搜索引擎競價排名法律規(guī)制研究

【摘要】:互聯(lián)網(wǎng)廣告影響著我們的生活。伴隨著計算機網(wǎng)絡的發(fā)展,現(xiàn)代人通過搜索獲得想要的內容,競價排名作為一種新型的搜索技術給我們的生活帶來了許多改變。搜索引擎商通過給廣告商提供競價排名服務,從而獲得巨大的利益。但是,近年來,以百度為代表的搜索引擎商,因為競價排名業(yè)務頻繁遭遇訴訟。因為競價排名是一把雙刃劍,帶來巨大商業(yè)利益的同時,也有著法律上的風險。2016年9月1日《互聯(lián)網(wǎng)廣告暫行管理辦法》的施行,明確規(guī)定了競價排名屬于廣告,這是我國首次在法律上定義競價排名。本論文從法律的視角著重闡述了搜索引擎競價排名的概念,還有相應的法律規(guī)制。我國目前關于競價排名的法律仍然不夠完善,對于競價排名的違法行為,也沒有相應具體的處罰措施。本文的核心在于描述如何完善競價排名的相關法律。本文分為五章,主要從概念界定、基本原理、法律制度上研究競價排名問題。第一章為緒論。主要介紹了有關競價排名的選題背景,國內外發(fā)展現(xiàn)狀,還有本論文的研究價值。由最近發(fā)生的“魏則西事件”和“美團外賣事件”為背景引出競價排名中出現(xiàn)的審查門檻低、相關部門監(jiān)管不嚴格的問題。通過對國內外研究現(xiàn)狀進行綜述,我們可以了解目前國內外關于搜索引擎競價排名的研究主要集中在討論競價排名的侵權問題。第二章是競價排名的法律分析。競價排名具有目標明確,廣告靈活性強,價格低廉的特征。本文還明確了競價排名在法律上的性質為廣告,競價排名應當和自然搜索明顯區(qū)分,所以它受到《廣告法》及相關法律法規(guī)規(guī)制,這對于全面了解競價排名有十分重要的意義。競價排名中主要有虛假關鍵詞、廣告主服務違法、商標侵權行為、點擊欺詐行為等違法行為。第三章為競價排名法律規(guī)制的路徑選擇和作用機制。這是通過競價排名在法律中的權利義務的配置來實現(xiàn)的。有關競價排名的法律規(guī)制分為《互聯(lián)網(wǎng)廣告管理暫行辦法》、《商標法》、《反不正當競爭法》等。規(guī)制競價排名的法律原則主要有誠實信用原則、真實性原則、過錯責任原則等。第四章為我國規(guī)制競價排名中存在的法律問題。主要包括法律主體模糊、競價排名的侵權責任問題、競價排名的實踐問題。明確了搜索引擎商如果對廣告主實施了幫助行為,那么搜索引擎商理應承擔間接侵權的責任。也指出了在法律救濟中競價排名法律糾紛管轄難、取證難、執(zhí)法難等突出的問題。第五章為完善我國競價排名法律規(guī)制的對策建議。主要從立法、執(zhí)法、司法、自身行業(yè)自律四個方面提出完善競價排名法律規(guī)制。明確提出完善競價排名法律規(guī)制的方法,不僅要貫徹《暫行辦法》的實施,同時還要盡快制定專門規(guī)制互聯(lián)網(wǎng)廣告的法律,來實現(xiàn)對競價排名違法問題的專門規(guī)制。加強對互聯(lián)網(wǎng)侵權的執(zhí)法力度,加強對工作人員的培訓,建立全國范圍的互聯(lián)網(wǎng)廣告監(jiān)管體系,加強對互聯(lián)網(wǎng)廣告審核和監(jiān)管,強化司法救濟,明確按照《暫行辦法》的規(guī)定規(guī)制競價排名。
[Abstract]:Internet ads affect our lives. With the development of computer network, modern people have obtained the desired content by searching, and the ranking of the bidding price has brought many changes to our life as a new search technology. The search engine has obtained great benefits by providing an advertiser with a bid ranking service. However, in recent years, Baidu is the representative of the search engine, because the ranking business of the bidding price frequently encounters the lawsuit. Since the ranking of the bidding price is a double-edged sword, it also has the legal risk. On September 1, 2016, the implementation of the provisional management method of the Internet advertisement clearly specifies that the non-competitive ranking belongs to the advertisement, which is the first legal definition of the competitive price ranking in China. From the perspective of law, this thesis focuses on the concept of search engine race ranking, and the corresponding legal regulation. At present, the law on the ranking of the non-competitive price is still not perfect, and there is no corresponding specific punishment measure for the illegal act of the ranking of the non-competitive price. The core of this paper is to describe how to improve the relevant laws of the ranking of the competitive price. This paper is divided into five chapters, mainly from the definition, the basic principle and the legal system. The first chapter is the introduction.
