【摘要】：按照龐德利益理論的觀點,文明就是人類對外在的或物質(zhì)自然界和對人類的內(nèi)在的或人類本性的最大限度的控制。在當代社會,人類對于文明的維系主要依賴于法律,而法律則主要通過對利益的"承認—選擇—保護"來推動文明的發(fā)展。生態(tài)文明作為一種新的文明形式,其特點就在于其對于人類社會中的各種環(huán)境利益能夠進行系統(tǒng)的識別和保護。生態(tài)文明中的環(huán)境利益可以分為個人利益,公共利益以及社會利益。環(huán)境法應(yīng)當通過多種權(quán)利、義務(wù)以及權(quán)力的路徑來實現(xiàn)對環(huán)境利益的保護,進而推動生態(tài)文明的建立。
[Abstract]:According to Pound's theory of interest, civilization is the greatest control of human beings' external or material nature and the inherent or human nature of human beings. In modern society, the maintenance of civilization is mainly dependent on law, while law mainly promotes the development of civilization through the recognition, selection and protection of interests. As a new form of civilization, ecological civilization is characterized by its systematic identification and protection for various environmental interests in human society. The environmental interests in the ecological civilization can be divided into individual interests, public interests and social interests. Environmental law should protect the interests of the environment through a variety of rights, obligations and power, and then promote the establishment of ecological civilization.
