農(nóng)村集體土地“三庫”集成方法研究

【摘要】:伴隨著計算機、數(shù)據(jù)庫以及網(wǎng)絡(luò)技術(shù)的發(fā)展,全國土地數(shù)據(jù)的管理實現(xiàn)了信息化,避免了原本紙質(zhì)管理的不足。隨著各農(nóng)村集體土地確權(quán)登記發(fā)證工作的推進,各地紛紛建立了“三庫”,即:農(nóng)村集體土地所有權(quán)數(shù)據(jù)庫、農(nóng)村集體建設(shè)用地使用權(quán)數(shù)據(jù)庫、農(nóng)村集體土地承包經(jīng)營權(quán)數(shù)據(jù)庫來管理集體土地,然而隨著農(nóng)村集體土地內(nèi)的各類土地的不斷流動,造成土地權(quán)屬界線不清晰,進而導(dǎo)致農(nóng)村矛盾加劇,因此迫切需要對農(nóng)村內(nèi)部的各類土地進行統(tǒng)一管理來明確土地的界限,保護土地權(quán)利人的合法權(quán)益。本文嘗試對農(nóng)村集體土地“三庫”進行集成。在農(nóng)村集體土地“三庫”集成方法的研究過程中,本文首先對農(nóng)村集體土地所有權(quán)、使用權(quán)以及對應(yīng)的數(shù)據(jù)庫進行了研究和分析,奠定了“三庫”集成的理論基礎(chǔ);其次對“三庫”中空間數(shù)據(jù)的含義、組織與管理、屬性數(shù)據(jù)、權(quán)利主體信息等進行了具體的探討與設(shè)計;最后結(jié)合具體的數(shù)據(jù)完成了“三庫”的集成,實現(xiàn)了圖形與屬性的查詢,并對“三庫”的實際應(yīng)用進行了分析研究。本文主要做了以下工作:(1)以農(nóng)村集體土地權(quán)利為基礎(chǔ),對相應(yīng)的“三庫”:農(nóng)村集體土地所有權(quán)數(shù)據(jù)庫、農(nóng)村集體建設(shè)用地使用權(quán)數(shù)據(jù)庫、農(nóng)村集體土地承包經(jīng)營權(quán)數(shù)據(jù)庫從目的、數(shù)學(xué)基礎(chǔ)、數(shù)據(jù)庫內(nèi)容以及權(quán)屬調(diào)查等方面進行分析。(2)將土地權(quán)屬與土地用途相結(jié)合,對農(nóng)村集體土地的地類圖斑劃分為:建設(shè)用地使用權(quán)宗地、農(nóng)業(yè)用地使用權(quán)宗地、地類圖斑地塊,并解釋了各部分的含義,為“三庫”的空間數(shù)據(jù)組織奠定了理論基礎(chǔ)。(3)以現(xiàn)有農(nóng)村集體土地數(shù)據(jù)庫為基礎(chǔ),具體設(shè)計了“三庫”的空間數(shù)據(jù)的組織與管理方式,并設(shè)計每個圖層的屬性結(jié)構(gòu),使得“三庫”集圖形與屬性于一體;同時為實現(xiàn)土地確權(quán)的目的,對土地確權(quán)過程中的權(quán)利主體進行總結(jié)并設(shè)計了其信息表,將土地與權(quán)利主體聯(lián)系起來,這也是“三庫”的現(xiàn)實需要。(4)運用Arc GIS軟件的個人數(shù)據(jù)庫功能,結(jié)合榆林市榆陽區(qū)項目數(shù)據(jù),對數(shù)據(jù)庫的空間數(shù)據(jù)進行了集成實現(xiàn),并實現(xiàn)圖形屬性信息的查詢,做到圖屬一致。(5)分析了“三庫”在不動產(chǎn)統(tǒng)一登記工作、土地確權(quán)登記發(fā)證工作、基本農(nóng)田劃定工作、土地勘測定界工作這四方面的應(yīng)用!叭龓臁钡膶崿F(xiàn),可以對農(nóng)村集體內(nèi)的各類土地以及房屋進行統(tǒng)一組織與管理,避免土地在流轉(zhuǎn)過程中出現(xiàn)的權(quán)屬界線不清而導(dǎo)致的農(nóng)村矛盾加劇的現(xiàn)象,有力保護各農(nóng)民集體以及農(nóng)民的土地財產(chǎn)權(quán)不受侵犯,同時為農(nóng)村不動產(chǎn)登記工作提供數(shù)據(jù)支持。
[Abstract]:With the development of computer, database and network technology, the management of national land data realizes information, and avoids the shortage of original paper management. With the promotion of the registration and issuance of the rural collective land ownership, three databases have been set up, namely, the rural collective land ownership database, the rural collective construction land use right database, the rural collective construction land use right database, the rural collective land ownership database and the rural collective construction land use right database. Rural collective land contractual management right database to manage collective land, but with the continuous flow of all kinds of land in rural collective land, the land ownership line is not clear, which leads to the intensification of rural contradictions. Therefore, there is an urgent need for unified management of all kinds of land in rural areas in order to define the limits of land and protect the legitimate rights and interests of land owners. This paper attempts to integrate the three libraries of rural collective land. In the research process of the integration method of rural collective land "three bases", this paper firstly studies and analyzes the ownership, right of use and corresponding database of rural collective land, which lays the theoretical foundation of the integration of "three bases". Secondly, the meaning of spatial data, organization and management, attribute data and rights subject information in "three databases" are discussed and designed in detail. Finally, the integration of "three libraries" is completed, the query of graph and attribute is realized, and the practical application of "three libraries" is analyzed and studied. This paper mainly does the following work: (1) based on the rural collective land rights, the corresponding "three libraries": rural collective land ownership database, rural collective construction land use right database, The database of rural collective land contractual management right is analyzed from the aspects of purpose, mathematical basis, database content and title investigation. (2) combine land ownership with land use, etc. The land types of rural collective land are divided into three parts: the right to use construction land, the right to use agricultural land, the plot of land type, and the meaning of each part. It lays a theoretical foundation for the spatial data organization of the "three bases". (3) based on the existing rural collective land database, the organization and management of the spatial data of the "three databases" are designed, and the attribute structure of each layer is designed. Make the "three libraries" graphics and attributes in one; At the same time, in order to realize the purpose of confirming the right of land, the subject of the right in the process of confirming the right of the land is summarized and its information table is designed, which connects the land with the subject of the right. This is also the practical need of "three libraries". (4) using the personal database function of Arc GIS software, combining the project data of Yuyang District of Yulin City, the spatial data of the database is integrated, and the query of graphic attribute information is realized. (5) the application of "three bases" in the unified registration of real estate, the registration and issuance of land confirmation rights, the delineation of basic farmland, and the work of land survey and demarcation are analyzed. The realization of "three storehouses" can organize and manage all kinds of land and houses in rural collectives in a unified way, and avoid the phenomenon of aggravation of rural contradictions caused by unclear boundary of ownership of land in the course of land circulation. It has the ability to protect the farmers' collective and farmers' land property rights from infringement, and to provide data support for the registration of rural real estate.
