論湘西苗寨糾紛的兩種解決機制

【摘要】:湘西苗族是以寨落為單位聚族而居的,清朝的統(tǒng)治秩序在湘西苗疆確立以前,湘西苗疆的法律秩序是自然形成的。這種法律秩序以寨落為單位,存在兩種糾紛解決機制:一是"理老"調(diào)解,二是"神明"裁判。兩者合法性的來源不同,"理老"調(diào)解需要雙方當事人的授權(quán),而"神明"裁判則依據(jù)雙方當事人的"申請",兩種糾紛解決機制背后有復雜的邏輯,它們共同維護和奠定了湘西苗族寨落相對穩(wěn)定的社會秩序。
[Abstract]:The Miao nationality lived in the village as the unit and the ruling order of the Qing Dynasty was formed naturally before the establishment of the Miao area in the western Hunan Province.There are two kinds of dispute settlement mechanism in this legal order: one is mediation, the other is the judgment of God.The sources of legitimacy of the two are different. The mediation between the two parties requires the authorization of both parties, while the "Shenming" adjudication is based on the "application" of the two parties, and there is complicated logic behind the two dispute resolution mechanisms.They jointly maintain and establish a relatively stable social order in Xiangxi Miao villages.
