上世紀(jì)七十年代末開(kāi)始,我國(guó)知識(shí)產(chǎn)權(quán)制度開(kāi)始建立,先后出臺(tái)了《商標(biāo)法》、《專利法》、《著作權(quán)法》、《反不正當(dāng)競(jìng)爭(zhēng)法》等有關(guān)知識(shí)產(chǎn)權(quán)保護(hù)的基本法律。隨著改革開(kāi)放的深入和經(jīng)濟(jì)的發(fā)展,知識(shí)產(chǎn)權(quán)立法工作面臨著前所未有的挑戰(zhàn),需要滿足不斷增長(zhǎng)的新要求。我國(guó)高新技術(shù)產(chǎn)業(yè)從零起步走向全面發(fā)展,已經(jīng)成為國(guó)民經(jīng)濟(jì)中增長(zhǎng)最為迅速的產(chǎn)業(yè)部門(mén),高新技術(shù)企業(yè)的發(fā)展與知識(shí)產(chǎn)權(quán)及其保護(hù)密切相關(guān)。對(duì)高新技術(shù)企業(yè)來(lái)說(shuō),如何促進(jìn)高新技術(shù)企業(yè)的技術(shù)創(chuàng)新以便擁有自主知識(shí)產(chǎn)權(quán)并能進(jìn)行有效保護(hù),已經(jīng)成為必須解決的問(wèn)題。沒(méi)有知識(shí)產(chǎn)權(quán)法律的保障,高新技術(shù)的發(fā)展就缺乏強(qiáng)大的動(dòng)力機(jī)制,高新技術(shù)產(chǎn)業(yè)發(fā)展將成為無(wú)源之水。對(duì)于高新技術(shù)企業(yè)以及政府各相關(guān)部門(mén)而言,深入剖析高新技術(shù)企業(yè)的知識(shí)產(chǎn)權(quán)保護(hù)現(xiàn)狀、存在問(wèn)題及其內(nèi)在原因,并借鑒國(guó)內(nèi)外的先進(jìn)經(jīng)驗(yàn),在知識(shí)產(chǎn)權(quán)法律制度的框架下,從戰(zhàn)略高度提出保護(hù)高新技術(shù)知識(shí)產(chǎn)權(quán)的戰(zhàn)略和措施,具有十分重要的現(xiàn)實(shí)意義。本文對(duì)中國(guó)在入世后,在高新技術(shù)知識(shí)產(chǎn)權(quán)保護(hù)方面所面臨的知識(shí)產(chǎn)權(quán)保護(hù)的問(wèn)題進(jìn)行了分析,發(fā)達(dá)國(guó)家美國(guó)及發(fā)展中國(guó)家印度在高新技術(shù)知識(shí)產(chǎn)權(quán)保護(hù)方面做的相當(dāng)出色,他們的許多經(jīng)驗(yàn)中國(guó)是可以有所借鑒的。高新技術(shù)知識(shí)產(chǎn)權(quán)...
