【摘要】：著作權的產(chǎn)生與發(fā)展,與人類科學技術的發(fā)展密切相關,二者互相影響、共同向前發(fā)展。事實上,著作權制度本身就是科學技術的產(chǎn)物。在印刷術發(fā)明之前,人們主要以抄寫、講誦的方式來傳播文學藝術作品和科技作品,不存在大量的復制,因而也不存在著作權的保護問題。隨著造紙技術的發(fā)明,尤其是印刷術的發(fā)明,對作品的大量而節(jié)省費用的復制成為可能,也就產(chǎn)生了著作權保護的必要。在我國,自宋代普遍采用雕版印刷術以后,就有了版權保護的事例。即使到了今天,基于印刷術而產(chǎn)生的復制權,仍然是著作權制度中的一項基本的和最重要的權利。 著作權制度這個科學技術的產(chǎn)物,自其產(chǎn)生以來,它就是隨著科學技術的發(fā)展而不斷的發(fā)展變化。或者說,科學技術的發(fā)展總是對著作權制度不斷提出挑戰(zhàn),而著作權制度也在應戰(zhàn)中不斷發(fā)展完善。大體說來,著作權制度應對科學技術的挑戰(zhàn)主要體現(xiàn)在兩個方面,一是隨著科學技術的發(fā)展,產(chǎn)生了一些新的受保護的客體,著作權制度逐漸將它們納入受保護的范圍之中；二是隨著科學技術的發(fā)展,產(chǎn)生了一些新的對于作品的利用方式,著作權制度逐漸將這些新的利用方式納入著作權的范圍之內(nèi)。 在著作權制度與科學技術的互相影響和共同向前發(fā)展的這個過程中,著作權的合理使用制度發(fā)揮著平衡著作權人和使用人之間利益的重要作用。在傳統(tǒng)紙質媒介中,合理使用制度的作用得到了很大的體現(xiàn),在教育、公益性事業(yè)以及個人使用等非營利性使用方式上為社會公眾爭取了很多的利益。然而,20世紀80年代以來,隨著電子信息技術的飛速發(fā)展,因特網(wǎng)正以驚人的速度將觸角延伸至人類活動的幾乎所有領域,成為繼報紙、廣播、電視之后的“第四媒體”。伴隨計算機網(wǎng)絡技術而產(chǎn)生的對網(wǎng)絡作品復制、下載、修改的便捷使著作權人大驚失色,網(wǎng)上一時之間成了盜版的天堂,打破了傳統(tǒng)著作權人與使用人之間的利益平衡關系,嚴重沖擊了著作權的合理使用制度,使傳統(tǒng)著作權的合理使用制度面臨著前所未有的巨大考驗。技術保護措施的使用扭轉了這一局面,但是它在充分保護了著作權人利益的同時,又幾乎剝奪了公眾合理接觸和使用作品的所有機會,著作權法處于失衡狀態(tài)。為了恢復在互聯(lián)網(wǎng)環(huán)境下這種被打破的平衡,有必要對網(wǎng)絡環(huán)境下的著作權的合理使用制度進行研究,合理使用制度需要適應網(wǎng)絡環(huán)境而進行變革,從而在網(wǎng)絡環(huán)境下維護著作權人和社會公眾的合法利益,這就是研究其的目的所在。本文力求在我國現(xiàn)行著作權法對網(wǎng)絡環(huán)境下合理使用制度的規(guī)定立法滯后的情況下,將針對網(wǎng)絡環(huán)境對合理使用制度造成的沖擊,結合國外立法和司法實踐,對我國網(wǎng)絡著作權保護的著作權的合理使用制度提出若干思考。
[Abstract]:The emergence and development of copyright are closely related to the development of human science and technology. They affect each other and develop together. In fact, the copyright system itself is the product of science and technology. With the invention of paper-making technology, people mainly spread literary and artistic works and scientific and technological works by copying and reciting. There are not a large number of copies, so there is no copyright protection problem. In particular, the invention of printing, the reproduction of a large number of works and save money has become possible, which has resulted in the necessity of copyright protection. In China, since the Song Dynasty, the general use of engraving printing. Even today, the right of reproduction based on printing is still one of the basic and most important rights in the copyright system. The copyright system, the product of science and technology, has been developing and changing with the development of science and technology since it came into being. In other words, the development of science and technology has always challenged the copyright system. Generally speaking, the copyright system to meet the challenges of science and technology is mainly reflected in two aspects, one is with the development of science and technology. Some new protected objects have emerged, and the copyright system has gradually brought them into the scope of protection; Second, with the development of science and technology, some new ways of using works have emerged, and the copyright system has gradually brought these new ways of use into the scope of copyright. In the process of mutual influence and common development of copyright system and science and technology. The fair use of copyright plays an important role in balancing the interests of copyright owners and users. In the traditional paper media, the role of fair use system has been greatly reflected in education. Public welfare undertakings and private use of non-profit use methods for the public to fight for a lot of interests. However, since 80s of the 20th century, with the rapid development of electronic information technology. The Internet is extending its tentacles to almost all areas of human activity at an alarming rate, becoming "4th media" after newspapers, radio and television. The convenience of downloading and modifying makes the copyright owners startled, and becomes the paradise of piracy on the Internet for a time, breaking the balance of interests between the traditional copyright owners and the users. Serious impact on the fair use of copyright system, so that the traditional fair use of copyright system is facing an unprecedented great test. The use of technical protection measures to reverse this situation. However, it not only fully protects the interests of copyright owners, but also deprives the public of all opportunities for reasonable access and use of works. Copyright law is in a state of imbalance. In order to restore this broken balance in the Internet environment, it is necessary to study the reasonable use of copyright in the network environment. Reasonable use of the system needs to adapt to the network environment and change, so as to protect the legitimate interests of copyright owners and the public in the network environment. This is the purpose of the study. This paper tries to aim at the impact of the network environment on the reasonable use system under the condition that the legislation of the current copyright law of our country on the reasonable use system under the network environment lags behind. Combined with foreign legislation and judicial practice, this paper puts forward some thoughts on the rational use system of the copyright of network copyright protection in our country.
