【摘要】:作為一種新興的糾紛解決模式,刑事和解不但注重對社會秩序的修復,而且重視對受害人個人權(quán)益的補償,這和民族習慣法的理念有相似之處。因此,可以利用刑事和解制度作為橋梁把民族習慣法引入到刑事訴訟體系中來,使民族習慣法在訴訟中發(fā)揮合理作用。這可以有效地減少民族習慣法對于刑事法治在民族地區(qū)推行的阻抗,使刑事訴訟可以更有效率地在民族地區(qū)展開。針對現(xiàn)行刑事和解制度設(shè)定的不足,有必要結(jié)合民族習慣法的特點,適度擴大刑事和解的適用范圍,維持司法人員主導地位同時增設(shè)和解主持人,建立矛盾調(diào)解中心進行訴訟外和解。
[Abstract]:As a new mode of dispute resolution, criminal reconciliation pays attention not only to the repair of social order, but also to the compensation of personal rights and interests of victims, which is similar to the idea of national customary law. Therefore, we can make use of the criminal reconciliation system as a bridge to introduce national customary law into the criminal procedure system, so as to make the customary law play a reasonable role in litigation. This can effectively reduce the resistance of national customary law to the criminal rule of law in ethnic areas, so that criminal proceedings can be more efficient in ethnic areas. In view of the shortcomings of the current criminal reconciliation system, it is necessary to expand the scope of the application of criminal reconciliation, maintain the leading position of the judiciary and set up conciliation moderators, and establish conciliation mediation centers for settlement outside the litigation according to the characteristics of the national customary law.
