【摘要】：針對(duì)我國(guó)面臨的水資源、水災(zāi)害、水環(huán)境、水生態(tài)等水問(wèn)題,應(yīng)用生態(tài)承載力所包含的生態(tài)彈性力、資源承載力和環(huán)境承載力三要素,結(jié)合水生態(tài)文明的基本特點(diǎn),建立該制度體系的邏輯框架。從涉水空間有序管理、水資源合理利用與監(jiān)管、水環(huán)境和水生態(tài)有效管控、評(píng)價(jià)和考核4個(gè)方面對(duì)相關(guān)制度進(jìn)行分類(lèi),構(gòu)建包含36項(xiàng)子制度的水生態(tài)文明制度體系框架。通過(guò)統(tǒng)計(jì)分析,指出存在的基本問(wèn)題和主要應(yīng)對(duì)思路:(1)對(duì)于在試點(diǎn)試驗(yàn)過(guò)程中出現(xiàn)問(wèn)題的制度,應(yīng)針對(duì)問(wèn)題,制定解決方案,積累經(jīng)驗(yàn),完善制度安排;(2)對(duì)于在法律中已有原則性規(guī)定,但亟待細(xì)化的制度,應(yīng)繼續(xù)通過(guò)試點(diǎn)工作,總結(jié)經(jīng)驗(yàn),細(xì)化已有法律法規(guī);(3)對(duì)于與現(xiàn)行法律法規(guī)和體制存在矛盾、沖突的制度,若開(kāi)展試驗(yàn)工作,需向國(guó)家有關(guān)機(jī)構(gòu)提請(qǐng)?jiān)谠圏c(diǎn)范圍內(nèi)暫時(shí)調(diào)整相關(guān)法律法規(guī)和體制。
[Abstract]:Aiming at the problems of water resources, water disasters, water environment and water ecology in China, applying the three elements of ecological carrying capacity, including ecological elasticity, resource carrying capacity and environmental carrying capacity, combined with the basic characteristics of water ecological civilization,Establish the logical framework of the system.This paper classifies the relevant systems from four aspects: orderly management of water space, rational utilization and supervision of water resources, effective control of water environment and water ecology, evaluation and assessment, and constructs the system framework of water ecological civilization system including 36 sub-systems.Through statistical analysis, it is pointed out that the existing basic problems and the main countermeasures: 1) for the system of problems in the process of the pilot trial, we should formulate solutions and accumulate experience in view of the problems.To perfect the system arrangement for the system that has been stipulated in principle in the law, but it is urgent to refine the system, we should continue to sum up the experience through the pilot work, and refine the existing laws and regulations.) there are contradictions and conflicts with the existing laws and regulations and the system that conflicts with the existing laws, regulations and systems.If the pilot work is carried out, the relevant laws and regulations should be temporarily adjusted to the relevant national institutions.
