【摘要】：如今,安全舉報(bào)投訴作為社會(huì)公眾參與和監(jiān)督安全生產(chǎn)工作的重要渠道,及時(shí)發(fā)現(xiàn)安全生產(chǎn)事故隱患和違法違規(guī)行為的重要途徑,化解社會(huì)矛盾的重要窗口,是鼓勵(lì)市民、職工監(jiān)督舉報(bào)各類安全隱患和事故的重要保障,能夠及時(shí)化解一些因安全生產(chǎn)違法違規(guī)行為而導(dǎo)致的社會(huì)矛盾,促進(jìn)政府安全生產(chǎn)監(jiān)管責(zé)任和企業(yè)安全生產(chǎn)主體責(zé)任的落實(shí)。加強(qiáng)安全舉報(bào)投訴工作的建設(shè)是符合國(guó)家“十二五”安全生產(chǎn)中心工作的迫切需求,不僅對(duì)于北京而且對(duì)于加強(qiáng)全國(guó)安全生產(chǎn)監(jiān)管和社會(huì)監(jiān)督體系的建設(shè)也具有重要的現(xiàn)實(shí)意義。 本調(diào)研以北京市12350舉報(bào)投訴中心為窗口,以探討如何建立和不斷完善安全生產(chǎn)舉報(bào)投訴工作機(jī)制為目標(biāo),通過(guò)調(diào)研北京市安全生產(chǎn)舉報(bào)投訴中心工作的運(yùn)營(yíng)模式,了解其組織機(jī)構(gòu)和職能設(shè)置,明確了舉報(bào)投訴中心工作是否能夠順利進(jìn)行,舉報(bào)投訴中心的工作是否在政府安全生產(chǎn)監(jiān)管中發(fā)揮了作用,取得了哪些具體成果等這些問題,同時(shí)也發(fā)現(xiàn)了不足,舉報(bào)投訴管理體系需要進(jìn)一步優(yōu)化,通過(guò)借鑒美國(guó)安全舉報(bào)投訴機(jī)制相對(duì)完善的法律體系和舉報(bào)程序以及更加明確的舉報(bào)件分類和較為直接處理方式,來(lái)促進(jìn)我國(guó)舉報(bào)投訴工作的科學(xué)化、規(guī)范化。通過(guò)比較中美舉報(bào)件參與人員、舉報(bào)投訴法律和管理機(jī)構(gòu)的比較,總結(jié)出我國(guó)安全舉報(bào)機(jī)制需要在宣傳、業(yè)務(wù)培訓(xùn)、綜合執(zhí)法、信息有效分類和嚴(yán)格保密方面進(jìn)行加強(qiáng)。
[Abstract]:Nowadays, as an important channel for the public to participate in and supervise the work of safety production, it is an important window for the public to timely discover hidden dangers of accidents and violations of laws and regulations in production safety and to resolve social contradictions. It is an important window to encourage the public to do so. The important guarantee of staff supervision to report all kinds of safety hidden dangers and accidents can resolve some social contradictions caused by illegal and illegal activities in production safety in time and promote the implementation of the responsibility of government supervision over production safety and the responsibility of the main body responsible for production safety in enterprises. To strengthen the construction of safety reporting and complaint work is in line with the urgent need of the work of the national work safety center in the 12th Five-Year Plan. It has important practical significance not only for Beijing but also for strengthening the construction of national safety production supervision and social supervision system. This investigation takes the Beijing 12350 report and complaint Center as the window, discusses how to establish and improve the work mechanism of reporting and complaint in production safety, and investigates the operation mode of the work of Beijing reporting and complaint Center on production Safety. To understand its organizational structure and functional establishment, and to clarify whether the work of the reporting and complaint centre can be carried out smoothly, whether the work of the reporting and complaint centre has played a role in the supervision of government work safety, and what concrete results have been achieved, and so on. At the same time, it has also found that the reporting and complaint management system needs to be further optimized. By drawing lessons from the relatively perfect legal system and reporting procedures of the United States security reporting and complaint mechanism, as well as a clearer classification and more direct handling of the complaints, To promote the scientific and standardized reporting of complaints in China. Through the comparison between Chinese and American whistleblower participants, the law and management agencies of reporting complaints, it is concluded that China's security reporting mechanism needs to be strengthened in the aspects of propaganda, business training, comprehensive law enforcement, effective classification of information and strict confidentiality.
