【摘要】：隨著互聯(lián)網(wǎng)技術(shù)的高速發(fā)展,搜索引擎已經(jīng)成為網(wǎng)民查詢資料、獲取信息不可或缺的工具,因此,對于搜索引擎提供者在互聯(lián)網(wǎng)信息傳播過程中該承擔(dān)何種責(zé)任受到眾多關(guān)注。本文通過結(jié)合兩例具有典型意義的案例,對搜索引擎提供者在現(xiàn)行中國法律體系下所面臨的版權(quán)責(zé)任展開詳細研究,并通過與美國相關(guān)立法的比較,深入探討了搜索引擎提供者版權(quán)責(zé)任的限制問題,進而尋求搜索引擎提供者和版權(quán)人的利益平衡之途徑。
[Abstract]:With the rapid development of Internet technology, search engine has become an indispensable tool for Internet users to query information and obtain information. Therefore, much attention has been paid to the responsibility of search engine providers in the process of Internet information dissemination. By combining two typical cases, this paper makes a detailed study on the copyright liability faced by search engine providers under the current Chinese legal system, and compares it with the relevant legislation in the United States. This paper probes into the limitation of the copyright liability of search engine provider, and then seeks the way to balance the interests of search engine provider and copyright owner.
