【摘要】：當(dāng)前我國(guó)工業(yè)化、城鎮(zhèn)化進(jìn)程加速,經(jīng)濟(jì)總量仍保持高速增長(zhǎng),能源資源消耗逐步增加,致使環(huán)境污染狀況堪憂,環(huán)境形勢(shì)嚴(yán)峻。傳統(tǒng)的政府環(huán)境治理模式已遠(yuǎn)遠(yuǎn)不足以應(yīng)對(duì)人類面臨的環(huán)境問題挑戰(zhàn),在環(huán)境保護(hù)過程中發(fā)揮公眾力量成為一種必然的選擇。目前中國(guó)政府和民眾已經(jīng)越來(lái)越深刻的感受到公眾參與在環(huán)境保護(hù)中的重大意義。公眾參與環(huán)境保護(hù)在中國(guó)已經(jīng)有了一定的發(fā)展,但是仍然存在諸多問題,現(xiàn)階段,人們環(huán)保意識(shí)的覺醒和政府轉(zhuǎn)型的現(xiàn)狀為公眾參與環(huán)境保護(hù)的推進(jìn)提供了重要契機(jī),也使得這一方面的理論研究成為學(xué)者的急迫任務(wù)。本論文正是要在對(duì)諸多相關(guān)理論研究的基礎(chǔ)上,結(jié)合具體的實(shí)踐和先進(jìn)經(jīng)驗(yàn),探究完善我國(guó)公眾參與環(huán)境保護(hù)的對(duì)策方法。論文以“公眾參與環(huán)境保護(hù)”為內(nèi)容進(jìn)行研究,通過對(duì)相關(guān)理論和國(guó)內(nèi)外研究現(xiàn)狀的分析,為公眾參與環(huán)境保護(hù)的主體、概念、范圍、參與尋找理論依據(jù),同時(shí)總結(jié)國(guó)內(nèi)外關(guān)于公眾參與環(huán)境保護(hù)的理論實(shí)踐。進(jìn)而對(duì)我國(guó)公眾參與環(huán)境保護(hù)的立法、意識(shí)、制度、主體、程度和途徑等方面的歷史發(fā)展和現(xiàn)狀進(jìn)行分析,指出我國(guó)現(xiàn)階段在公眾參與環(huán)境保護(hù)領(lǐng)域的問題和不足,比如缺乏相應(yīng)的法律制度保障、環(huán)境保護(hù)參與水平低、環(huán)境決策參與程度低、參與態(tài)度不夠理性、環(huán)保非政府組織作用有限等。本文以網(wǎng)傳濰坊企業(yè)“深井排污”污染地下水環(huán)保事件案例和山東公眾參與環(huán)境保護(hù)一些嘗試為例,對(duì)現(xiàn)存問題進(jìn)行深層原因分析和實(shí)地調(diào)研。提出針對(duì)中國(guó)現(xiàn)實(shí)狀況的推進(jìn)公眾參與存在環(huán)境保護(hù)的對(duì)策,主要從完善公眾參與機(jī)制、重新樹立政府公信、推進(jìn)環(huán)境信息公開、激發(fā)公眾參與環(huán)境保護(hù)熱情、支持環(huán)保NGO發(fā)展等方面進(jìn)行討論,同時(shí)研究新環(huán)境形勢(shì)下的多元化途徑,實(shí)現(xiàn)信息對(duì)稱,提高公眾參與環(huán)境保護(hù)主動(dòng)性,切實(shí)保障公眾參與環(huán)境保護(hù)目標(biāo)的實(shí)現(xiàn)。
[Abstract]:At present, the industrialization of our country, the acceleration of the process of urbanization, the rapid growth of the total economic volume and the gradual increase in the consumption of energy and resources cause the environmental pollution situation to be worrisome and the environmental situation to be grim. The traditional government environmental governance model is far from enough to deal with the environmental challenges faced by human beings. It has become an inevitable choice to exert public power in the process of environmental protection. At present, the Chinese government and people have increasingly felt the great significance of public participation in environmental protection. Public participation in environmental protection has developed in China, but there are still many problems. At this stage, the awakening of people's environmental awareness and the current situation of government transformation provide an important opportunity for the public to participate in the promotion of environmental protection. It also makes the theoretical research in this area become the urgent task of scholars. On the basis of the research of many related theories, this paper aims to explore and perfect the countermeasures of public participation in environmental protection in our country by combining the concrete practice and advanced experience. This paper takes "public participation in environmental protection" as the research content, through the analysis of the relevant theory and the domestic and foreign research present situation, for the public participation in the environmental protection subject, the concept, the scope, the participation seeks the theoretical basis, At the same time, it summarizes the theory and practice of public participation in environmental protection at home and abroad. Then it analyzes the historical development and present situation of the legislation, consciousness, system, subject, degree and approach of public participation in environmental protection in China, and points out the problems and deficiencies in the field of public participation in environmental protection in our country at the present stage. For example, lack of corresponding legal system protection, low level of environmental protection participation, low level of participation in environmental decision-making, irrational attitude of participation, limited role of environmental non-governmental organizations and so on. Taking the case of "deep well sewage" pollution of groundwater pollution in Weifang enterprise as an example and some attempts of public participation in environmental protection in Shandong Province as examples, this paper makes a deep cause analysis and field investigation on the existing problems. This paper puts forward some countermeasures to promote the existence of environmental protection for public participation in China, mainly from perfecting the mechanism of public participation, re-establishing the government's public trust, promoting the disclosure of environmental information, and arousing the enthusiasm of public participation in environmental protection. In order to support the development of environmental protection NGO and other aspects, this paper studies the diversified approaches under the new environment situation, realizes information symmetry, enhances the initiative of public participation in environmental protection, and ensures the realization of the goal of public participation in environmental protection.
