【摘要】：數(shù)字技術和網(wǎng)絡技術的迅速發(fā)展,給著作權的利用和保護帶來深刻的變化與影響。數(shù)字技術的運用使得版權市場的作者大眾化、傳播渠道網(wǎng)絡化、復制內容完美化和利用需求多元化。這些新的變化,一方面豐富了版權市場的創(chuàng)作內容,加快了信息的傳播,改變了人們獲取信息的渠道,促進了數(shù)字版權經濟的快速發(fā)展。另一方面在數(shù)字化條件下著作權易被侵權,原有的傳統(tǒng)版權市場利益平衡被打破,著作權人利益受到嚴重損害。由于單個著作權人力量薄弱,維權難度大,所以絕大部分著作權人寧愿將作品握在自己手中,而使用者對于信息的需求量隨著經濟的發(fā)展不斷增大,但卻不知道從何處獲得相關作品的著作權。從社會公眾的角度分析,精神食糧的創(chuàng)作者和傳播者的行為將嚴重損害社會公眾獲取知識和信息、的權利,不利于我國文化產業(yè)的傳播和發(fā)展。 為推動數(shù)字版權經濟的快速發(fā)展,滿足各利益方的需求,著作權集體管理制度和組織應運而生。韋之先生認為,著作權集體管理制度是指規(guī)范著作權人、鄰接權人或者是其他權利人授權有關組織,代為集中管理著作權、鄰接權的制度。著作權集體管理制度乃是現(xiàn)代著作權法制的重要組成部分。根據(jù)我國《著作權集體管理條例》,我國著作權集體管理組織,是指為權利人利益依法設立,根據(jù)權利人授權、對權利人的著作權或者與著作權有關的權利進行集體管理的社會團體。著作權集體管理有著其不可取代的優(yōu)勢。從經濟學的角度分析,在網(wǎng)絡環(huán)境下采取著作權集體管理,可以最大限度地降低成本,彰顯法律的效益價值。此外,著作權集體管理制度有助于保護著作權人和相關權利人的合法權益,促進其創(chuàng)作的積極性,還能為使用者提供便利,采取一攬子授權許可的方式以降低使用者搜索作品和談判的成本,提高使用者對作品的使用量和使用效率。這種管理方式在權利人和使用者之間構建起一座溝通的橋梁,兼顧權利人、使用者和公眾的利益,從而達到權利人個人利益和社會公眾利益的良性平衡。 數(shù)字技術和網(wǎng)絡環(huán)境為著作權集體管理帶來了前所未有的挑戰(zhàn),同時,著作權集體管理組織本身的弱點也嚴重阻礙了其快速發(fā)展。我國第一個著作權集體管理組織,即中華人民共和國音樂著作權協(xié)會于1992年成立,至今不足二十年。而國外的著作權集體管理組織最早產生于19世紀的法國,至今已有兩百多年的歷史,其相關法律法規(guī)完善,組織機構完善,擁有大批會員,對版權市場有著深遠的影響力。相對而言,我國著作權集體管理起步較晚,且發(fā)展緩慢,理論研究深度不夠,相關立法欠缺,組織機構不完善且缺乏社會基礎。隨著知識產權的國際交流與合作越來越頻繁,加強知識產權的保護已經刻不容緩。在著作權保護領域中,加強著作權集體管理制度和組織的建設具有重要的理論和現(xiàn)實意義。 基于上述理論探討和實踐思考,本文以著作權集體管理制度為研究對象,采用歷史研究、比較研究、理論探討等研究方法,嘗試結合著作權集體管理的理論和國內外實踐,挖掘我國在著作權集體管理實踐領域中所存在的種種問題,對我國的著作權集體管理制度的構建進行研究探討并提出相應的完善措施。 本文除緒論和結語外,共分為五大部分。 第一部分即著作權集體管理概述,主要是著作權集體管理的基礎理論分析,共分為三小節(jié)進行論述。第一節(jié)主要介紹了國內外著作權集體管理的歷史沿革和發(fā)展現(xiàn)狀。首先介紹了法國戲劇作家協(xié)會和作家、作曲家和音樂出版人協(xié)會成立的背景和歷史意義,及其對歐洲各國的影響力和數(shù)字環(huán)境下各國著作權集體管理管理組織的新發(fā)展；運用比較的方法介紹了我國著作權集體管理的歷史和我國五個著作權集體管理組織的現(xiàn)狀。第二節(jié)主要介紹了著作權集體管理組織的概念和性質。闡述了集體管理組織的信托性質、非營利性質、半官方性質和壟斷性質。第三節(jié)內容為著作權集體管理組織的權利正當性研究,其權利的正當性是其存在和發(fā)展的基礎。 第二部分主要是介紹集體管理制度對于數(shù)字版權經濟的推動作用。第一節(jié)闡述了數(shù)字化作品的性質與數(shù)字版權之間的關系,明確數(shù)字化作品作為著作權保護的對象是著作權集體管理組織管理數(shù)字化作品的前提條件。第二節(jié)闡述了版權經濟存在和發(fā)展的理論基礎及其對于整個經濟社會的重要作用。第三節(jié)主要介紹了數(shù)字化作品的使用方式,為闡述著作權集體管理制度的完善措施提供基礎。第四節(jié)強調著作權集體管理對于數(shù)字版權經濟發(fā)展的推動作用。 第三部分主要是運用比較分析的方法介紹國內外關于著作權集體管理的理論和實踐研究。第一節(jié)主要從首先從制度建設、組織建立兩個方面介紹了美、日、德、英等國的著作權保護在應對數(shù)字時代的新挑戰(zhàn)下所做出的努力和成就,對我國著作權集體管理發(fā)展具有提導和借鑒意義。第二節(jié)主要是對我國著作權集體管理制度的研究現(xiàn)狀和實踐情況進行簡要闡述。 第四部分主要內容在于挖掘數(shù)字時代下著作權管理所存在的問題,為本論文的核心部分。本部分內容以Google陽中國文字著作權協(xié)會(簡稱“文著協(xié)”)雙方基于Google數(shù)字圖書館計劃侵犯我國570多名作者權益的事件進行協(xié)商和談判的過程為切入點,挖掘我國著作權集體管理目前所存在的問題。著作權集體管理組織所存在的問題可以分為內部問題和外部問題。第一節(jié)主要闡述外部問題對著作權集體管理組織發(fā)展的影響。外部問題主要是：數(shù)字技術的發(fā)展打破了版權市場原有的利益平衡,造成了權利人、使用人之間的利益沖突；非會員管理缺失是集體管理組織發(fā)展緩慢的一個重要原因；國家行政力量對著作權集體管理的干預造成了集體管理組織行政色彩濃厚,同時,國家行政機關對于集體管理組織的扶持力度遠遠不夠是阻礙其發(fā)展的一個關鍵外部問題；此外,另一至關重要的外部問題阻礙了集體管理組織的發(fā)展,即我國公民著作權意識淡薄。在外部環(huán)境不夠理想的情況下,集體管理組織本身還存在一些難以逾越的問題,這便是本部分第二節(jié)的主要內容。主要闡述了以下四個方面的問題：組織機構不完善、缺乏專業(yè)人員和技術支持；著作權人對集體管理組織的授權問題成為制約集體管理組織發(fā)展的瓶頸；著作權使用許可方式及使用費標準問題亟待改善；集體管理組織缺乏監(jiān)督機制,組織運行不透明；集體管理組織相互之間、集體管理組織與相關協(xié)會之間缺乏溝通和協(xié)作。 第五部分基于前人工作的基礎之上針對上述問題提出了相應的改善措施,即數(shù)字時代下著作權集體管理制度之重構。建議改善措施主要包括：引入競爭機制,活躍數(shù)字版權市場；建立綜合型的數(shù)字版權交易系統(tǒng),提升版權交易效率；明確其社會團體定位,保障集體管理組織的獨立自主性；加強宣傳工作,提升公眾的著作權保護意識；完善集體管理組織各項職能,促進集體管理組織以數(shù)字時代為契機,快速健康發(fā)展：構建綜合監(jiān)督機制,保證集體管理組織運行的透明度。
[Abstract]:With the rapid development of digital technology and network technology , the use and protection of copyright is profoundly changed and influenced . The application of digital technology makes the author of the copyright market popular , the communication channel is networked , the reproduction content is perfect and the demand is diversified . Copyright collective management system is an important part of modern copyright law . In addition , copyright collective management system is an important part of modern copyright law system . In addition , copyright collective management system is an important part of modern copyright law system . Digital technology and network environment have brought unprecedented challenges for collective management of copyright . At the same time , the weakness of copyright collective management organization itself has hindered its rapid development . Based on the above - mentioned theoretical discussion and practical thinking , this paper attempts to explore the problems existing in the field of copyright collective management by combining the theory of collective management of copyright and the practice in the field of collective management of copyright by taking the theory of collective management of copyright as the object of research , and exploring the problems existing in the field of collective management of copyright . In addition to the introduction and the conclusion , this paper is divided into five parts . The first part is the summary of copyright collective management , which is mainly the basic theory analysis of the collective management of copyright , which is divided into three sections . The first section introduces the background and historical significance of copyright collective management at home and abroad , and introduces the concept and nature of copyright collective management organization in China . The second section introduces the trust property , non - profit nature , semi - official nature and monopoly nature of copyright collective management organization . The second part focuses on the promotion of collective management system to digital rights economy . The first section describes the relationship between the nature of digital works and digital rights , and specifies that digital works as the object of copyright protection is a prerequisite for the management of digital works by copyright collective management organizations . Section II sets forth the theoretical foundation of copyright economic existence and development and its important role in the whole society as a whole . The third part mainly introduces the theory and practice of copyright collective management at home and abroad by means of comparative analysis . The first section introduces the efforts and achievements made by the copyright protection in the countries of America , Japan , Germany and Britain under the new challenge of the digital age . The fourth part focuses on the problems existing in the copyright management in the digital age , which is the core part of this thesis . The fifth part puts forward the corresponding improvement measures for the above - mentioned problems based on the previous work , that is , the reconstruction of the copyright collective management system in the digital age . It is suggested that the improvement measures mainly include the introduction of the competition mechanism , the active digital rights market , the establishment of the comprehensive digital rights trading system , the improvement of the copyright trading efficiency , the improvement of the public ' s copyright protection consciousness , the improvement of the functions of the collective management organization , the promotion of the collective management organization to take the digital age as an opportunity , and the rapid health development : to build the comprehensive supervision mechanism and ensure the transparency of the operation of the collective management organization .
