【摘要】：隨著中國(guó)改革開放的不斷深入和經(jīng)濟(jì)社會(huì)的持續(xù)發(fā)展,生態(tài)問(wèn)題和環(huán)境惡化成為中國(guó)當(dāng)前面臨的最嚴(yán)峻問(wèn)題。中國(guó)要實(shí)現(xiàn)經(jīng)濟(jì)社會(huì)的持續(xù)健康高速發(fā)展,必須正視并著手解決日益嚴(yán)重的生態(tài)環(huán)境惡化問(wèn)題,尤其是自然資源的退化、城市農(nóng)村嚴(yán)重的污染以及不可再生能源的日益匱乏等,都在嚴(yán)重影響社會(huì)和諧安定與中國(guó)夢(mèng)的最終買現(xiàn)。面對(duì)這種態(tài)勢(shì),黨的十七大報(bào)告中提出生態(tài)文明建設(shè)的重要戰(zhàn)略,黨的十八大在十七大的基礎(chǔ)上再次提出生態(tài)文明,并將其提升到關(guān)系人民福祉、關(guān)乎民族未來(lái)的突出地位。在十八大報(bào)告中,胡錦濤同志著重強(qiáng)調(diào)必須加緊加強(qiáng)生態(tài)文明制度建設(shè),以“五位一體”總布局其一的生態(tài)文明建設(shè)為總體框架,以完備、科學(xué)的制度為保障,不斷推進(jìn)中國(guó)生態(tài)文明的健康持續(xù)發(fā)展。本論文嘗試基于制度變遷視角對(duì)當(dāng)代中國(guó)生態(tài)文明制度建設(shè)進(jìn)行研究,試就生態(tài)文明制度建設(shè)的概述、我國(guó)生態(tài)文明制度變遷進(jìn)程、取得的成就、存在的主要問(wèn)題及生態(tài)文明制度建設(shè)創(chuàng)新做一個(gè)粗淺的分析和研究設(shè)想,積極探索適合我國(guó)國(guó)情的生態(tài)文明制度建設(shè)的途徑。本論文共分為五個(gè)部分。第一章是緒論,重點(diǎn)闡述本文的研究背景、研究目的與意義、國(guó)內(nèi)外研究現(xiàn)狀、研究方法以及本文的創(chuàng)新點(diǎn)。第二章對(duì)生態(tài)文明制度的相關(guān)理論進(jìn)行了論述,包括制度的內(nèi)涵、結(jié)構(gòu)、功能生態(tài)文明制度的內(nèi)涵、類型、特點(diǎn)與功能以及制度變遷理論概述。第三章對(duì)我國(guó)生態(tài)文明制度變遷進(jìn)程進(jìn)行了梳理,從我國(guó)生態(tài)文明制度建設(shè)的萌芽和起步階段,到形成和完善階段,再到成熟和推進(jìn)階段,接下來(lái)評(píng)價(jià)和分析中國(guó)當(dāng)前有關(guān)生態(tài)保護(hù)和建設(shè)的制度,一方面肯定和支持當(dāng)前取得的相關(guān)制度建設(shè)成績(jī),另一方面也揭露當(dāng)前中國(guó)存在著的關(guān)于環(huán)境制度建設(shè)的各種問(wèn)題。第四章里結(jié)合生態(tài)文明制度建設(shè)的國(guó)際經(jīng)驗(yàn),從不同的視角嘗試提出了我國(guó)生態(tài)文明制度建設(shè)的構(gòu)想。在這一章中重點(diǎn)闡述基于強(qiáng)制性變遷的生態(tài)文明制度建設(shè)的構(gòu)想,在國(guó)家層面需對(duì)生態(tài)文明制度的建設(shè)進(jìn)行指導(dǎo),同時(shí)提出國(guó)家強(qiáng)制力對(duì)于制度體系建設(shè)的重要作用,也提到引導(dǎo)公眾參與建設(shè)生態(tài)文明的問(wèn)題；基于誘致性變遷的生態(tài)文明制度建設(shè)的構(gòu)想主要提出了加強(qiáng)生態(tài)文明教育宣傳、倡導(dǎo)綠色低碳生活方式�；诒Ｕ吓c執(zhí)行機(jī)制的生態(tài)文明制度建設(shè)的構(gòu)想主要包含建立和完善生態(tài)文明考核評(píng)價(jià)制度、落實(shí)環(huán)境保護(hù)的行政執(zhí)法、盡快展開制度建設(shè)的試點(diǎn)工程。最后是結(jié)語(yǔ)。
[Abstract]:With the deepening of China's reform and opening up and the sustained development of the economy and society, ecological problems and environmental deterioration have become the most serious problems facing China at present. It is important to address and address the growing deterioration of the ecological environment, in particular the degradation of natural resources, the serious pollution in urban and rural areas and the increasing scarcity of non-renewable energy, Both are seriously affecting social harmony and stability and Chinese Dream's final purchase. In the face of this situation, the report of the 17th National Congress of the Party put forward an important strategy for the construction of ecological civilization, and the 18th National Congress of the Party once again proposed ecological civilization on the basis of the 17th National Congress of the Communist Party of China. In the report of the 18th National Congress, Comrade Hu Jintao emphatically stressed the need to intensify the construction of the ecological civilization system. Taking the overall layout of "five in one" as the overall framework for the construction of ecological civilization, and taking a complete and scientific system as the guarantee, This paper tries to study the system construction of ecological civilization in contemporary China based on the perspective of institutional change, and tries to summarize the system construction of ecological civilization, and the process of institutional change of ecological civilization in China. The achievements, the main problems and the innovation of the ecological civilization system, This paper is divided into five parts. The first chapter is the introduction, focusing on the research background, research purpose and significance, domestic and foreign research status. The second chapter discusses the relevant theories of ecological civilization system, including the connotation, structure, function, connotation and type of ecological civilization system. The third chapter combs the process of the institutional change of ecological civilization in China, from the budding and starting stage of the construction of the ecological civilization system in our country, to the stage of formation and perfection, and then to the stage of maturity and promotion. Next, we will evaluate and analyze the current system of ecological protection and construction in China. On the one hand, we will affirm and support the achievements of the current relevant system construction. On the other hand, it also reveals all kinds of problems existing in China concerning the construction of environmental institutions. Chapter IV combines the international experience of the construction of ecological civilization institutions. This paper tries to put forward the conception of the construction of ecological civilization system in China from different angles of view. In this chapter, the conception of the construction of ecological civilization system based on mandatory changes is expounded, and the construction of ecological civilization system should be guided at the national level. At the same time, the paper points out the important role of national coercive power in the construction of system, and also points out the problem of guiding the public to participate in the construction of ecological civilization; the conception of ecological civilization system construction based on induced changes mainly puts forward the idea of strengthening the education and propaganda of ecological civilization. The concept of constructing ecological civilization system based on the mechanism of protection and implementation mainly includes establishing and perfecting the evaluation system of ecological civilization and implementing the administrative law enforcement of environmental protection. Start as soon as possible the pilot project of system construction.
