【摘要】：2013年以來(lái),全國(guó)先后出現(xiàn)了十余次大范圍的霧霾天氣,霧霾天數(shù)是50多年以來(lái)最多的一年,對(duì)群眾健康、交通安全、經(jīng)濟(jì)發(fā)展等方面都造成了嚴(yán)重影響,霧霾的治理迫在眉睫,但是我國(guó)的霧霾治理在理論上和實(shí)踐上的成果都無(wú)法滿足目前霧霾治理的需求。行政問責(zé)是一種通過對(duì)問責(zé)客體的問責(zé)行為進(jìn)行責(zé)任追究,從而實(shí)現(xiàn)規(guī)范問責(zé)客體的行為,矯正問責(zé)行為的功能的機(jī)制。在我國(guó)霧霾的治理過程中引入行政問責(zé)機(jī)制可以起到督促矯正規(guī)范的作用,同時(shí)也有利用樹立責(zé)任政府的形象。在環(huán)境保護(hù)部和各級(jí)政府的努力下,多個(gè)城市已經(jīng)針對(duì)自己的情況提出并實(shí)施了霧霾天氣的治理措施,成果不一,但總體來(lái)說(shuō)作用不甚明顯。2013年3月環(huán)境保護(hù)部提出通過評(píng)估考核、結(jié)果公開的方式來(lái)實(shí)現(xiàn)大氣污染的行政問責(zé),部分城市踐行,通過將大氣污染防治成果納入績(jī)效考中來(lái)實(shí)現(xiàn)問責(zé),但是在霧霾天氣治理行政問責(zé)的實(shí)際操作過程中卻出現(xiàn)了由于行政問責(zé)客體、問責(zé)適用的責(zé)任體系以及問責(zé)的責(zé)任結(jié)果實(shí)現(xiàn)等要素出現(xiàn)偏差導(dǎo)致行政問責(zé)的功能異化的現(xiàn)象。本文首先從我國(guó)霧霾治理、我國(guó)霧霾治理行政問責(zé)以及我國(guó)霧霾治理行政問責(zé)功能的發(fā)揮三個(gè)層面進(jìn)行應(yīng)然和實(shí)然情況的分析。然后通過對(duì)比應(yīng)然和實(shí)然情況,提出三個(gè)行政問責(zé)要素偏差導(dǎo)致功能異化的現(xiàn)象,通過對(duì)異化現(xiàn)象的描述、原因追究、作用機(jī)制以及矯正措施等方面進(jìn)行研究,在新的環(huán)境即霧霾治理環(huán)境以新的角度對(duì)行政問責(zé)功能發(fā)揮進(jìn)行研究,豐富我國(guó)霧霾治理過程中行政問責(zé)的理論研究。
[Abstract]:Since 2013, there have been more than 10 large scale haze weather in China, haze days is the most in more than 50 years, for the public health, traffic safety. Economic development and other aspects have caused serious impact, the governance of haze is imminent. However, the haze governance in our country in theory and practice can not meet the needs of the current haze governance. Administrative accountability is a kind of accountability through the accountability of the accountability of the object of accountability. In order to standardize the behavior of the object of accountability, correct the function of the mechanism of accountability. In the governance process of haze in China, the introduction of administrative accountability mechanism can play a role in the correction of norms. At the same time, there is also the use of the image of responsible government. Under the efforts of the Ministry of Environmental Protection and governments at all levels, many cities have put forward and implemented the haze weather management measures according to their own situation, with different results. In March 2013, the Ministry of Environmental Protection proposed to realize the administrative accountability of air pollution through assessment and assessment, the results of which were made public, and some cities put it into practice. Through the achievement of air pollution prevention and control into the performance test to achieve accountability, but in the actual operation of haze weather control administrative accountability process has emerged because of the administrative accountability object. Accountability applicable responsibility system and accountability of responsibility results in the implementation of factors such as deviations resulting in administrative accountability of the functional alienation phenomenon. First of all, this paper from the haze governance. China's haze governance administrative accountability and our country's haze governance administrative accountability function of the three levels of analysis of the ought and the actual situation, and then through the contrast between the ought and the actual situation. Put forward three administrative accountability factors deviation leading to the phenomenon of functional alienation, through the description of alienation phenomenon, the reasons for investigation, the mechanism of action and corrective measures are studied. In the new environment, the haze governance environment studies the function of administrative accountability from a new perspective, which enriches the theoretical study of administrative accountability in the process of haze governance in China.
