【摘要】：滿族家規(guī)是民間法的組成部分,可以法的效力為視角,對(duì)其進(jìn)行歷史與現(xiàn)實(shí)的考察。從滿族家規(guī)的現(xiàn)實(shí)根據(jù)看,在穆昆制發(fā)達(dá)的清代社會(huì),滿族家規(guī)有強(qiáng)有力的權(quán)力支撐,曾對(duì)家族成員的行為發(fā)揮著實(shí)際上的約束力;從滿族家規(guī)的道德和心理根據(jù)看,它與其所處時(shí)代的主流價(jià)值觀相符合,對(duì)家族成員具有相當(dāng)強(qiáng)的心理影響力。因此,滿族家規(guī)在歷史上具有相當(dāng)?shù)男Я�。伴隨著時(shí)代的變遷,市民社會(huì)的出現(xiàn),上述維度中僅有道德和心理層面在支撐著滿族家規(guī)的效力,作為一種軟性要求,今天的滿族家規(guī)實(shí)際上起著樹立并倡導(dǎo)家風(fēng)的作用。
[Abstract]:The Manchu rule is part of the folk law, the law effectiveness can be investigated from the perspective of history and reality. The reality according to the rules from the Manchu, in Mu Kun developed Qing Dynasty, Manchu rule has strong power support, told the family member's behavior plays in fact from binding; the Manchu Family Moral and psychological basis, it with the mainstream value concept of the era is consistent, with a strong psychological impact on family members.
