【摘要】：伴隨著建設(shè)工程的快速發(fā)展,建設(shè)工程項(xiàng)目的管理水平也得到了相應(yīng)的發(fā)展與提高,一個(gè)重要的表現(xiàn)在于招投標(biāo)制度的實(shí)施和不斷的完善。我國自從20世紀(jì)80年代初在建設(shè)領(lǐng)域引進(jìn)招投標(biāo)制度以來,對(duì)推動(dòng)建設(shè)工程市場規(guī)范化、法制化起到了重要的作用。由于我國市場經(jīng)濟(jì)體制的不完善,利益約束機(jī)制的不健全,市場誠信體制建設(shè)尚不完善等,導(dǎo)致了在工程建設(shè)領(lǐng)域里出現(xiàn)了一些不規(guī)范的現(xiàn)象,如“圍標(biāo)串標(biāo)”等行為,違背了招投標(biāo)市場的“公平、公正和公開”的原則,嚴(yán)重?cái)_亂和破壞了工程建設(shè)市場的健康有序的發(fā)展。 論文首先針對(duì)招投標(biāo)過程中圍標(biāo)串標(biāo)行為的產(chǎn)生的現(xiàn)象,分別從組織行為學(xué)和經(jīng)濟(jì)學(xué)分析了體制根源和企業(yè)行為表現(xiàn)(如經(jīng)濟(jì)根源)進(jìn)行了詳細(xì)的分析。其次,引入博弈論和管理學(xué)的相關(guān)理論來分析和研究圍標(biāo)串標(biāo)行為的發(fā)生機(jī)理和博弈關(guān)系,建立了圍標(biāo)串標(biāo)的博弈模型。針對(duì)招投標(biāo)過程中圍標(biāo)串標(biāo)博弈的結(jié)果及其特點(diǎn),給出了相應(yīng)的防范措施和建議。最后,論文列舉了相應(yīng)的案例對(duì)圍標(biāo)串標(biāo)進(jìn)行分析,結(jié)合圍標(biāo)串標(biāo)行為博弈結(jié)果和圍標(biāo)串標(biāo)行為產(chǎn)生的體制、企業(yè)行為等根源,系統(tǒng)地給出圍標(biāo)串標(biāo)行為預(yù)防、應(yīng)對(duì)和懲罰相應(yīng)的措施。這對(duì)建設(shè)工程及其它領(lǐng)域在規(guī)避圍標(biāo)串標(biāo)行為具有一定的借鑒意義和參考價(jià)值。
[Abstract]:With the rapid development of construction projects, the management level of construction projects has also been developed and improved accordingly. An important manifestation is the implementation and continuous improvement of the bidding system. Since the introduction of the bidding system in the construction field in the early 1980s, China has promoted the standardization of the construction engineering market. The legalization has played an important role. Due to the imperfect market economy system, the imperfect interest restraint mechanism and the imperfect market credit system construction, there have been some irregularities in the field of engineering construction. For example, the behavior of "surrounding bid string and bid" violates the principle of "fairness, justice and openness" of bidding market, and seriously disturbs and destroys the healthy and orderly development of engineering construction market. In this paper, firstly, the author analyzes the system root and enterprise behavior (such as economic origin) from the perspective of organizational behavior and economics in order to analyze the phenomenon of the girdle bidding behavior in the process of bidding. Secondly, the paper analyzes the behavior of enterprises in detail from the perspective of organizational behavior and economics. This paper introduces the game theory and the management theory to analyze and study the mechanism and the game relation of the behavior of the girdle bidding, and sets up the game model of the gird string bidding, aiming at the result and characteristics of the game in the bidding process. Finally, the paper enumerates the corresponding cases to analyze the surrounding label, combined with the game result of the behavior of the girdle string, the system of the behavior of the girdle string, the origin of the enterprise behavior, and so on. The corresponding measures of prevention, response and punishment are given systematically, which have certain reference significance and reference value for construction engineering and other fields in circumventing the behavior of circumscribed marking.
