【摘要】：隨著計(jì)算機(jī)和網(wǎng)絡(luò)技術(shù)的日益發(fā)展,尤其是“人肉搜索”引擎被廣泛運(yùn)用后,網(wǎng)絡(luò)環(huán)境下的個(gè)人隱私狀況已成為人們極為關(guān)切的問題。在網(wǎng)絡(luò)環(huán)境下,公眾知情權(quán)和監(jiān)督權(quán)的行使與個(gè)人隱私權(quán)的保障的立法平衡是一個(gè)難題。 目前我國網(wǎng)絡(luò)技術(shù)的發(fā)展，公民的言論自由得到了更大的發(fā)揮，同時(shí)這種自由也使得人們的隱私權(quán)受到威脅，尤其在網(wǎng)絡(luò)環(huán)境中更是如此。網(wǎng)絡(luò)隱私權(quán)是隱私權(quán)在網(wǎng)絡(luò)環(huán)境中的延伸，并非新型的隱私權(quán)。網(wǎng)絡(luò)隱私權(quán)的內(nèi)容包括可識(shí)別的個(gè)人信息、個(gè)人私生活和個(gè)人虛擬財(cái)產(chǎn)。由于立法的不成熟，我國在法律中對(duì)隱私權(quán)相關(guān)內(nèi)容規(guī)定的較為薄弱，在一定程度上影響了隱私權(quán)的保護(hù)，我國對(duì)網(wǎng)絡(luò)隱私權(quán)的保護(hù)還有較大的發(fā)展空間。論文在借鑒美國、歐盟等國家先進(jìn)經(jīng)驗(yàn)的基礎(chǔ)上，對(duì)我國立法、信息監(jiān)管、公民的權(quán)利意識(shí)和行業(yè)自律方面的制度提出建議。本文通過對(duì)具體案件的分析，以近幾年多發(fā)的"人肉搜索"事件折射出信息時(shí)代公民網(wǎng)絡(luò)隱私權(quán)遭受侵權(quán)為視角，系統(tǒng)地展開對(duì)公民網(wǎng)絡(luò)隱私權(quán)民法保護(hù)的系列問題的討論。對(duì)“人肉搜索”提出一個(gè)客觀的認(rèn)定標(biāo)準(zhǔn)，以利于司法實(shí)踐中正確認(rèn)識(shí)，有利于正確處理司法與輿論的關(guān)系，正確處理刑事司法與社會(huì)輿論之間的關(guān)系，是司法獨(dú)立進(jìn)而實(shí)現(xiàn)司法公正的基本要求。立足于我國當(dāng)前對(duì)公民網(wǎng)絡(luò)隱私權(quán)民法保護(hù)的現(xiàn)狀，，分析了其中存在缺乏一般規(guī)則和具體規(guī)則的規(guī)定的問題，并結(jié)合我國的立法現(xiàn)狀和實(shí)際需要，試圖構(gòu)建我國公民網(wǎng)絡(luò)隱私權(quán)民法保護(hù)體系。 基于上述，從多個(gè)角度對(duì)構(gòu)建我國網(wǎng)絡(luò)隱私權(quán)保護(hù)完整機(jī)制的多元化建議。網(wǎng)絡(luò)隱私權(quán)的保護(hù)是一項(xiàng)復(fù)雜而又艱巨的系統(tǒng)工程，它需要全社會(huì)的通力合作，這樣才能使我國網(wǎng)絡(luò)隱私權(quán)的保護(hù)收到實(shí)效。只有這樣，我國公民的人格才具有完整性、徹底性；只有人們的隱私權(quán)得到充分尊重和保護(hù)，使網(wǎng)絡(luò)發(fā)展成為信息交流的安全的工具，才能更好地實(shí)現(xiàn)整個(gè)社會(huì)人際關(guān)系的和諧。
[Abstract]:With the development of computer and network technology, especially after the "human flesh search" engine is widely used, the personal privacy in the network environment has become a problem of great concern. In the network environment, the legislative balance between the exercise of public right to know and the right of supervision and the protection of personal privacy is a difficult problem. At present, with the development of network technology in our country, citizens' freedom of speech has been brought into play, at the same time, this freedom also threatens people's privacy, especially in the network environment. Network privacy is the extension of privacy in the network environment, not a new type of privacy. The content of network privacy includes identifiable personal information, personal private life and personal virtual property. Due to the immaturity of legislation, the relative content of privacy is relatively weak in the law of our country, which to some extent affects the protection of the right of privacy, and the protection of the right of privacy on the Internet still has a great space for development in our country. On the basis of drawing lessons from the advanced experiences of the United States and the European Union, this paper puts forward some suggestions on our country's legislation, information supervision, citizen's right consciousness and industry self-discipline. Based on the analysis of specific cases, this paper systematically discusses a series of issues of civil law protection of citizens' network privacy, from the perspective of "human flesh search" events in recent years, reflecting the infringement of citizens' network privacy rights in the information age. This paper puts forward an objective criterion of "human flesh search" in order to benefit the correct understanding in judicial practice, correctly handle the relationship between judicature and public opinion, and correctly handle the relationship between criminal judicature and public opinion. It is the basic requirement of judicial independence and judicial justice. Based on the current situation of civil law protection of citizens' network privacy in our country, this paper analyzes the problems of lacking general rules and specific rules, and combines the current legislative situation and actual needs of our country. This paper attempts to construct the civil law protection system of citizens' right to privacy on the Internet. Based on the above, this paper proposes to construct the complete mechanism of network privacy protection in China from many angles. The protection of network privacy is a complex and arduous system engineering, it needs the cooperation of the whole society, in order to make the protection of network privacy in our country receive the actual effect. Only in this way can the personality of our citizens have integrity and thoroughness. Only when people's right to privacy is fully respected and protected can the network develop into a secure tool for information exchange. In order to achieve better interpersonal harmony in the whole society.
