【摘要】：隨著網(wǎng)絡(luò)信息技術(shù)的創(chuàng)新與進步,我們的社會獲得了迅速發(fā)展,社會生活已經(jīng)進入了信息時代,信息技術(shù)的進步引發(fā)了通信方式的變革,給人們帶來了極大的便利,網(wǎng)絡(luò)平臺的不斷出現(xiàn)豐富了形式多樣的網(wǎng)絡(luò)活動。數(shù)據(jù)庫龐大的搜索引擎,方便溝通交流的社交軟件,精彩紛呈的網(wǎng)絡(luò)游戲等都是網(wǎng)絡(luò)時代的產(chǎn)物。在移動通信技術(shù)高度發(fā)達的今天,尤其是手機4G網(wǎng)絡(luò)的出現(xiàn),越來越多的消費者對網(wǎng)絡(luò)的依賴性也逐漸增強,突出表現(xiàn)之一就是移動運營商推出的數(shù)據(jù)流量套餐一直受消費者的青睞,流量用戶十分廣泛�？茖W(xué)技術(shù)與經(jīng)濟是息息相關(guān)的,計算機網(wǎng)絡(luò)信息技術(shù)發(fā)展,帶來了巨大的經(jīng)濟利益,流量、電子賬戶等虛擬財產(chǎn)作為新型的財產(chǎn)利益形態(tài)逐漸出現(xiàn)。數(shù)字化、虛擬化網(wǎng)絡(luò)技術(shù)的廣泛應(yīng)用在提高生活質(zhì)量的同時也出現(xiàn)了很多流量侵權(quán)問題,引發(fā)了一系列有別于傳統(tǒng)財產(chǎn)的矛盾糾紛,例如出現(xiàn)域名搶注、軟件外掛、攔截干擾、惡意點擊、流量劫持等領(lǐng)域的侵權(quán)行為。除此之外關(guān)于電子信箱、虛擬身份、網(wǎng)游中的貨幣、裝備等網(wǎng)絡(luò)財產(chǎn)爭端也屢見不鮮。由于現(xiàn)在的立法中關(guān)于流量財產(chǎn)權(quán)的法律法規(guī)并不是很完善,在處理流量等財產(chǎn)糾紛時,略顯吃力。在3月15號第十二屆全國人民代表大會第五次會議審議通過的《中華人民共和國民法總則》(審議通過稿)第一百二十七條規(guī)定:法律對數(shù)據(jù)、網(wǎng)絡(luò)虛擬財產(chǎn)的保護有規(guī)定的,依照其規(guī)定。明確了對于網(wǎng)絡(luò)虛擬財產(chǎn)的保護,這可以看出未來對流量財產(chǎn)權(quán)等虛擬財產(chǎn)權(quán)立法保護的趨勢,對于解決司法實踐中的虛擬財產(chǎn)爭奪問題具有重要意義。“互聯(lián)網(wǎng)+”時代下,經(jīng)濟利益的保護需要法律保護的與時俱進,虛擬財產(chǎn)權(quán)的立法保護為網(wǎng)絡(luò)經(jīng)濟的發(fā)展奠定了一定的法律基礎(chǔ)。文章內(nèi)容分為四個部分。第一部分是文章的引言,在這部分中主要介紹了本文的研究背景,關(guān)于流量財產(chǎn)權(quán)與虛擬財產(chǎn)權(quán)保護的國內(nèi)外研究現(xiàn)狀。關(guān)于流量財產(chǎn)權(quán)的研究內(nèi)容少之又少,只能依據(jù)少量的參考資料來思考問題,關(guān)于虛擬財產(chǎn)權(quán)保護的研究比較成熟。流量與虛擬財產(chǎn)在性質(zhì)上具有一定的相同點或相似點,這也是我將流量作為一種虛擬財產(chǎn)來研究的思路來源。另外介紹了思考問題的研究方法和創(chuàng)新之處。關(guān)于流量財產(chǎn)權(quán)話題的研究應(yīng)該就是最大的“創(chuàng)新”了。在之前,對于流量財產(chǎn)權(quán)的討論較少。借鑒虛擬財產(chǎn)權(quán)的保護思路來探討流量財產(chǎn)權(quán)的保護,也有一定的思路創(chuàng)新。在第二部分中,從流量與虛擬財產(chǎn)的性質(zhì)出發(fā),對其概念和特征進行了具體的分析,得出了可以將流量作為一種虛擬財產(chǎn)研究的結(jié)論。從流量與虛擬財產(chǎn)的共性推理出流量即為一種虛擬財產(chǎn)的合理性。這對于解決現(xiàn)在流量財產(chǎn)權(quán)的法律空缺問題是一個比較高效、便捷的思路。然后對流量財產(chǎn)權(quán)的定性進行了分析。首先對流量的法律屬性進行了歸屬性的分析。流量就是網(wǎng)絡(luò)平臺的利益存在,具有財產(chǎn)的特性,也符合法律上的財產(chǎn)權(quán)的屬性,這是對流量進行立法保護的理論基礎(chǔ)。進而提出了新型財產(chǎn)權(quán)的流量財產(chǎn)權(quán)定位思路。嚴格的從理論上分析,新型財產(chǎn)權(quán)的角度更為科學(xué)嚴謹。文章第三部分主要內(nèi)容是流量侵權(quán)行為具體的表現(xiàn)并分析了其產(chǎn)生的原因。正是這些問題的存在讓關(guān)于流量財產(chǎn)權(quán)保護的立法變得必要而緊迫。在第四部分中,基于上文的分析探討,針對我國流量財產(chǎn)權(quán)保護的問題,提出了在日后法律發(fā)展和完善的路上可以考慮的立法模式,以及在司法競合狀態(tài)下,流量財產(chǎn)權(quán)保護可考慮和借鑒的路徑。我國的《中華人民共和國民法總則》(審議通過稿)第一百二十七條規(guī)定:法律對數(shù)據(jù)、網(wǎng)絡(luò)虛擬財產(chǎn)的保護有規(guī)定的,依照其規(guī)定。這在目前是彌補法律缺失最為高效、便捷的做法。同時也表現(xiàn)出了未來將作為特別法立法保護的趨勢。但在法律結(jié)構(gòu)日益完善,法律內(nèi)容愈發(fā)具體的未來,我認為為流量等虛擬財產(chǎn)設(shè)立一種新型財產(chǎn)權(quán)更為科學(xué),而且對日后可能出現(xiàn)的類似屬性的虛擬化事物更具有包容性。
