【摘要】：行業(yè)協(xié)會(huì)是市場經(jīng)濟(jì)國家普遍存在的一種社會(huì)團(tuán)體組織，在現(xiàn)代市場經(jīng)濟(jì)國家中，行業(yè)協(xié)會(huì)在促進(jìn)行業(yè)發(fā)展、規(guī)范行業(yè)秩序、監(jiān)督行業(yè)行為等方面起著重要作用。梅州市特種設(shè)備行業(yè)協(xié)會(huì)是梅州唯一的特種設(shè)備方面的行業(yè)協(xié)會(huì)，它作為政府與企業(yè)之間的重要橋梁紐帶，一方面宣傳貫徹特種設(shè)備有關(guān)的法律、法規(guī)、規(guī)章、安全技術(shù)規(guī)范和標(biāo)準(zhǔn)，承擔(dān)政府有關(guān)部門委托的特種設(shè)備的有關(guān)事務(wù)；另一方面面向企業(yè)和個(gè)人提供行業(yè)信息、技術(shù)標(biāo)準(zhǔn)、技術(shù)資料，開展學(xué)術(shù)交流和技術(shù)服務(wù)，對(duì)推動(dòng)梅州市特種設(shè)備行業(yè)自律和協(xié)助政府部門實(shí)施特種設(shè)備安全監(jiān)察發(fā)揮著積極的作用。但同時(shí)也面臨著協(xié)會(huì)服務(wù)能力不足、管理體制不健全、自身功能不完善、法律環(huán)境缺失等問題。梅州市特種設(shè)備行業(yè)協(xié)會(huì)當(dāng)前面臨的問題，是我國特種設(shè)備行業(yè)協(xié)會(huì)總體問題的地方化、具體化，也是全國很多地方特種設(shè)備行業(yè)協(xié)會(huì)不同程度存在的，不是孤立的個(gè)案。所以，通過研究梅州市行業(yè)協(xié)會(huì)參與特種設(shè)備安全監(jiān)管中面臨的問題及提出相應(yīng)的對(duì)策，給我國行業(yè)協(xié)會(huì)參與特種設(shè)備安全監(jiān)管提供一些借鑒。 論文由五章構(gòu)成。第一章為文章的緒論，主要介紹了本文的選題背景和研究意義、國內(nèi)外研究現(xiàn)狀、研究思路和研究方法以及研究的主要內(nèi)容。第二章是梅州市特種設(shè)備行業(yè)協(xié)會(huì)參與特種設(shè)備安全監(jiān)管現(xiàn)狀分析，介紹了當(dāng)前梅州市特種設(shè)備安全監(jiān)管形勢(shì)、梅州市特種設(shè)備行業(yè)協(xié)會(huì)的發(fā)展歷程，從提供專業(yè)技術(shù)支持、促進(jìn)行業(yè)溝通交流、協(xié)助政府實(shí)施監(jiān)管、促進(jìn)行業(yè)自律管理等方面介紹了梅州市行業(yè)協(xié)會(huì)參與特種設(shè)備安全監(jiān)管的主要成效，采用調(diào)查問卷的方式進(jìn)行調(diào)研，并分析得出梅州市行業(yè)協(xié)會(huì)參與特種設(shè)備安全監(jiān)管存在的主要問題。第三章是梅州市行業(yè)協(xié)會(huì)參與特種設(shè)備安全監(jiān)管存在問題的原因分析，從內(nèi)外兩方面約束因素進(jìn)行分析，其中外部約束因素包括傳統(tǒng)的政府治理理念影響、行業(yè)協(xié)會(huì)的法制建設(shè)滯后、行業(yè)協(xié)會(huì)社會(huì)認(rèn)可程度低，，內(nèi)部約束因素包括行業(yè)協(xié)會(huì)發(fā)展的獨(dú)立性弱、行業(yè)協(xié)會(huì)管理制度不健全、行業(yè)協(xié)會(huì)自身能力不夠了強(qiáng)。第四章是國外行業(yè)協(xié)會(huì)參與特種設(shè)備安全監(jiān)管對(duì)梅州的啟示，分別對(duì)美國、歐盟、日本行業(yè)協(xié)會(huì)參與特種設(shè)備安全監(jiān)管的做法與啟示進(jìn)行了分析。第五章是對(duì)梅州市行業(yè)協(xié)會(huì)參與特種設(shè)備安全監(jiān)管提出對(duì)策建議，分別從外部環(huán)境支持和自身能力建設(shè)兩個(gè)方面提出了對(duì)策，外部環(huán)境支持方面包括改革現(xiàn)行管理體制、加快政府職能轉(zhuǎn)變、建立健全法律法規(guī)、加強(qiáng)行業(yè)文化建設(shè)等；自身能力建設(shè)方面包括建立科學(xué)合理的內(nèi)部管理機(jī)制、拓寬行業(yè)協(xié)會(huì)的籌資渠道、加快行業(yè)協(xié)會(huì)人才結(jié)構(gòu)調(diào)整、提升行業(yè)協(xié)會(huì)有服務(wù)能力、加強(qiáng)行業(yè)協(xié)會(huì)對(duì)外交流合作、建立行業(yè)協(xié)會(huì)的自律機(jī)制等。
[Abstract]:Industry Association is a social organization widely exists in market economy countries, in the modern market economy, industry associations in promoting the development of the industry, regulate trade order, plays an important role in industry supervision behavior. Meizhou special equipment industry association is the only Meizhou special equipment industry association, it is an important bridge the link between the government and enterprises, on the one hand, carrying out the law, special equipment related laws, regulations, technical specifications and safety standards, the relevant bearing special equipment entrusted by the relevant departments of the government service; on the other hand, for enterprises and individuals to provide industry information, technical standards, technical information, carry out academic exchanges and technical services. To promote the Meizhou special equipment industry self-regulation and assist the government departments in the implementation of special equipment safety supervision plays a positive role. But it also faces the co Service ability is insufficient, imperfect management system, its function is not perfect, the lack of legal environment. Meizhou special equipment industry association facing problems, is the general problem of special equipment industry association of China's local, specific, there is a lot of local National Association of special equipment in different degrees, not isolated a case study of Meizhou city. So, by industry associations to participate in the special equipment safety supervision problems and put forward corresponding countermeasures to China's Industry Association to participate in the safety supervision of special equipment to provide some reference.
This thesis consists of five chapters. The first chapter is the introduction, mainly introduces the research background and significance, research status at home and abroad, the main content of research ideas and research methods and research. The second chapter is the analysis of the present situation of special equipment safety supervision in Meizhou City special equipment industry association, introduced the Meizhou special equipment safety supervision situation, the development of Meizhou City special equipment industry association, from providing professional technical support, promote the communication industry, to assist the government to implement the regulation, the main effect in Meizhou city industry association to participate in the safety supervision of special equipment to promote self-discipline management, using the method of questionnaire investigation, and analysis of Meizhou city industry associations to participate in the main problems of safety supervision of special equipment. The third chapter is the Meizhou Municipal Industry Association to participate in the special equipment safety supervision Analysis of the causes of the problems, analyzed from two aspects of internal and external constraints, the external constraint factors include the influence of traditional idea of government management, the legal system lags behind industry associations, industry associations and social recognition degree is low, the internal constraint factors include independent development of industry association is weak, the trade association management system is not perfect, the industry association's own ability not enough. The fourth chapter is the foreign industry associations to participate in the revelation of the safety supervision for special equipment to Meizhou, to the United States, the European Union, law and Enlightenment of Japanese industry association to participate in the safety supervision of special equipment were analyzed. The fifth chapter is about the Meizhou city industry association to participate in the safety supervision of special equipment of countermeasures, countermeasures are put forward respectively. From the external environment and their ability to support the construction of two aspects, including the external environment support to reform the existing management system, and government functions Can change, establish and improve laws and regulations, strengthen its cultural construction; its capacity building including the establishment of a scientific and reasonable internal management mechanism, broaden the financing channels of trade associations, accelerate the restructuring of industry associations, industry associations to enhance service ability, foreign exchanges and cooperation with industry associations, establish the self-discipline mechanism of Industry Association.
