【摘要】：通過(guò)研究大量國(guó)內(nèi)外臨終關(guān)懷立法的政策、文獻(xiàn),將其立法現(xiàn)狀進(jìn)行綜述,并對(duì)今后我國(guó)制定臨終關(guān)懷法律法規(guī)政策等進(jìn)行探討,以期促進(jìn)更多學(xué)者的關(guān)注,推動(dòng)我國(guó)臨終關(guān)懷立法的實(shí)現(xiàn)。臨終關(guān)懷立法在我國(guó)除臺(tái)灣地區(qū)外,尚無(wú)明確法律條文規(guī)定實(shí)施;西方國(guó)家則制定了涉及國(guó)家財(cái)政支持、服務(wù)機(jī)構(gòu)及從業(yè)人員、臨終關(guān)懷服務(wù)對(duì)象等多方面較完善的臨終關(guān)懷法律法規(guī),保障了此項(xiàng)服務(wù)的科學(xué)發(fā)展。建議我國(guó)在遵循相關(guān)立法原則的前提下,明文規(guī)定臨終關(guān)懷各要素,同時(shí)建立、健全我國(guó)醫(yī)療保障制度,從根源上推動(dòng)國(guó)民對(duì)臨終關(guān)懷服務(wù)的理解和支持。
[Abstract]:By studying a large number of domestic and foreign hospice legislation policies and literature, this paper summarizes the current situation of the legislation, and probes into the establishment of laws, regulations and policies on hospice care in China in the future, in order to promote more scholars' attention. To promote the realization of hospice care legislation in China. Apart from Taiwan, legislation on hospice care in China has no clear legal provisions to implement. Western countries have formulated legislation involving state financial support, service agencies and employees. The more perfect laws and regulations of hospice care guarantee the scientific development of the service. It is suggested that under the premise of following the relevant legislative principles, China should explicitly stipulate the various elements of hospice care, establish and perfect the medical security system of our country, and promote the understanding and support of the people to the hospice care service from the root.
