【摘要】：湖南水資源存在時(shí)空分布不均、污染嚴(yán)重、利用率低的現(xiàn)象,這導(dǎo)致湖南省用水問(wèn)題緊張。水權(quán)交易在我國(guó)一些地區(qū)成功的運(yùn)用并已經(jīng)解決了當(dāng)?shù)氐挠盟C(jī)。因此對(duì)湖南水權(quán)交易制度的研究,既有利于優(yōu)化我省水資源配置,解決水資源季節(jié)性短缺問(wèn)題,也能為我國(guó)水權(quán)交易制度的構(gòu)建提供理論和實(shí)踐基礎(chǔ)。湖南建立水權(quán)交易制度有其自身的必要性和可行性。從湖南水資源現(xiàn)狀來(lái)看,湖南地區(qū)水資源存在時(shí)空分布不均、污染嚴(yán)重、利用效率低等問(wèn)題,使得湖南建立水權(quán)交易制度成為必要。湖南水權(quán)交易制度的建立有其可行性。首先,我國(guó)的水權(quán)交易理論趨于成熟,如水資源所有權(quán)和其使用權(quán)相分離的理論基礎(chǔ);其次,國(guó)內(nèi)外有關(guān)水權(quán)交易的實(shí)踐有很多可借鑒之處:如澳大利亞、智利等國(guó)家擁有科學(xué)完善的初始水權(quán)分配制度,我國(guó)東陽(yáng)、義烏等地水權(quán)交易的實(shí)踐也為湖南建立水權(quán)交易市場(chǎng)提供了寶貴的經(jīng)驗(yàn);最后,相關(guān)法律法規(guī)為湖南水權(quán)交易制度的建立提供了法律保障,如《水利部關(guān)于水權(quán)轉(zhuǎn)讓的若干意見(jiàn)》和《湖南省湘江保護(hù)條例》等法律文件。當(dāng)然,湖南水權(quán)交易制度的建立仍面臨很大挑戰(zhàn),湖南有關(guān)水權(quán)交易立法的缺乏、湖南有關(guān)水權(quán)交易相關(guān)配套制度尚未建立都是制約湖南水權(quán)交易制度建立的重要因素。針對(duì)這些問(wèn)題,要建立湖南水權(quán)交易制度,首先要制定湖南水權(quán)交易的相關(guān)立法,如《湖南省水權(quán)交易暫行辦法》、《湖南省水量分配暫行辦法》和《湖南省水價(jià)管理暫行辦法》等,用法律來(lái)保障湖南水權(quán)交易制度的實(shí)踐應(yīng)用;其次是要建立規(guī)范的水權(quán)分配及交易運(yùn)行制度。其中對(duì)初始水權(quán)的分配制度需要從明確水權(quán)分配原則及保障生態(tài)用水等方面來(lái)完善,對(duì)湖南水權(quán)交易運(yùn)行機(jī)制需要從其運(yùn)行、水價(jià)等方面來(lái)健全;再次是搭建相關(guān)的管理機(jī)構(gòu),捋清水資源管理機(jī)構(gòu)的職責(zé),建立湖南水權(quán)交易中心,對(duì)湖南水權(quán)交易進(jìn)行統(tǒng)一的監(jiān)督和管理,從而建立科學(xué)完善的湖南水權(quán)交易制度。
[Abstract]:There is a phenomenon of uneven distribution of water resources in time and space, serious pollution and low utilization rate in Hunan Province. This led to the tension of water use in Hunan Province. Water rights trading in some areas of China has been successfully used and has solved the local water crisis. Therefore, the study of Hunan water rights trading system. It is beneficial to optimize the allocation of water resources in our province and solve the problem of seasonal shortage of water resources. It can also provide theoretical and practical basis for the construction of water right trading system in China. Hunan has its own necessity and feasibility to establish water right trading system. There are some problems in Hunan water resources, such as uneven distribution of water resources, serious pollution and low utilization efficiency, which make it necessary to establish water rights trading system in Hunan. First of all, the establishment of water rights trading system in Hunan has its feasibility. The theory of water right trading in China tends to be mature, such as the theoretical basis of the separation of water resources ownership and its right of use; Secondly, the practice of water rights trading at home and abroad has a lot of lessons: for example, Australia, Chile and other countries have a scientific and perfect initial water rights distribution system, Dongyang, China. The practice of water right trading in Yiwu and other places also provides valuable experience for establishing water right trading market in Hunan. Finally, the relevant laws and regulations for the establishment of Hunan water rights trading system to provide legal protection, such as the Ministry of Water Resources on the transfer of water rights, and Hunan Province Xiangjiang protection regulations and other legal documents. Of course. The establishment of water right trading system in Hunan is still facing great challenges, and the lack of legislation on water right trading in Hunan. It is an important factor to restrict the establishment of water right trading system in Hunan province. In view of these problems, it is necessary to establish the water right trading system in Hunan. First of all, it is necessary to formulate relevant legislation on water rights trading in Hunan Province, such as the interim measures on Water right Trading in Hunan Province, the interim measures on Water Distribution in Hunan Province, and the interim measures on Water Price Management in Hunan Province. Using the law to protect the practical application of Hunan water right trading system; The second is to establish a standardized water rights distribution and trading operation system. The distribution system of the initial water rights needs to be improved from the aspects of clear water rights distribution principles and protection of ecological water use. The operation mechanism of water right transaction in Hunan should be perfected from its operation and water price. The third is to set up the relevant management agencies, stroking the duties of the water resource management agencies, establishing the Hunan Water Rights Trading Center, and carrying on the unified supervision and management to the Hunan water rights trading. So as to establish a scientific and perfect water right trading system in Hunan.
