, exists at this stage. In particular, with the development of copyright trade and the emergence of new cultural carriers and modes of communication, the relevant laws and regulations are no longer suitable for the objective situation and need to be perfected urgently with the development of copyright trade and the emergence of new cultural carriers. This paper makes some thoughts and analyses, and then puts forward some useful suggestions from the aspects of legislation, judicial practice and copyright administration, so as to further promote the healthy development of the international copyright trade industry. Improve the level of intellectual property protection in China, and further enhance our good international image in intellectual property protection. This paper is divided into four parts. The first part is an overview of international copyright trade, the international copyright trade, international copyright trade types and the current situation of international copyright trade. The second part discusses the subject qualification examination and judicial trial of international copyright licensing contract, which is divided into four sections, combined with the actual cases in international copyright trade. This paper discusses the significance of the subject qualification examination of copyright trade license and how the courts deal with the issue of the qualification examination of the licensing subject and the invalidity of the contract in the judicial practice, the third part discusses the content review of the introduction of foreign books by the network publishing. In view of the lack of relevant laws and regulations in our country at present, some suggestions are put forward. Part 4th is about copyright protection in China. According to the problems of serious piracy and counterfeit books and several ways of protecting the rights of the publishing industry in our country, this paper puts forward some suggestions on how to solve the problems from the angles of copyright legislation, copyright administration and judicial trial. Through the analysis of these problems, this paper discusses the solutions, hoping to provide some valuable opinions and suggestions, and provide some guidance for the practice of international copyright trade. It can provide beneficial help for the healthy development of copyright trade industry, further improve the copyright laws and regulations and further establish the good international image of our country in the protection of intellectual property rights.
