構(gòu)建重大事故有效反省機(jī)制

【摘要】：為克服我國反省機(jī)制在追究事故深層原因、保障反省效果、分配多方權(quán)責(zé)關(guān)系等方面的不足,選取4個國內(nèi)外典型的重大災(zāi)難事件,剖析其反省過程,基于2004—2015年相關(guān)安全生產(chǎn)法律的修訂情況及重大事故發(fā)生起數(shù),探討重大規(guī)制反省路徑。分析發(fā)現(xiàn),目前我國反省周期較短,反省力較弱,反省效果難以長久延續(xù),我國現(xiàn)有的反省主體三角結(jié)構(gòu)存在僵化缺陷,而歐美采用的四角制衡結(jié)構(gòu)彈性較強(qiáng)。提出的反省機(jī)制總體框架,可明確從行為、社會、制度等3方面構(gòu)建穩(wěn)固有效的反省機(jī)制,從組織檢討、風(fēng)險推演、改進(jìn)、聯(lián)動等4大機(jī)制內(nèi)涵中提取有效反省保障體系。
[Abstract]:In order to overcome the shortcomings of our country's introspection mechanism in investigating the deep causes of the accident, ensuring the effect of introspection and distributing the relationship between power and responsibility, four typical major disaster events at home and abroad are selected, and the process of introspection is analyzed. Based on the revision of relevant laws on safety in production from 2004 to 2015 and the number of major accidents, this paper probes into the path of major regulatory introspection. It is found that the period of introspection is short, the introspection is weak, the effect of introspection is difficult to last for a long time, the existing triangular structure of introspection in our country is rigid and defective, and the four-angle check and balance structure adopted in Europe and America is more flexible. The overall framework of the introspection mechanism can clearly construct a stable and effective introspection mechanism from three aspects of behavior, society and system, and extract an effective introspection security system from the four connotations of organizational review, risk deduction, improvement and linkage.
